So I FINALLY dug into this case that all of yall, and the country is talking about. I've managed to avoid it for over a year. My take-aways, not that anybody asked, are this:
#1 They were ALL assholes. All of them. Several white dude bros protesting the police shooting were out there with guns, not just that little 17 year old shit-ass. #2 From one video, it does appear clear that Rittenhouse was being surrounded (attacked?) by at least three people, one brandishing a semi-automatic handgun. #3 Wisconsin is an "open carry" state, allowing people to walk around with guns, (but not minors.) #4 Rittenhouse was carrying a gun illegally and should be held and convicted on those charges specifically, regardless of the shootings. #5 It's plausible, even likely Rittenhouse was indeed in fear for his life. But he clearly had no qualms about using his semi-automatic rifle. #6 Given at least one video I've seen, it would be entirely within the scope of the law that he be exonerated for using deadly force, as there was a clear case to make for him being in mortal fear by being, at one point, flanked/charged by three men, at least one, if not two, brandishing semi-automatic handguns.
The law is complicated folks. This kid is morally, reprehensibly wrong. And hopefully his mother, who seems thirsty for media attention, will be the next person to face trial for her treatment of a juvenile/child in allowing him to be out at night with a semi-automatic gun.
However, there were others with guns. At least two men charged him with guns. One is alive, the hot dude-bro that got shot in the arm and who took the stand. But he too had a gun. An argument can be made as to why he isn't facing criminal prosecution for threatening a minor with deadly force. Because again, the law is complex and often fucked up. One dead man didn't have a gun, but attacked Rittenhouse, allegedly trying to get the gun away from him. He was holding his skateboard in one hand. But he did charge at the guy without direct provocation, (there are no claims Rittenhouse aimed his gun at or threatened Mr. Huber or his girlfriend.). Huber was attempting to be a hero and I'm not sure that was needed. It certainly wasn't smart.
The other dead man did not appear to have a gun, but by all account charged Rittenhouse and threw something at him. I'm not necessarily buying CNN's bullshit about it "just being a plastic bag". THAT incident seems to be mostly in question.
Rosenbaum, the man who Rittenhouse shot first, had just been let out of prison earlier that day, (or was it a mental hospital?). Not that it should matter in his death, but he served a decade in prison for molestation of a minor. He had mental illness, bipolar disorder. It isn't unreasonable, given his mental and criminal past, to assume Rosenbaum would/could have threatened Rittenhouse to the point of Rittenhouse being in fear for his life.
Legally, I expect Rittenhouse to be found not guilty of the charges. There's plenty of evidence on both sides. It's all very ugly, Rittenhouse is in no way innocent. And the prosecutors should be fired and their license to practice law removed, because they aimed way too high and they clearly knew they did. They should have gone for another charge that carried jail time.
It's all very sad. The people out rioting didn't help matters. It was no "peaceful protest". It was a bunch of white trash assholes, most of them itching for a reason to protest and hijacking the local Black Lives Matter movement with their wilding. The rest were white trash, paramilitary wannabe losers. They weren't looking to "defend property", they were looking for conflict.
This is why you can't have nice things when you involve guns. They should all be cancelled and locked-up like animals.

Yes, motive is always important in court cases. I don't know why people think it's irrelevant. Again, how strange that he thought it a good idea to insert himself in the middle of all that when he had nothing to do with it and wasn't law enforcement, and he was the only person who shot three people, killing two when even law enforcement didn't. Rioting/protesting doesn't carry the death penalty. His actions were grossly inappropriate.
I just think that this isn't a good idea to set as a precedent because if he is let off, it could be a good argument for people to go out with a big gun looking for trouble and provoking people into 'attacking' them so that they can shoot them.

The one overclaiming for himself was Grosskreutz. Grosskreutz was not a licensed EMT anywhere in the country. What he omitted was that his "ambulance" experience was working for a private medical ambulance service that gave rides to medical appointments to seniors.
Plenty of people on both sides of these demonstrations/riots were offering basic first aid assistance to people. They were labeling themselves all kinds of technically incorrect titles - people are almost never accurate with these labels. Yes it may be cosplay but it doesn't tell you anything about these people except maybe they all wanted to offer some help. Rittenhouse did, in fact, render aid to someone earlier - someone who sprained their ankle IIRC.

Rosenbaum was moving while Rittenhouse was firing, so it’s not Rittenhouse’s fault for whatever position Rosenbaum was in when each of the bullets struck him. President Biden calling Rittenhouse a white supremacist isn't the first time political leaders have put their own weight on the scales of justice. That guy doesn't even get facts correct so he is comparing completely different circumstances and ignoring essential facts and the complete law on provocation. Sorry but he is an idiot. I guess everyone wants their 15 minutes of fame over this case. He'd have been better off doing a happy bear strip tease for those 2 minutes.
First, his description of provocation is incorrect. I don't believe there was provocation. But for argument's sake even if Rittenhouse had "provoked" Zaminksy - of course, they did not produce evidence at trial to show he did and they could have done that by putting Zaminsky on the stand to say that - you do not lose your right to self defense if you retreat from that alleged provocation - Rittenhouse on video retreated 3x from what the prosecution tries to claim was provocation.
So that kills that provocation argument.
Further, the prosecution is trying to argue transferred intent on the provocation from Zaminsky to Rosenbaum, again with no evidence to show that. First, that is a very strained legal theory to make. In addition to the problem with the legal theory, there is no evidence of any kind that Rosenbaum was aware of the alleged act of provocation by Rittenhouse.
You know, you need evidence of things. Not just some speculation, 'well it could have happened that way.' That is not evidence.
But I appreciate the opportunity to bust another lazily done and incorrect legal analysis.
Are the facts really so hard to get correct? This case is over a year old. What os wrong with these people, especially so called journalists.

Lawyers for Rittenhouse filed their motion for mistrial with prejudice based on this and several other grounds
The motion states that this larger file was not provided to the defense 'until after the trial concluded'
It reads, 'During the jury instructions conference, the defense played their version of the video for the court to review. The state indicated their version was much clearer and had their tech person come into court to have the court review their clearer video. The video is the same, the resolution of that video, however, was not.'
In fact, the state did not provide the larger file until two days before closing arguments and after the evidence had been closed.
The video footage has been at the center of this case. The idea that the state would provide lesser quality footage and then use that footage as a linchpin in their case is the very reason they requested and were granted the provocation instruction by the Court.'
Lawyers for Rittenhouse filed their motion for mistrial with prejudice based on this and several other grounds.
They had already raised the issue of 'prosecutorial misconduct' and 'over-reach' for Binger's behavior when he 'violated' Rittenhouse's constitutional right to remain silent by suggesting that he had done so that he could 'tailor' his story to fit the facts as they emerged during trial.
And for his bid to enter evidence into trial that had already been excluded by the judge. Both transgressions came the day that Rittenhouse testified and saw Judge Schroeder furiously admonish the prosecutor telling him, 'This better stop.'
Now, in the motion filed Monday, Rittenhouse's defense team has re-iterated Corey Chirafisi's contention in court that Binger's behavior was 'clearly intentional' and 'prejudicial.'
For his part Judge Schroeder did not accept Binger's insistence that he acted 'in good faith' snapping, 'I don't believe you.'
According to the defense, 'The failure to provide the same quality footage in this particular case is intentional and clearly prejudices the defendant.'

It’s not as complicated or grey as you might suggest. In a fight there’s an aggressor and a defender. The roles could flip during the fight depending on what happens. The jury has to decide which is which at the time of the killing and then the defender may be entitled to the protection of self-defense. So once the jury has appropriately determined that Rosenbaum was the aggressor, then it is Rittenhouse who is the one who can claim self-defense.

Once Rosenbaum put his hands on the gun or once he even started trying to get the gun from Rittenhouse he is no longer considered unarmed. A cop struggling with someone trying to get his gun would be justified in shooting that person.
Huber was armed with a skateboard which he used a number of times to hit Rittenhouse at least one of the hits was a strike to the neck and head. More people are killed by blunt objects in the US than an AR-15 style rifle.
Ziminsky and Rosenbaum had been acting in concert all evening. Along with Ziminsky's wife. Both Ziminskys were armed with guns. The video shows Rosenbaum and Ziminsky close together when Rittenhouse passed them before heading into the Car Source lot where he had been sent to guard.
Ziminski breaks off and heads toward the south part of the lot and Rosenbaum heads behind some cars toward the north part of the lot. They have effectively surrounded Rittenhouse. As Rittenhouse heads across the lot, Rosenbaum comes out from behind cars and stars to chase down Rittenhouse who is now running away from him and just as he closes in on Rittenhouse, Ziminski fires his gun on the lot. That's when Rittenhouse turns and sees Rosenbaum and retreats by running again away from Rosenbaum.
That was planned. Considering that Rosenbaum had earlier told Rittenhouse that he would kill him if he got him alone, it is reasonable to fear that Rosenbaum intend to kill Rittenhouse now that he had him alone (with his partner Ziminski firing a gun nearby) and was trying to get Rittenhouse's gun.
Further it would be reasonable to fear that Rosenbaum came into possession of one of the Ziminski's guns.

The fact that the jury is taking this long is very good news. A Conviction is coming but will Judge Drama Queen declare a mistrial before he lets his favorite accused killer get convicted.?

For there to be justice, yes, the judge would have to declare a mistrial if the prosecution somehow succeeded in tricking the jury into voting guilty.

Once a verdict is reached, that’s it. You can’t declare a mistrial once the trial is done.

r567, yes, not mistrial, so what’s the correct term for when a judge has to reverse a conviction because no reasonable jury would find the defendant guilty, or the term for when a judge has to vacate the decision of the jury and grant a motion for a new trial because of misconduct by the prosecution? That’s what we would have to look at if the jury is tricked into wrongly finding Rittenhouse guilty, right?

That’s an easy one, and one you would know the answer for if you watched the trial or read about what was happening in it. Rittenhouse didn’t go to Kenosha with the rifle. The rifle was already in Kenosha at the house of Dominick Black. Also, Rittenhouse was already in Kenosha the day of the shootings, having traveled there the previous day for work. It’s easy for you to be confused, since there have been so many lies on DL and in social media about Rittenhouse traveling to Kenosha with a gun.

R569, I don't think that there is such a thing. A conviction can be appealed, but I don't think that a judge can override the verdict. If he is found guilty of any of the charges, he would have to go through the usual appeals process.

It reminds of when people didn’t want to believe the reports from DLers in the battleground states in 2016 that Trump was leading Hillary there. For this case, you had people on DL who wouldn’t accept the reality of the evidence proving that Rittenhouse acted in self-defense, no matter how many times other people spelled it out for them in detail why Rittenhouse was innocent beyond a reasonable doubt. Instead of referring to the deniers as anti-Rittenhouse, it may be more accurate to describe them as anti-reality.
