It is because the constitution is so clear on this, that even they see the stupidity. Not to mention, if things can be overturned when written so obviously out right, they could undue the second amendment (which was never about private gun ownership, but militias, but whatever) or other things conservatives like.

That's exactly what a lifetime appointment to the Supremes was supposed to do -- insulate the judges from political considerations so they can follow the law and their conscience.
The Framers were pretty smart for the most part, at least for their time; and if we just follow the Constitution, things may turn out all right in the end.
