MAGA Rages at ‘DEI Pick’ Amy Coney Barrett for Defying Trump

Supreme Court Chief Justice John Roberts and Trump-appointed Justice Amy Coney Barrett sparked a MAGA meltdown Wednesday by siding with three liberal justices to reject the Trump administration’s request to withhold billions of dollars in foreign aid.

The administration had sought to renege on $2 billion in payments owed under existing USAID contracts. Now it must now comply with a Feb. 13 court order from District Judge Amir Ali and release the money after the Supreme Court went against President Donald Trump and refused to overturn Ali’s order.

Multiple MAGA influencers, including Mike Cernovich and Jack Posobiec called Barrett a “DEI” hire. “She is evil, chosen solely because she checked identity politics boxes,” Cernovich wrote. “Another DEI hire. It always ends badly.”

Hans Mahncke, a Substack personality with a Trumpian following, suggested that MAGA now has a “fight” on its hands. “The anti-Trump majority on the Supreme Court may have ruled that the federal government must pay for these canceled USAID projects, but that doesn’t mean the money should flow without a fight.”

He added: “This fight isn’t over—it’s just shifting to a different battlefield."

At one point during Trump’s address to Congress on Tuesday night, he shook the chief justice’s hand and said: “Thank you again. Thank you again. Won’t forget it.”

Roberts had paused the spending deadline implemented by Ali to allow the Supreme Court to review the administration’s request to side-step the lower court order. However, he chose to reject the government’s desired outcome on Wednesday.

Judge Ali had implemented a Feb. 26 payment deadline, before the case went before the Supreme Court. Wednesday’s decision was a 5-4 split against Trump, in a huge setback for the president.

The Supreme Court did not say when the funds must be released, with the original Feb. 26 deadline now passed. It instead instructed Ali to “clarify what obligations the government must fulfill to ensure compliance with the temporary restraining order, with due regard for the feasibility of any compliance timelines.”

The plaintiffs brought a case, scheduled for Thursday, concerning a preliminary injunction. Judge Ali currently has a temporary restraining order in place that lasts through March 10.

The Supreme Court has a 6-3 conservative majority. Samuel Alito, Clarence Thomas, Neil Gorsuch, and Brett Kavanaugh were the four who dissented Wednesday.

Alito, supported by the other three conservative judges, questioned Justice Ali’s jurisdiction over the case.

“Does a single district court judge who likely lacks jurisdiction have the unchecked power to compel the government of the United States to pay out (and probably lose forever) 2 billion taxpayer dollars? The answer to that question should be an emphatic ‘No,’ but a majority of this court apparently thinks otherwise,” Alito wrote. “I am stunned.”

I know that it's futile, but I truly hope that people like Barrett continue to be targeted and realize the error of their ways.

All the magats losing their cushy government jobs and the Muslims in Michigan who decided that Harris wasn't the better choice are in for a rude awakening.

While Alito and Thomas are hopeless, as are Kavanaugh and Gorsuch, if Roberts and Barrett occasionally operate based on the law and Constitution, as opposed to political agenda, perhaps there won't be a complete collapse of democracy.

MAGA activists have turned against one of President Donald Trump's own appointees to the Supreme Court: Justice Amy Coney Barrett.

Appointed by Trump in 2020, Barrett is a staunch conservative who has joined major rulings in which the court has moved U.S. law to the right, including on abortion and affirmative action.

But that's not enough for some of Trump's most aggressive supporters, who think the former Notre Dame Law School professor has been a disappointment. MAGA supporters see what some call an independent streak as a sign she isn't sufficiently aligned with or loyal to Trump.

"She is a rattled law professor with her head up her a--," said Mike Davis, who once clerked at the Supreme Court for Justice Neil Gorsuch and described Barrett as "weak and timid."

Barrett defenders have dismissed the attacks, scoffing at the idea that the justice’s conservatism is defined by how her decisions align with Trump and insisting Barrett won’t be affected by outside criticism. Barrett, reached via the Supreme Court, did not respond to a request for comment.

The anger from Davis and other right-wing personalities with large online followings stems mostly from a couple of recent high-profile, 5-4 decisions in which Barrett has been the deciding vote against Trump's side.

Swift and vicious reviews poured in from right-wing, Trump-allied figures this week when Barrett and other justices rejected a Trump administration attempt to avoid paying U.S. Agency for International Development contractors as ordered to by a federal judge.

"DEI judge," influencer Jack Posobiec posted on X, suggesting that Barrett was a "diversity, equity and inclusion" hire, presumably because she is a woman.

Trump at the time promised to pick a woman to replace liberal Justice Ruth Bader Ginsburg.

"Amy Coney Barrett was a DEI appointee," another far-right influencer, Laura Loomer, wrote.

Her X post featured a photo of Barrett's family. Barrett and her husband have seven children, including two they adopted from Haiti, who are Black.

Even Barrett's brief interaction with Trump earlier this week, when he delivered an address to Congress, has been scrutinized by the online MAGA set.

"Look at how Justice Amy Coney Barrett looks at our duly elected President, the man who put her on the Supreme Court. She looks very bitter," Rogan O'Handley, an influential MAGA figure on X known by his handle DC_Draino, wrote in a post containing a video of the encounter.

One law professor, Josh Blackman at South Texas College of Law Houston, suggested that Barrett should step down from her lifetime appointment to the Supreme Court so that Trump can pick a replacement.

The White House did not respond to a message seeking comment.

Barrett defenders have fought back, with Derek Muller, a Notre Dame law professor who studied under Barrett, saying in an interview he doubted she would be affected by the negative reactions.

"She has the resolve to be on the court just like the other justices do," he said. The justices know that "unpopularity is not a measure of what a judge is doing," he added.

The conservative National Review also weighed in, posting a column Thursday titled “In Defense of Justice Amy Coney Barrett,” deriding the criticism as “nonsense.”

Barrett's USAID vote followed a decision in January when the court, once again split 5-4, rejected Trump's request to block a sentencing hearing in his criminal hush money case in New York. The decision prompted angry reactions from pro-Trump voices including Davis.

In both cases, Barrett joined fellow conservative Chief Justice John Roberts in the majority, aligned with the three liberal justices.

Even before those cases, Barrett has increasingly shown a willingness to separate herself from the right flank of the court with a considered and cautious approach.

I like Amy Coney Barrett:

First, she is respectful and courteous to attorneys when she is questioning them. She doesn't interrupt and let's them speak.

Second, I have listened to a few of her speak at law school interviews, while I might disagree with her judicial philosophy, she is articulate and explains why she believes it.

Third, she is proving she is consistent with her beliefs and is not simply a partisan hack.

Fourth, she comes from the more white gloved version of the Republican Party. She is more like John Roberts, Hank Paulson, Robert Gates, Condi Rice, et. al. than the Kristi Noems and Stephen Millers.

Justice Barrett is, objectively, a brilliant legal mind. She's also generally polite, professional, and has a record as a good teacher.

R56 I doubt that, especially since Congress codified same-sex marriage and the Supreme Court already ruled in Obergefell that same-sex marriage was Constitutional.

The Court can only hear cases and controversies, so unless there is a case that directly relates to same-sex marriage AND the Court grants a writ of certiorari, then they will hear the case. They only need 4 votes to grant writ, and I doubt they will get four. Of the 6 "conservative" justices, I only see Thomas, Alito, and maybe Kavanaugh voting to grant writ.
