I said this in the Justice Breyer retirement thread, but the timing of his announcement was unusual. Typically, Justices retire at the end of the term (summer). But there’s a tradition that only one Justice will retire at once. If Justice Thomas is in poor health, Breyer may have announced his retirement early to give Justice Thomas some space to make a summer announcement.

Thomas has been wanting to get off the court for some years now. He was very much hoping for a Trump victory so he could announce his retirement. Once that didn't happen, he told Roberts he would stay for four more years, expecting a republican win in 2024. All the more reason for us to hold the White House then.

I would say that Ginsburg's body was worn down by recurrent cancer but that she was otherwise taking care of herself. Ashkenazi Jews are very prone to various cancers but, even by their standards, RBG was unlucky; apart from that, though, genetics and other factors make Jews very long-lived.
Thomas is just a good old-fashioned obese man. Yes, he will get excellent care but a lifestyle like his catches up with you steadily and I don't see him living to 87 or anything like it (unless he makes big lifestyle changes). The thing about "wishing people dead" is, yes sometimes it seems to come from a place of real personal malevolence and partisan vengefulness. But for a lot of us it comes from the total frustration we feel from the political system being so rigged by the right wing and regressive forces like dark money and flagrant disinformation being churned out 24/7 by Fox News. In the case of Trump, it seemed like there was almost nothing that could stop him from leading this entire country into an ignorant, dark hell, and in fact it nearly was true. We almost didn't win that election because of the extreme, coordinated chicanery they pulled. I’ve known Merrick Garland for nearly 30 years and was a colleague of his at DOJ in the 1990s. I appeared before him when he was on the Court of Appeals. He’s a brilliant lawyer and was a great judge. When Obama nominated him, I thought he was a superb choice to replace Scalia. Had it not been for McTurtle’s despicable obstructionism, Merrick should have and would have been confirmed to the Court in 2016.
But, that was then and this is now. He will be 70 in November. There are other, younger candidates who would do a fantastic job.
I did not think that Merrick was the best choice for AG, precisely because he is too much of an institutionalist. I preferred one of the former Democratic US Attorneys, like Sally Yates, Doug Jones, or Preet, and still do.

I am *extremely* disappointed by Garland. It is strange how I continually place my hope for our country on members of our federal government. Why? Why do I keep doing this? I did it with Mueller, again with Garland. I am sure Garland is a good and decent human being — but he so far is not showing me that he is also a leader. A real fucking leader would challenge the status quo. A real leader would uphold the law, regardless of title, status, bank account, allies. A real leader would act for the People to uphold our Constitution.
I also believe that the Dems allowing this to go on is going to bite us in the ass on a level we can’t even imagine. I am talking waaay bigger than merely losing the Senate. We are going to pay a steep price for not forcing Dems to uphold the law. It is such a travesty. I honestly think I’m really done. We could fix this!!!!! That’s what is so maddening! Yeah Garland was a great judge but he's not strong enough to be AG. Biden gave him the job out of pity because he cares about fairness and felt bad that Garland was robbed of being on SCOTUS. A major consideration in indicting someone is “can you get a conviction.” I think the problem could be that Garland and other DOJ prosecutors realize that there is absolutely no way they can keep a MAGAt (or few) off a jury. Given the commitment MAGAts feel about Trump, a conviction would be virtually impossible. A hung jury is the best that one could hope for.
Given that reality, perhaps it is less embarrassing to not bring charges versus indicting and losing.

Justice Clarence Thomas missed oral arguments at the Supreme Court this week because of his hospitalization for treatment of an infection.
A court spokeswoman declined to provide an update on Thomas’s condition.
He was admitted to Sibley Memorial Hospital in Washington Friday night, complaining of flu-like symptoms. Sunday night, the court said in a new release that he had been diagnosed with an infection and was being treated with intravenous antibiotics.
A court spokeswoman Sunday night reiterated that Thomas had been vaccinated and boosted against the coronavirus, and that his illness was not covid-related.
Justices decide for themselves how much health information they will release to the public, and there has been no additional guidance.

My neighbor died of sepsis. She was fine, but started to feel those flu-like symptoms. The next day—literally—her son found her on the bathroom floor delirious. She died later that night. It came in incredibly quickly.

This happened to my mother. Somehow she survived it - and it was awful. But the doctor told us there would be damage to her organs. She was 84 and one tough lady. Up until this, she was still golfing.
But we soon learned her heart had been affected. They treated her but she passed 4 months later. The one conversation she had with me - right after the sepsis- was don't ever let me go through that again. Promise me you will give me "a pill."

That’s not how this works. Roberts has a few prerogatives as the Chief Justice and this isn’t one of them; he still only gets one vote. There's a common misunderstanding of historic life expectancy. Many, many, many more infants and children died young in those days but once you got to adulthood, plenty of people lived into their 70s and 80s. The numbers are just skewed because of the high youth death rate.

In the 1790s and early 1800s, I believe, there were fewer justice on the Court and fewer cases before the Court. The justices had a lot more time for circuit court cases and for doing whatever else it was that they did in their lives. There was a greater turnover, with justices stepping down to run for some office or other, or just because they got tired of the job. And some of them would drop dead of smallpox or whatever.

I doubt that, R537. Ginni Thomas has a lot of power among conservatives. Read the Jane Mayer article in January's New Yorker. She is well-respected and with Thomas on SCOTUS holding the views he does, he is respected by them as well. He has shown he is willing to do what it takes, which is what they all want. They are more than willing to have women and minorities on their side when they hold similar values and contribute advancement to the cause.
