It's also quite possible this was information about foreign nuclear programs or weapons (that US intelligence had secretly discovered) and not US nuclear programs. So other countries could be freaking out about this too.

R53, if Trump was deliberately hiding that information from the National Archives because he wanted to keep it, they wouldn't necessarily have known it was there to look for. (Their source now, supposedly, was someone in the Secret Service who clued them in.)

Perhaps the delay was for the FBI to get independent evidence that there is missing confidential material is in the hands of foreign agents. I don't see a treason charge.

So far it doesn't seem they can prove that Trump was trying to "levy war" against the US or try by force to stop a legal procedure with a force of people. I realize people want to suggest Trump directly led the January 6 riot at the Capitol but so far they don't seem to have the smoking gun that he planned this or told people to do what they actually did, i.e., break into the Capitol and try to stop a legal procedure. But you never know what they can still come up with. Planning the rally and even a march to the Capitol is not enough.

The second way to prove treason, i.e., by aiding and "giving comfort" to an enemy of the US requires us to be at war. There has to be an officially declared "enemy".

The search warrant they are asking the judge to unseal will not have the affidavit with it. So the warrant itself may prove disappointing in its lack of detail. It may only direct the seizure of specific boxes and numbered documents. We're certainly not going to see labeled documents especially if they are classified or about nuclear shit (actual Legal term). LOL!

While it doesn't seem to meet a definition of treason, it sounds treasony so not a good look and, if there is intent to do something that could harm the US, even if inadvertently, it seems fair to call him a traitor.

This is an interesting transcript of an interview with a former US Attorney from February 2022 when they discovered 15 boxes of papers Trump took with him to Florida and discusses the Presidential Papers and the powers of the president to classify and declassify documents which is pretty unfettered.

WASHINGTON (Reuters) - Tom Barrack, a billionaire friend of U.S. President Donald Trump, pursued a plan to buy Westinghouse Electric Corp even as he lobbied Trump to become a special envoy to promote the building by the firm of nuclear power plants in Saudi Arabia, said a congressional report released on Monday.

While Barrack failed in both efforts, the report provides fresh evidence of the ease with which some corporate and foreign interests have gained access to Trump and other senior members of his administration.

Documents obtained by the Democratic-led U.S. House of Representatives Oversight Committee raise “serious questions about whether the White House is willing to place the potential profits of the President’s friends above the national security of the American people and the universal objective of preventing the spread of nuclear weapons,” the report said.

The report is the second from the panel’s investigation into the plan to construct 40 nuclear power plants in Saudi Arabia and elsewhere in the Middle East. The plan was supported by Trump’s first national security adviser Michael Flynn, Barrack, Trump’s inaugural committee chairman, and a consortium of firms led by retired U.S. military commanders and former White House officials called IP3.

One company was Westinghouse, the only U.S. manufacturer of large reactors, which was bought out of bankruptcy by Brookfield Asset Management last August.

The report comes alongside a number of other investigations into the administration being conducted by the panel chaired by Representative Elijah Cummings - including into the use of personal texts and emails for official business by Trump’s daughter, Ivanka, and her husband, Jared Kushner.

Trump attacked Cummings, an African American from Baltimore, in weekend tweets that the president’s critics denounced as racist.

Monday’s report was based largely on thousands of documents provided by unidentified private companies. The White House, the report said, provided no documents, while other federal agencies submitted some.

There is no reason to think that Trump didn't offer or sell nuclear secrets. There's really only two reasons for him to have gone to all this trouble to keep that information for himself: to sell or provide to others, or to keep for himself with the idea that he could use it as blackmail or a threat.

We knew the day he left the White House that there were boxes of documents leaving the building that probably shouldn't have been taken, there were photos on Twitter of it. (Also, staff were taking little souvenirs like busts of Lincoln and such.) The National Archives was asking for those documents back throughout 2021. I don't think we heard much of anything about the June FBI seizure, either.

I couldn't even guess as to why the media wasn't all over this. It could simply be because they'd covered the National Archive story so much in 2021 that by 2022, they just didn't think it would get enough attention to make it profitable for them.

Not long after Trump gave back some of the documents in January 2022, there were articles like this one that mention he had torn up documents and staff had to tape them back together, but they bury the part about the documents only just having been returned, and that the documents were being reviewed by the Jan 6 committee.

Seriously, if you read this article, the most important stuff is at the bottom, while the least important stuff -- the cutesy "aw, he tore things up, they had to scotch tape it back together again" -- is the headline. It's baffling.

Trump would have never had access to launch codes unless a decision was made to approve a launch. The nuclear football (the briefcase the codes are kept in) isn't just laying around the White House in case it's needed. And even if the codes got into the hands of some foreign power it would have done them no good. There are multiple safeguards to prevent an unauthorized launch of nuclear weapons. And obviously the launch codes would be changed when a POTUS leaves office, and maybe even at times during his presidency.

If Trump took classified documents about nuclear weapons it probably was documents that included a diagram showing were every nuclear missile silo was located. If some rogue foreign power decided to launch against us they'd probably want to aim their missiles at all those sites, not that it would much good because we would have already launched our missiles.

WaPo's source said they were looking for "classified documents relating to nuclear weapons" and I have no reason not to believe them.

Obviously, we're not going to know the most sensitive stuff. They've already told us that they can't even describe some of the documentation because it's too sensitive. We saw someone enter 3 new sealed entries in the warrant docket as we waited for Garland to speak yesterday, so we know we'll never see that information, either.

Even if the information that's being speculated about isn't handled by the National Archives, the search warrant was reported to be broad, and they could have been looking for (and found) the classified nuclear information while they were looking for items the National Archive reported were missing.

What I'm saying is that there is no reason, right now, to automatically discount the very real possibility that Trump had sensitive nuclear information in the documentation that was seized.

I certainly don't believe that we have devastating national secrets typed up on pieces of paper, and that those pieces of paper are curated by the National Archives so that they are easily accessible. Not to mention that multiple federal employees would have to know what's on the paper and which papers aren't accounted for. Seems like a pretty elementary security flaw.

We'll see what happens, I predict that this will get exponentially stupider and weirder as time goes on and the cover story will make less and less sense as the days pass.

This is from the latest NYT article on this:

"Mr. Garland provided no details. But the person briefed on the matter [ie NYT's source] said investigators had been concerned about material from what the government calls “special access programs,” a designation that is typically reserved for extremely sensitive operations carried out by the United States abroad or for closely held technologies and capabilities."

So, not codes. Damaging stuff.

The article also says that although Trump is not opposing release of the warrant, "The Justice Department did not seek to release the affidavits — which contain much more information about the behavior of Mr. Trump and evidence presented by others — that were used to obtain the warrant." It looks like the inventory of items taken during the search will be released, but they may be described in quite general terms, for obvious reasons.

FBI agents found dozens of classified documents during their search of Trump’s Mar-a-Lago on Monday.

Sources say there were “boxes everywhere,” with some containing Top Secret Sensitive Compartmented Information (TS/SCI). Those are considered some of the highest level of classified documents.

Since the documents are so secretive, it’s unknown whether investigators will ever publicly acknowledge what they’re in reference to, let alone release them.
