Unpaywalled version of the LAtimes update

Cameras at the warehouse captured Cabrales and Giles leaving the party with Pearce, Ansbach and Osborn in Osborn’s Hyundai. They got to Pearce and Osborn’s apartment on Olympic Boulevard around 5 a.m.

Twenty minutes later, Vander Lee wrote, Giles texted her friend: “Let’s go,” adding a wide-eyed emoji.

“Yes,” Cabrales responded. “I’ll call an Uber. 10 min away.”

A car was seen in surveillance footage pulling up to the apartment, waiting five minutes, then leaving, Vander Lee wrote. Detectives believe this was the ride Cabrales had ordered.

“One glaring fact is that both Giles and Cabrales wanted to leave Pearce’s residence, as is evident by their texts and ordering an Uber,” Vander Lee wrote. “The next time they are seen, they’re dead.”

A downstairs neighbor told police she heard the sounds of “someone in pain and moaning on and off” coming from upstairs between around 10:30 a.m. and 4 p.m., the affidavit says.

Around 4:20 p.m., surveillance footage shows, Pearce carried Giles’ body to his black Toyota Prius, whose license plates were removed, Vander Lee wrote. Pearce and Osborn drove to Southern California Medical Center in Culver City and left Giles with medical staff, claiming to have found her passed out on a curb, according to the affidavit.

They returned to the apartment, loaded Cabrales into the car and drove her to a Kaiser hospital in Mid-City, Vander Lee wrote. Homicide detectives came to their apartment after midnight. A “visibly nervous” Osborn said he didn’t see Giles or Cabrales take any drugs, Vander Lee recalled in his affidavit.

“I didn’t give them anything, OK, I don’t live like that,” Osborn said. When he woke up he saw they weren’t breathing, but “they were making noises,” he said. “I figured give them a couple hours and they’ll come out of it, but it seemed like they were getting progressively worse.”

Osborn said he’d never been in this situation before and panicked. He didn’t call an ambulance for the women because “we didn’t know them,” and he didn’t bring them to the same hospital because “we didn’t know how that would look,” he told detectives.

Pearce told detectives, “at the end of the day, I didn’t do anything wrong.”

“Obviously,” he added, “I’m not going to say anything that’s going to incriminate me.”

The first of the sexual assaults Pearce is accused of committing occurred in 2010, when he responded to a woman’s post on Craigslist seeking a room to rent.

She went to see the apartment, and Pearce, whom she recalled as “very flirty but charming,” offered her a glass of whiskey. As she drank it on the couch, the room started to spin, she recalled to police. When she came to, Pearce was penetrating her with a wine bottle, prosecutors wrote in court papers. After the woman fought him off and fled, Pearce sent her text messages threatening to hurt her family, a probation officer wrote in a report.

Another woman told authorities Pearce raped her while she was unconscious. Afterward, he recited her home address and threatened to hurt her family if she told anyone what he’d done, the probation officer wrote.

I don't realize people still make duck lips in photos. Most of the pics in R3 feature them.

Interesting RollingStone article with some details that I haven't seen mentioned anywhere else. Apparently the "undetermined drug" in Hilda's system was fentanyl (surprise!). A follow-up test to confirm the level of fentanyl "couldn’t be performed due to insufficient specimen volume".

Rape and murder charges filed, life in prison possible.

Looking at multiple rape and drug charges as well as two counts of murder, the incarcerated Pearce could face life in prison if found guilty. Osborn, who remains free, is facing up to three years behind bars if found guilty on the two felony charges of seeking to “harbor, conceal, and aid” Pearce. Both men are set to be in Los Angeles Superior Court downtown on July 11 for arraignment. Pearce is expected to plead not guilty.

Left outside West L.A. hospitals by masked men in mid-November 2021, Giles was pronounced dead at the scene, while Cabrales-Arzola was taken off life support on November 27 at the request of her family. The duo had last been seen alive in an apartment in the Pico- Robertson neighborhood earlier on November 13, 2021.

Facing outrage and demands for action from the grieving families of Giles and Cabrales-Arzola, the somewhat newly minted D.A. and the LAPD picked up Pearce, Osborn and Michael Ansbach in mid-December last year. Aspiring actor Osborn, who was arrested on the Hollywood set of CBS’ NCIS: Los Angeles, and Ansbach were charged with accessory to manslaughter at the time. Bail was set at $100,000 each for both men. Pearce was booked on suspicion of manslaughter, with bail set at $1 million.

Soon afterwards, Osborn walked out of jail. The anticipation is he will be brought in by the police before next week’s hearing. There was no mention of Ansbach in today’s unsealed second amended complaint. “The matter is under review,” said a DA spokesperson about Ansbach’s status in the matter.

Pearce has remained behind bars since December.

From the article linked at R10

[quote]Tuesday’s unveiling of the new charges against Pearce and Osborn comes one day before the deadline for a recall petition against Gascón.

Are they implying that Gascón using this case and all the media attention it's been getting to save his ass?

by Anonymousreply 11July 6, 2022 4:52 AM

The complaint linked in the Deadline article says Pearce murdered both women with "malice aforethought". I REALLY want to know what evidence there is to support this. It must be something that hasn't been made public yet. Sale/transportation/offer to sell a controlled substance is listed as a separate charge.

I think the girls drugged themselves.

by Anonymousreply 13July 6, 2022 5:18 AM

Call me a cynic, but I doubt Pearce would've been charged with murder without all the media attention. You have to give the husband/mother credit for coming up with that out-there story about "forcible heroin injection" and possible snuff porn connections.

by Anonymousreply 14July 6, 2022 5:31 AM

So according to the DM there was an arraignment/preliminary hearing about this case today, but ABC7 Los Angeles says it was delayed until August 29. Odd. Anyway, nothing new/interesting seems to have come out.

I gotta say though, I'm increasingly confused by the fact that most articles about this case say the victims were dumped OUTSIDE the hospitals, but the LA Times reported that the guys spoke to staff, claiming they'd found the women passed out on a curb. That sounds like they carried them inside. So which one is it? They need to get their facts straight; it's not exactly a minor detail ...

by Anonymousreply 17July 12, 2022 3:57 AM

According to ABC7, David Pearce' arraignment was delayed because his lawyer withdrew. Does that mean the lawyer considered the case to be unwinnable? If that's the case, there must be some really strong evidence that hasn't been made public yet ... maybe the 3rd guy spilled the beans.

R14, but what we are told actually happened is just as bad as the conjecture filled accusations.

The main suspect already has a history of drugging women and raping them.

See? This is why I theorize about people like Bill Cosby.

I do wonder if anyone ever died due to his drugging and raping women.

You can only get away with that shit so many times, before someone ends up dying because their system cannot handle it, or because they were drugged with a different batch that is deadly.

Fuck the snuff film angle. It doesn’t make a lick of difference when all things are considered.

You drug someone’s drink, especially with fentanyl? Don’t be surprised if they OD, and without medical intervention and help, eventually end up dead.

Regardless of what he did BEFORE he dropped them off at the ER, the one thing he did NOT do, is immediately call for EMS units to show up at his residence and treat these girls with Narcan.

He made a decision to attempt to save his own ass before saving the lives of two strangers.

He deserves all the law can throw at him, as does his friend.

There’s zero excuse for drugging these girls, and then willfully refusing to provide them with immediate care because he was hoping they’d come out of it.

He’s nothing but PURE scum, as is his friend.

I hope they get the entire book thrown at them both for what they did to these young ladies.

It was intentional and premeditated, even if they never thought it would lead to two deaths.

These guys just wanted what they wanted, and when shit got out of hand, they were still willing to let two girls die in order to save their own asses.

by Anonymousreply 19July 12, 2022 4:19 AM

R19, normally I would agree with you, but this particular case is more complex than you make it out to be. You just assume that Pearce put fentanyl in their drinks. There are a number of problems with that assumption. 1. the women had a history of voluntary drug use. 2. One of them was seen using multiple drugs that night (coke and ketamine), and 3. pretty much EVERY drug can be laced with fentanyl these days.

It is possible that Pearce didn't force anything on these women, but simply offered them what he assumed was coke, which unfortunately turned out to be laced with fentanyl. If that is what happened, he'd still be reponsible in a way and should be punished, but I would not think of it as murder.

The man seems like an absolute piece of shit, but they still need evidence to convict him. You can't just make up a version of events ("put fentanyl in their drinks") that suits your feelings towards him.

by Anonymousreply 20July 12, 2022 4:37 AM

I wonder why they seem to focus exclusively on the fentanyl now. When I heard Christy Giles had GHB in her system, I thought that was the one drug they could easily argue was given to her without her knowledge, and with the intention of knocking her out. Fentanyl just seems like an odd choice of date rape drug.

by Anonymousreply 21July 12, 2022 4:45 AM

R20, if I were to abuse fentanyl, I believe that I would know to NOT pop a pill, right at the moment I’m ordering an Uber, in order to urgently get out of some dude’s apartment, who’s giving me bad vibes.

Self preservation trumps EVERYTHING, including compulsory behaviors.

by Anonymousreply 22July 12, 2022 4:51 AM

Where did I say they "abused fentanyl", R22? I said pretty much every drug can be laced with fentanyl these days, and those two women were open to use all kinds of drugs.

As for them getting "bad vibes" from those dudes ... could be, could be not. That "let's go + wide-eyed emoji" message sure sounds creepy, but we'll never know what really prompted it, unless there are recordings or the third guy spills the beans. What we do know is that the girls had planned to go to another party, and that just a few minutes after the "let's go" message, a friend who was at that party asked Christy, "where you're at?".

Look, I'm not saying Pearce et al. are innocent. What I'm saying is, the evidence mentioned so far seems weak to me, and I'm thinking these murder charges are probably based on things that are yet to be made public.

by Anonymousreply 23July 12, 2022 5:21 AM

The girls called an Uber and never made it to the car. Circumstantial, but damning.

by Anonymousreply 24July 12, 2022 7:47 AM

R20, under California law, giving someone an illegal drug, even with their knowledge and consent, is still a felony. The state has charged drug dealers under the felony murder rule for ODs. I could see the rule being used in this case.

by Anonymousreply 25July 12, 2022 8:23 PM

After ingesting the fatal dose of fentanyl/GHB or whatever it was that Pearce gave them, how long would it have taken for the women to become incapacitated?

by Anonymousreply 26July 13, 2022 12:28 AM

I think perhaps the girls were planning to leave and helped themselves to some drugs.

Why would straight men give drugs to women who were about to leave? Throwing good drugs after bad, in a way. If the women didn’t put out and departing, the men wouldn’t have given them any more drugs. It would have been a waste. In my opinion. And maybe there was something in the bathroom that they weren’t supposed to touch but they snooped and found it and decided to take it. I always snoop in the medicine cabinet (but I never take anything!).

by Anonymousreply 27July 13, 2022 1:01 AM

^ defense attorney talk and a jury would reject it. Especially as the chief defendant has a history of drugging and raping.

The girls wanted to leave. The men had already drugged them or did soon after with the intent to rape.
