After she pushed her, she watched from across the street for about 20 minutes. Her fiancé was in the area

Manhattan ADA Justin McNabney said Tuesday the dying woman — while "bleeding profusely from the head" — recounted what had happened to a friend before losing consciousness. Gustern allegedly told a friend that her attacker approached her directly and shoved her "as hard as she had ever been hit in her life," the complaint states.

Police later used surveillance footage to track down their suspect and determined that she stayed in the area for more than 20 minutes after the attack and was spotted having a physical altercation with a man, believed to be her fiance, roughly seven minutes after the victim was shoved, the complaint states.

Thirteen minutes after the attack, Pazienza was allegedly seen watching the ambulance as it arrived in the area to help the victim and take her away. She and her fiancé allegedly left the area soon after and were seen entering New York City’s Penn Station 30 minutes later. Footage also captured her arriving at her Astoria home around 9:50 p.m. in the same clothes she wore at the scene.

Prosecutors further allege that Pazienza then took steps to avoid being caught, such as deleting her social media and her wedding website, fleeing to her parents’ Long Island home and stashing her cell phone at a relative’s home, the complaint states.

But police received at least two tips identifying Pazienza as their suspect.

When cops showed up at the family’s Long Island home, her father allegedly refused to let cops into the home and "and claimed that his daughter was not at home," McNabney said.

She then allegedly contacted her attorney who arranged for her to turn herself in.

Now they want evidence?! Meanwhile, in the same breathe, they claim they don't care about knowing what the parents business is, what her neighbors had to say about her erratic behavior and other important information!

Shore Towers is an ugly 23 story condo building in Astoria Queens, it's overpriced, small and poorly constructed. Residents have to take a shuttle to the closest subway.

Over the years there have been a lot of code violations in this building. A friend rented there years ago, they were barely there a year, they went on to buy a much nicer and larger apartment on the LIC waterfront.

Most reports point to Naveen, the BF, owning the apartment. It's a little over 600 square feet. The apartment is tiny and on a low floor with no Manhattan skyline views.

At Shore Towers, owners can easily rent out their apartments, perhaps Naveen is simply renting.

It's obvious this person is a troll. I've been engaging them and I will stop.

As far as this tragedy, I initially went by whatever info was out there. I had already posted, each new report did get a bit more convoluted. For instance, it's clear the murderer is in no way any kind of NYC socialite.

Most New Yorkers are familiar with NYC socialites, the glamorous women who are always on The NY Times Sunday Styles party pages, at charitable events, gallery openings etc, this murderer is a total non-entity. She's nothing but another SATC type who moved to NYC in hopes of some kind of attention. Her father owns a cesspool business. Some socialite, it's obvious, these new journalists now use that term loosely.

The problem is with these so-called journalists not researching most of their information.

The NY Daily News was one of NYC's best newspapers, when they were sold a few years ago, they fired over 50 of their long time journalists, some of their former journalists won Pulitzer Prizes, their current crop of journalists seem like they are writing for their high school paper. The late Jimmy Breslin and Pete Hammill were former DN writers. Others who are still alive have moved on to The NY Times, such as Gail Collins.

The NY Daily News has become as bad as the NY Post. While the DN is definitely more liberal than the Right Wing NY Post, the new writers are awful and lot of this paper's content is re-printed from other newspapers. The typos are downright hilarious and sometimes the photos don't even mesh with the captions.

Whether it’s she picked a stranger in a rage, she was a pissed-off ex-student of Barbara, she felt like her hailed cab was taken from her, she remembered Barbara from her shop, she was pissed at her fiancé, she was reminded of an abusive grandmother, nuts, entitled, yadda yadda… however you get to the point does nothing to change the point. She used deadly force in an act of rage clearly with intent to harm. And her target died.

The witness who helped Barbara immediately after the attack hearing Barbara says she had been approached by a woman she didn’t know and, “…hit harder than I’ve ever been hit in my life.” That’s going to be key testimony.

Aidala is a good attorney, former prosecutor. I could see her taking a plea to criminally negligent homicide - that's up to 4 years. There could be a causation issue since she died some time later after hospitalization.

Manslaughter First Degree could have more issues.

Manslaughter in the first degree:

If your actions result in the death of another person even if that was not your intention . . . manslaughter is distinguishable from murder in that manslaughter is defined as causing someone's death without the intent to do so while murder requires intent. Manslaughter involves recklessness, negligence, or heat of passion.

Two of the most relevant essential elements of the offense:

With intent to cause serious physical injury to another person you do in fact cause the death of that person,

With intent to cause the death of another person you cause the death of such person or a third party while acting under the influence of extreme emotional disturbance

The government could have a problem proving intent with a manslaughter charge. Pushing someone out of the way, for instance, can be done without any intent to cause injury.

There will be lots of pre-trial litigation over whether to admit or exclude the purported words of the victim as relayed by her friend(s). Will be interesting.

If there are mental health issues then that will just make it more complicated for the prosecution.

What an awful way to leave the world. I'm glad it seems she had a good life.

Apartment living is not easy for many who grew up in a house. Could be the murderess was having constantly meltdowns over noise?

If Pazienza is on the spectrum, autistics cannot handle noise. Could be her noise issues then spilled out to other areas of her life. I'm not defending her at all, but constant noise is extremely disturbing to many who live in large noisy cities.

I work from home, have for many years. I live in co-op, the apartment above me was sold to a really noisy family. The apartment was sold over a year ago, for some reason, the family didn't move in until about 5-6 months ago. The noise started immediately. There have been complaints from the residents in the floors above and below this family. Not to mention, due to the construction of this building, noise can travel to other floors beyond the surrounding floors.

Their younger child is constantly making thud sounds from running, this starts at the same exact time every evening, the running goes on for literally three hours! The kid must have ADHD. In addition to the noisy child, there are chairs always moving, the kid also screams and there are loud arguments.

Why such a family would even consider buying an apartment is bizarre. People making this level of daily noise, need to buy a house way out in the boondocks, not subject others to their noisy lifestyle.

The co-op board is extremely strict. Perhaps they need to vet prospective buyers more deeply rather than worry about getting the large flip-tax from the former owners. This new family were already fined several times. A few more fines and the co-op board can legally, according to our bylaws, ask them to sell their apartment.

This happened to another resident in the co-op, a very noisy man who was always blasting music. Like the kid running at the same exact time every night, this man's stereo went on the same time every night. Sometimes we were spared on the weekends. One night, my heavy sofa was literally vibrating and moving, the music was that loud.

The security couldn't believe how large this guy's stereo speakers were. The jerk sure didn't need that level of power in an apartment. After many fines, the board gave him an ultimatum. Stop blasting thumping music or sell. The man sold his apartment. His love of noise seemed to outweigh having a beautiful spacious place to live! The new resident is quiet. Now the co-op is dealing with the noisy entitled Yuppie family. Hopefully, they'll be gone soon.

One of my neighbors has a bad temper, he told me he will go upstairs to complain directly. I advised him not to, but this new family is a huge nuisance. They obviously don't understand the meaning of "cooperate", especially in the context of co-op living.

The building is concrete and steel, it's not a new build. Reflected noise is a huge problem. That's why the board suggests to people who are a bit noisy, to have 80% of their apartment carpeted, especially their living room. Most new residents have wood or laminate floors. The smart decent new cooperators have something called Whisper Walk, a special kind of noise reduction padding, added under their wood floors.

I've lived in my co-op for quite awhile, I've never dealt with the level of noise the people above me are making. Just the stereo blaster and he didn't last very long.

I do notice the nastiness, superiority and an obvious sense of entitlement coming from the newer cooperators, so many are off the charts. These newbies also don't seem to respect a lot of the original residents, who are now quite old, some in their 80s and 90s. The co-op is over 50 years old.

What I don’t understand is if the police were tipped off to her whereabouts and went to the parents home and were denied entry, why didn’t they bring a search warrant? This is already on the defense’s terms. Law enforcement let a known murderer remain free until she was ready to turn herself in, which was a full 24 hours later. This is why I think she’ll walk with like a 6 month sentence.

Because of the constitution. Probable cause. Their house is not where their daughter lives. She has a legal address in Astoria. It’s not easy to get warrants to search white peoples homes. The parents haven’t committed a crime. When police ask if they can search the house they have a legal right to say no.

“Of course, officers. I will contact my lawyer and we will make arrangements for that.”

“We’d like you to do it now. It might be bad for you if you dont.”

“Am I under arrest?”

“We’ll, you could face charges that will accumulate if you refuse to come with us.”

“I’ll take that chance. My lawyer will make arrangements for me to come to the station if it’s required of me.”

Younger people recover from a stumble (like tripping over a crack in the pavement, for example) more easily.

Older people, whose strength has weakened, have a harder time recovering their balance from a stumble, and are more likely to fall as a result.

A younger person has more body strength, particularly in their legs, and they are much more likely to be able to recover from a stumble, rather than fall.

Barbara Gustern, being an elderly woman, most likely could not have maintained her balance after being pushed. Hitting her head on the payment was the worst possible result of that push.

I don't know the ages of the people on this thread, but I'm assuming that at least some of you have heaved a sigh of relief to not have fallen after you stumble, either at home, or out somewhere. The older you are, the more of a concern this becomes.

This series of events is particularly frightening for older people.

My former boss was murdered. The wife he was divorcing, refused to talk to the police when they came to her home to tell her that he was just found murdered. Her boyfriend answered the door and wouldn't let them in. She went out the next day and hired two lawyers who specialized in defending women who have murdered their husbands. The attorneys spoke with the police and told them they could give them a list of questions and she MIGHT answer them. She answered half of them. And that was the end of that.

She got away with murdering him. And she never said a word to the police. The police never even stood in the same room as her, ever.

You never talk to cops, period. I’ve seen so many “murder TV” shows where the main suspect or an accomplice refused to talk to the cops. Sometimes they get away with it because, unless the person confessed, the cops have a very weak case.

Detectives are trained and know what they’re doing and saying at all times. The police department where I live has a Homicide Bureau that is (now) notorious for eliciting false confessions.

Think of this example:

The police come to your house and tell you your neighbor was killed gangland style and can you come down to the precinct and answer some questions. You reply, “Well; I certainly didn’t shoot him. I don’t own a gun and have never even held a gun in my life.”

Cops: “Who said he was shot? We didn’t say that. How did you know he was shot?” *commence stinkeye*

Also, when pulled over for a traffic violation, depending on the time of day they’ll ask, “Where are you coming from?”

Nunya fuckin’ bidness where I’m coming, going, or any other extra info. (Mind you that’s not going to get you out of a ticket, but I’m talking legally.)

The septic business is huge on Long Island. Very little if Suffolk County is in sewers. Houses on 1/4 acre lots have cesspools. It’s insane. There were areas that always reeked after a heavy rain. Long Island is basically a sand bar, so there’s drainage into the surrounding waters.

Lauren Pazienza is an alumni of Fashion Institute of Technology (FIT) in NYC. Should have known... place long has been considered college of choice for those who cannot get in anywhere else.

Leaving fashion aspect aside, and yes many famous designers and other in the business have graduated or at least attended FIT, overall place is largely full of young women (and gays) big on dreams and short on actual talent.

Know several people who went to FIT (for two year associate degrees, which was largely all place offered at time), then tried to go on for B of S. Every college they tried to transfer credits to told them basically their FIT course credits were rubbish. Things like liberal arts, math, some sciences, foreign languages, etc... would transfer, but basically these people had to take another year to year and one half of courses before starting upper level work.

FIT has a lovely campus in the Chelsea area. I usually eat lunch there outside in the Summer if I happen to be in the neighborhood.

Decades ago I adjuncted one course for them. It was a more or less forgettable experience except I didn't like the students and when asked a few years later to do it again I didn't even bother to respond to the email. Which is unusual for me but I really just wrote them off. There was something about it. And in those days I was always up for making a little extra cash and doing a evening class didn't take much effort. But at some intuitive level I just said " not there."

Tell me, would an 'affluent family' live in this type of house?

Most of my relatives who live in the NYC suburbs, upstate NY and in Westchester, own homes which are much nicer that this. This ugly house isn't even brick. Tacky.

Something tells me, if her parents don't have mob ties, they are living beyond their means, especially taking all those Euro vacations. That might explain the cheap looking house.

After visiting my mom a few nights ago, I was walking to the subway. My mom lives in an area of private houses, apartment buildings and some new buildings which are condos.

A disheveled man was walking down the street towards me and screaming at the top of his lungs, "I'm gonna kill all these motherfuckers! KILLLL THEM ALL" It wasn't very late, about 10PM, but the street was sort of desolate. You bet your ass I crossed that damn street immediately then started running to the subway.

Her boyfriend is psychologically dependent on her, probably emotionally abused or even physically so. He will be charged with aiding her after the fact and the prosecution will use that to get him to testify against her for no time.

The only thing that might prevent happening is a mob threat to him and his family engineered by her parents. But do they have that type of influence? It would be great her parents brought up on charges of subverting the course of justice etc if they tried that however.

Though Pazienza she appears to have lived a life of privilege, and later glamour in New York City's high society, neighbors told the New York Post that she was sharp-tempered and confrontational, and an elementary classmate has claimed she bullied fellow students.

A former classmate of Pazienza told Fox News that when he moved in down the street from her in second grade, she began bullying him. The classmate claimed that she always had a 'crazy look in her eyes' and would kick him and call him and other kids names.

My first partner got his degree in art from the Ringling School in Florida and then got a further degree from FIT. His first mentor taught him how to design for showgirls and for elephants. Do we know if the taxi or car was present that the victim was waiting for? Is there evidence of that yet?

People are assuming she crossed the street to attack the victim. She may have crossed the street to get the car/Uber whatever or for another reason. That changes the narrative.

All housing projects are subsidized, Do you mean you lived in Mitchell-Lama housing? That's way different than NYCHA housing projects.

Now NYC also has yet another form of subsidized housing, where a certain portion of a building is market level and the rest of the building has subsidized apartments. If a tenant then starts to earn more than the allowed amount, they have to move. This is not the case in NYCHA housing, you just have to pay a higher rent, which is 30% of your earnings. If you lose your job then get another which pays less, or a spouse who was working dies, the rent is lowered.

Virtually everything in NYS is pleaded down at least one level. Now that this bitch from Hell as been sprung she, that some king of piece of bf and family will sit down with attorney to hatch out what happens next.

Attorney will push right to discovery information to see what DA's office has got on his client. Based in good part on that information a strategy will be formed to base her defense upon, and or wrestle for best plea deal possible.

Without some strong medical or other official evidence of mental health issues, it's going to be hard to defend fact this woman walked across a NYC street to push her victim to ground. Two women didn't know each other from Eve, and there had been no prior immediate contact or whatever.

In short of DA has a good case for manslaughter that office feels can win at trail, there will be considerable pressure to see the the thing through, if for no other reason to make an example of Lauren Pazienza.

If she is allowed to simply plead guilty to a low level assault charge, given a "time out" such as conditional discharge, anger management, and fined, but no or very little jail time, all fuck is going to break loose.

I can see why some people suspected she might have known her and had a motive for approaching her like that. The development Gustin seems to have lived in, Penn South, was build by the International Ladies Garment Workers Union for its employees in the early 60s. Many elderly Jews live there (they were not elderly when they moved in 60 years ago) and it's one of the few places in Manhattan where you still find middle class people, many of whom do hold down interesting arts-related jobs. (And just as many who don't.)

It's still one of the last bastions of a city that has largely disappeared, where middle class people still lived in Manhattan.

The complex was built in the old-school LeCorboisier "Towers In The Park" style, with buildings set back from the street surrounded by green space. It's very mid-century, but also seems very livable.

While I have no idea what her parents actual politics are, those are the exact people who make up the bulk of Trump's base - upscale blue collar.

Her dad probably grosses anywhere from $500K to $2MM depending on the year, and doesn't pay a whole lot of taxes on the part he takes out as income. Lots of recurring revenue from institutions and homeowners.

And yet I have no doubt her dad feels he is looked down upon by his college-educated corporate neighbors because he runs a cesspool company. While they probably do not actively "look down" on him, he's of no use to them networking-wise and they likely have markedly different cultural touchstones.

It's funny how the Post is spinning this too. The parents live in a decent-sized but not very fancy house in a nice but not super-posh town and took vacations to places like Aruba where they likely got a package airfare+hotel deal. Plenty of mid-ranged chain hotels in Aruba. It is, not St. Barths.

And plenty of not-very-wealthy people take a once-in-a-lifetime trip to Europe at some point in their lives.

Similarly, she was likely invited to one or two McMullen-photographed parties because of her job. It does not seem as if she was a regular on that circuit.

But in Tabloid Word calling her a "socialite" gets clicks.

Most of those types who came from Long Island and now live in Queens do spend a lot of time in Manhattan. A lot of them are actually embarrassed to claim they live in Queens.

Despite the million dollar condos and co-ops now on the Long Island City waterfront, there really isn't much of a true creative scene there, not that Pazienza was actually part of any sort of important creative scene involving actual artists.

From the info about her background she doesn't actually seem very creative, charismatic or even intelligent. She comes across like yet another spoiled airhead looking for attention and some sort of fame.

I knew someone like this when I was in my late teens. She was in my social group but not one of the people I knew well and had a couple of close male friends who didn't seem like boyfriends but whose job it was to explain her weird af behaviour to people with phrases like "she's just like that" and "just don't piss her off" etc. Weirdly enough her 'thing' was shoving people. Penn South is pretty awful. It looks like a project or college dorms and is an eye sore in Chelsea. There are some dangerous projects a few blocks south that are much worse though.

You "don't understand" anything because you're an idiot.

First and foremost Penn South is private property. NYC doesn't "allow" anything. Like everyone else in NYC they pay their property and other taxes and are within the law. So what do you suggest city do? Use eminent domain to take land? Yeah that will go over really well in court.

Two, housing estates (projects) went up decades ago when that part of Chelsea was still largely a gritty, industrial, commercial, working to bit of middle class area. Like elsewhere in city those pubic housing estates gave people vastly better housing than still common nasty tenement buildings.

In both instances both Penn South and housing estates allow working to middle class households to continue to live in a rapidly gentrifying Chelsea/West Side of Manhattan.

Penn South is no more "awful" than Stuyvesant Town/Peter Cooper Village on east side and few other places like Waterside Plaza.

As for balance of your deluded post, I've got news for you dearie, 8th avenue from 14th north to 34th isn't exactly Park Avenue. It wasn't back in 1970's, 1980's, 1990's and still isn't today.

Further north you go above 14th it's homeless, drug addicts, low and common, etc... Even when 8th as the new Christopher Street even gays couldn't shift that element totally.

Once you get to 8th and 23rd it's often like a cross between Daytop Village waiting room and Bellevue psych ward. Penn South and London Terrace are two bright spots real estate wise in that part of Chelsea for those who aren't very wealthy.

Many nationalities, other than Wasps, have light eyes and light hair. My great grandfather was a blond Sicilian. He had dark blond hair and bright blue eyes. Northern Italians are know to have lighter features than Southern Italians and Sicilians, who are more swarthy and darker skinned. There are also light eyed South Asians. There's a Greek man in my neighborhood who owns a restaurant, he has light brown hair and blue eyes. There are also many Italians with natural red hair.

Stuy Town now features $7000 rents! One of my doctors kids shared an apartment there with a few roommates. Think it was three or for bedroom. That was the rent about five years ago.

There are so many people in this thread who are sure not native New Yorkers.

After Met Life sold the property, Sty Town went through a massive renovation, then they raised the rents to market level. I'm not sure what the old timers did, they sure couldn't afford such absurd rents. $7000 a month?!

IIRC, the co-op Penn South was featured in a NY Times Sunday Real Estate article a few months ago, the Times interviewed a man who lived there for over 35-40+ years. You can be a native New Yorker and not care about public housing or ugly buildings. I am not a native New Yorker, but have lived here for 20 years (more than half of my life). I know a great deal about this city and it’s architecture. It’s one of my interests. However, I also know enough to stay out of the projects and to put my head down and walk quickly by them. I don’t take a the time to read the plaques to learn if the block-shapes monstrosities are owned by the city or not. I don’t have the desire to get mugged.

I love the racist calling me out for being white. Yes, I know. All white people are evil. My lack of abundant melanin and sebaceous glands, my smooth hair, and my chiseled nose make me unworthy to share my opinion on a gay gossip site and even to breathe NYC’s air.

I gather by something being a Mitchell-Lama co-op, it's not private? A nearby co-op is run this way. This means, when a cooperator sells their co-op apartment, they sell it directly back to the co-op and cannot make any sort of profit on it. The co-op then sells the apartment to anyone who passes the board interview, has good financials and whatever background checks they require.

These apartments do go up in price, but not at the level private co-ops can be re-sold. For example, when a nearby co-op went up over 50 years ago, they sold apartments for very low prices. Then, their prices went up in small increments.

Years ago, when I looked an apartment there, it was $60,000 for a one bedroom. Now their one bedroom apartments are staring at $100,000 and $250,00+ for a 3 bedroom, 2 bath. In all these apartments, the living rooms and kitchens are the same sizes. At the time I looked at the one bedroom, I ended up getting a much nicer and larger co-op, a 2 bedroom, for a bit less than $60,000.

btw dear @ R572, there are certain areas of the three main boroughs where condos and co-ops have been built directly across from NYCHA housing projects, one such area is Long Island City Queens, which has been slowly gentrifying.

In LIC, there are two long time co-op complexes which have survived in harmony with the NYCHA projects directly across from them, so darling, you need to STFU! One co-op had a beautiful apartment sell for over $800,000, the person who bought it knew there was a housing project across the street.

The Queensbridge NYCHA project in LIC is directly across the street from the Silvercup film studios.

PR/events coordinator is one of those jobs highly populated by white females from upper middle to well off backgrounds that lack frim four year college chops. In other words busy sort of work that often isn't highly compensated, but does have perks such as arranging and attending events where likely will come into contact with eminent persons.

Can easily see an alumni of FIT getting such a job. There is only so much one can do with a B of S degree in direct and interactive marketing from that place.

Knew someone who got their A.A.S from FIT years ago. She got so fed up with four year colleges turning down bulk of credits earned she gave up going for her bachelors. Then FIT came up with various B of S degree programs largely for graduates of their two year associate programs. At time marketing was one offered so that's what aforementioned person ended up going back and getting.

Bit after she graduated FIT changed their general marketing degree into something else, guess that is what Direct and Interactive Marketing comes in....

Quite honestly once you pass 28th and 8th going towards Penn Station it just gets more sketchier, and that's saying something for this particular stretch of avenue. On odd times have to walk up that way tend to increase my guard a bit just in case.

Thus at first when heard about this horrible event assumed it was just another of local loons on lose that are common around Penn Station area.

Over years FIT has added huge amount of security along both 27th and 28th street campus in response to suspect element that pervades area. Fact their student body is majority female (both day and evening students) also factors into things.

We called Chelsea the Village Heights back then. Everybody still wanted to live in Greenwich Village back then but we made the neighborhood so popular we got priced out. We're still the only minority that when we move in, the property values go up.

Pretty accurate since that was her job. As stated in another post position of "event planner" can be found at most middle sized and above companies. Goldman Sachs, Chase Bank, etc... all have such positions.

Smaller places usually have one frau secretary (usually someone from executive level) with maybe few other of the girls to assist.

Compensation isn't that bad from most places; comparable to high level administrative assistants. For those employed by big banks and others there is always chance of a nice fat yearly bonus.
