So - the most surprising thing to me about the Cheeto over Christmas - is that he does appear to have stayed put in DC and not decamped to Florida. I know someone was saying there wasnโt a marine stationed outside his door or whatever as if to prove heโd gone - but surely if he had gone - we would have heard. And they flew his whore back from Florida - so it seems unlikely he managed to get there...?

The Trump administration is considering a far-reaching rollback of civil rights law that would dilute federal rules against discrimination in education, housing and other aspects of American life, people familiar with the discussions said.

Any "news" relating to AOC or any of the progressives trying to "undermine" Pelosi or the Dem party needs to be taken with a huge grain of salt. Yesterday there was a push on the Part 71 thread to spread the word that the progressive caucus was going to kill Pelosi's paygo rules. Once again, it's all overblown. The dispute is one over strategy, not substance, and it's not that big a dispute anyway since the progressive caucus isn't trying to whip votes against Pelosi and has already accepted her word that she won't let the rule impeded progressive legislation. The real problem is a LAW that is beyond mere House rules. The people voting against Pelosi's rule package are repping the wishes of their deep-blue districts and they're not actually undermining anything. WHICH PELOSI HAS ALWAYS BEEN DOWN FOR. Pelosi is known for telling fellow Dems to turn on her if needed to win.
Remember: major media has a preexisting narrative about Dems that it pushes regardless of reality. Dems are always losing, weak, in crisis or infighting. So, from the D.C. Circuit's decision we learned that a foreign government was actively involved in blocking Muellerโs investigation. That fact is intriguing enough. In the ordinary course, that should have been the end of it. The state-owned Corporation filed an appeal with the Supreme Court, which receives roughly 7,000 petitions a year but acts in fewer than 200 of them. There was unanimity below โ all four judges (the District Court judge and the three Circuit Court judges) had agreed that the Corporation and Country Aโs legal claims of sovereign immunity and of contrary foreign law were without merit. There was little reason for judicial watchers to expect anything beyond a quiet return to the grand jury and further proceedings there. We headed off for the holidays.
And then came Robertsโ surprise Sunday decision. He is the โcircuit justiceโ for the D.C. Circuit, meaning he is the justice assigned to receive emergency and other petitions arising from that circuit. Under Supreme Court rules, the circuit justice may act without consulting his or her colleagues to dispose of routine rulings. So, we should not read too much into the fact that it is the chief justice in particular who acted here.
But we can read a good deal into his decision to intervene at all. Although every judge below agreed there was ultimately no merit to the Corporationโs legal claims, Roberts evidently harbors some doubt. Something in the Corporationโs papers caught his attention. So rather than consigning this appeal to the discard pile with thousands of others, he has blocked the lower courtsโ decisions until he can receive the governmentโs briefs defending those decisions. Those papers must be filed no later than New Yearโs Eve. Once he receives the full briefing, he can reject the Corporationโs appeal or he can advance the matter to the full court for consideration.
Until then, we can only wonder at the remarkable circumstance that the chief justice of the United States has personally intervened, at the request of a foreign government through its corporate entity, in Muellerโs investigation. Only two days before, court observers noted that in a high-profile asylum decision, Roberts had sided with his four liberal colleagues against the Trump administration. Many observers took that as evidence that Roberts was carefully seeking to preserve the courtโs institutional neutrality, integrity and balance.
What are we to make of his pre-Christmas intervention on behalf of Country A and the Corporation, and against Muellerโs office? We may know soon. Muellerโs office filed its submission early, on Friday evening. Weโll keep our eyes glued to the docket.

Regarding Justice Roberts intervention in the secret case....Some of you, reporters included, are way over thinking this.
1. Roberts did not out of the blue decide to intervene in the case. He is the Justice that oversees the DC Circuit.
2. The mystery corporation lost the last round at the Circuit and THEY APPEALED TO THE SC. It is standard procedure.
3. Roberts will either let the Circuit decision stand, or he will refer the matter for the full court.

I think that you may have it a bit confused. The shutdown will not stop the criminal cases from going forward. Mueller's office is exempt (as are almost all federal criminal prosecutors). The shutdown has, however, stopped any of the Trump civil lawsuits from going forward (like the Emoluments Clause case) because the Justice Department's civil attorneys are furloughed and not exempt from the shutdown.

The emoluments case despite being a civil case is actually really important imho because;
1) There is settled law that the President can be the subject of civil prosecution.
2) Itโs very specifically an activity a sitting President is not allowed to as per the constitution. As such a finding against could lay the groundwork for impeachment charges in a way that would be appealing to people who take the view that the President is generally above the law.

A subpoena is issued by the the Court. If refused, the judge has a couple options, but basically Individual -1 can be compelled to comply, either by fines or jail time. His answer may indict himself as well!

The news media must challenge him. There are not two sides to this. There is no threat to our southern border. This needs to be emphasized. It is not a matter of opinion. It is a fact. They'd also have enough votes to override a Presidential veto. Trump has demonstrated he is perfectly happy violating the Constitution. He isn't inventing this by himself. He is being guided in this. Advised.He has a natural inclination towards authoritarianism, but he wouldn't have the sense to figure out how to get there. We are in a crisis right now and Pelosi isn't going to get us out by herself. She is a strong leader and she has massive support, but the fucking Republicans in the Senate hold the key right now and they absolutely must step up.

Jeffrey Toobin was on yesterday with Wolf, and they discussed the whole "emergency" thing and he said legally it gets very crazy, that the courts may not be able to do anything to stop him on legal grounds, and honestly, the court would probably rule cautiously on any matter where national security is invoked. I found that very scary. They can't keep waiting until the next worse thing happens. They need to act now. I understand the unions are suing him because workers are being forced to work without pay. Thanks, R427 it has been mentioned on MSNBC, but it hasn't been highlighted nearly enough. There is also something else to consider. Since the moneys have been appropriated and the spending bills signed into law, it is illegal to block these funds and prevent programs already approved by Congress from being implemented. There have been other instances when a POTUS has refused to spend money allocated for something he disagreed with and he has been taken to court by 3rd parties with an interest. I guess we need one of our government experts to discuss this intelligently, but we have to be more aggressive with this turd. We have to stop him now. And honestly all his bullshit in the rose garden runs completely counter to the facts. The main thing is that we have to have a sense of urgency about this. And I think pressuring some of the GOP Senators to withhold their votes from McConnell until he puts this to a vote is the way to go. We need to find out which Senators are waivering and pressure them....even Susan Collins.... I know. But I think at this point we need to stop running to the WH to negotiate. He is loving that spectacle and it makes us look like supplicants. I think we need to isolate him and shift attention to McConnell and the Senate. THose fuckers passed a bill just before Christmas with 90 votes. Bi-partisan. 1. Trump says he would sign a particular bill on the topic.
2. The House passes the bill.
3. The Senate passes the bill by voice vote, meaning is was so o erwhelming that a recorded vote was not necessary.

There are something like 14,000 kids living in tents in Texas and contractors run those. In fact there are a lot of sub contractors working with the DHS. She is passing the exact same bills that the Rethuglican controlled House and Senate passed last year -- minus the money for the stupid, fucking wall. She is just doing it one-by-one to get the government open again. It is difficult to see her losing the media / public relations battle in this case. This is a smart approach, and the Repukes in the Senate will cave. Most of them believe the wall is an absurd waste of money. And, even if they don't they can read the polls -- this is a very unpopular idea.

r492 The Senate filibuster still applies all votes except court confirmations. When the minority party decides to filibuster, it takes 60 Senators to pass a bill. Last year, McConnell needed nine or ten Democratic Senators to vote to override the filibuster and include Trump's wall funding in the budget. No way that was going to happen.

Both branches do not want it, R492, and the Senate dares not choose the 'nuclear' option knowing it will be used against them when the tables eventually turn. Down deep they know it's a Trump boondoggle. Unneeded, unnecessary and stupid and unpopular in some marginal states like Arizona and Texas where private property rights are sacred. Ranchers have cross-borderlands they graze. It's anti-environmental, cruel to migrating animals and would require the destruction of many sensitive and unique ecosystems.
It's not a simple build. They'll have to use eminent domain and adhere to state water regulations. I wouldn't trust this asshole with a crayon, let alone something this complicated.
No wall. Increase, modify and expand border facilities and patrols. Create little areas where you funnel them through and catch illegals. You want to come in? Use the gate we've already provided and do the appropriate paperwork to seek asylum. What we've now done is create those who are trying to do this as a 'criminal' class and the enemy. We've created fear around teenagers, children, women and yes, big bad hombres fleeing the horrible conditions of their country; conditions that in some cases we helped create.
We want an end to the carnage this man has created. Get rid of him, now.

This was 10 years ago, but Hakeem Jeffries (new chair of the House Democratic Caucus) used to come to some of my work events in his district when he was a state Assemblyman.
He's a really smart guy, and I think cares more about people and making things better, more than most politicians. He's more street fighter than you might think, which I hope bodes well for this new role in our new environment. I'm really pleased he's where he is now.
Tish James was at those events too when she was on the city council, and they got along well. Who knew then that they would both end up playing a role in taking back the country from perennial joke Donald Trump as President!
He's much better looking in person; his eyes are beautiful and pretty intensely green. I thought he had a gym body under those suits.
