Daryl Hall is suing John Oates

Daryl Hall is suing John Oates.

The pop and R&B duo formed in Philadelphia in 1970 has forged one of the most successful alliances in musical history. In their heyday — between 1974 and 1991 — the partners scored 29 Top 40 hits and six that reached number one. They’ve been inducted together into both the Songwriters and Rock & Roll Hall of Fame and are generally considered the most commercially successful pop music duo of all time.

But all is not well in Hall and Oates land.

On Nov. 16, Hall filed a lawsuit against Oates in court in Nashville. Philadelphia Magazine reported the news after being posted on X, the platform formerly known as Twitter, by Tennessee-based Axios reporter Nate Rau last week.

What is the dispute dividing the duo, who first met in an elevator at the Adelphi Ballroom in West Philadelphia in 1967 while leading their own bands?

That is unknown. The file is sealed. It can only be seen by “Private Eyes,” so to speak. So we don’t know if the partners have, in fact, grown “Out of Touch,” to quote another 1980s chart-topping hit. Presumably, the lawsuit was filed in a Nashville Chancery Court because that’s where Oates lives.

Representatives for Hall, Oates, and Hall & Oates as a group, were contacted by The Inquirer for comment but had yet to respond at time of publishing.

In 2017, 2018, and 2021, Hall & Oates headlined their own Hoagie Nation festival in Philadelphia. The first two years were held at the Festival Pier on the Delaware River waterfront, and then in 2021, it moved to the Mann Center, where it appeared to be poised to take its place alongside the Roots Picnic as an annual event.

But the fest wasn’t staged in either of the last two years. The duo, who have worked together and apart for decades, played only a handful of dates in 2022, including one at the Hard Rock Hotel & Casino in Atlantic City, and none this year.

Meanwhile, they’ve been busy individually.

Particularly Hall. He’s been touring with fellow Philadelphia Todd Rundgren as an opening act, with upcoming shows this week in Japan and the Philippines. His webcast, Live From Daryl’s House, relaunched this month from its home base in Pawling, N.Y., with episodes featuring Glenn Tilbrook, Robert Fripp, and Lisa Loeb.

Oates is an active member of the creative community in Nashville, and appeared at the Americana Music Honors show in September. He has released a series of singles this year, the latest of which is “Too Late to Break Your Fall.”

If you haven't seen Daryl's House....do...there are a few seasons, and it is brilliant...it shows musicianship as opposed to the majority of today's auto-tuned corporate written performers. You can look at one of Beyonce's songs, and there are 10 writers...He has everyone from Smokey Robinson to Cheap Trick and today's pop musicians...it's amazing

For whatever it is worth, Celebrity Net Worth puts Hall at $70M and Oates at $60M. If Hall was the songwriter, he should be higher from song royalties. As said before, maybe this is about the split on any sale of the catalog, depending on who owns all those complex music rights.

It's really not that difficult to get a temporary order, and it has to be followed up with evidence to have the order extended and kept in place at a court hearing where the other party is allowed to dispute the order. Website's indicate a temporary order in Tennessee's lasts 15 days.

This is understandable if Oates is trying to sell off his rights to THEIR music. Say what you will, but it was Darryl Hall who was the frontman, the only real singer, and the one leading the videos and songs.

Oates always lacked charisma - he rarely ever even smiled - and just played his guitar on stage. He was completely forgettable and replaceable from an entertainment perspective.

Darryl carried John - and now wants to sell off rights to the music, which is going to end up costing Darryl a lot of money to play HIS OWN SONGS?

Relative talent and primacy in the band and videos doesn't matter in the legal dispute. It's simply whether Oates has the legal right to sell his half independently of Hall.

Music rights can be incredibly complex and fractured into pieces and specific use rights. From that article, it sounds like Hall transferred some or even the majority of his rights many years ago and regrets it. He is scrambling to preserve what he has. He is probably seeing some of the recent staggering prices to artists who manages to hold on to their rights. Think of Prince who changed his name to a symbol and Taylor Swift who rerecorded her original hits because she didn’t own the original recordings. Music copyright is an incredible maze.

I never understood Paul McCartney getting all angry at Michael Jackson for buying the Beatles' copyrights. I'm assuming the copyrights were for sale to the highest bidder. Paul could've bought the copyrights, too.

He comes across as ok in the Howard Stern interview, maybe it was pre grumpy old man. He has nothing bad to say about Oates and admits his collaborative contributions. The use of the term fag is very unfortunate and you can see he realized it was a mistake and tried to walk back use of "that term". He definitely retains the distinctive Philly accent.

Paul tried to purchase them, he approached Yoko Ono to try to put together an offer but she balked, so they lost out to MJ who at that time had a ton of cash and put in the highest bid.

I hear their songs on a number of commercials. I guess there will be more if Primary Wave gets total control with most of the royalties going to Primary Wave. That $25-50M for 50% back in 2007 doesn’t seem so good now.

The price paid for artist catalogs did sort of skyrocket in the mid/late 2010s, so it probably didn't seem that bad, even good, at the time. Probably undervalued, but it's still a lot of money that should last for a lifetime if managed correctly. Their catalog seems particularly amenable to being in used in commercials.
