The article is poorly written. Did the cop tell him he was a person of interest, that he was as suspect? Was he listening in on the call to his father? His father should have told him to keep his mouth shut. At a moment of emotion the cop jumped on him. If he wasn't read his rights first,and told that he didn't have to say anything, or that it could be used against him, and if the cops held him for a long period without a break, trying to break him down then his confession is through duress. It should be kept out. The police want to make it seem s as though they were trying to locate a body. But they were trying to catch him in a confession. But he had rights. He should have brought a lawyer with him.

It depends of the totality of the circumstances. If the court believes that the defendant wasn't confessing of his own free will but under pressure then duress is there. As I said the article is so poorly written. We don't know how long he was there, what the cop was saying to him before, where they interviewed him, who suggested he call his father, when the cop asked him about the body after the call, and whether he was tired, hungry. scared, felt trapped, etc. What would a reasonable person feel like in that situation? How would they react? If the judge believes that they would feel forced to confess than the confession should be thrown out.

One major issue in this case is the judge severing the cases puts Rackover (who is probably more guilty of the cover-up than the actual murder) at a severe disadvantage because it's now two against one. Former roommates Dillione and Gemma will cover for each other and paint Rackover as the domineering killer.

Unfortunately the facts contradict that claim -- Dillione admits to knocking Comunale unconscious and claims that Rackover then beat an unconscious man to death. This claim strikes me as suspect based on what we know about Rackover -- he's someone that wants to impress others and be the hero, beating a helpless man to death does not fit that profile. However, being the hero who leads the effort to clean up/dispose/make his friend's problem go away does perfectly fit Rackover's profile.

Furthermore, the narrative pushed by Dillione and Gemma that Rackover was domineering in the aftermath is debunked by the simple fact that Max Gemma was allowed to leave alone and not be involved after the killing.

Given Rackover's past and all the emotional eating he's been doing in jail, Dillione and Gemma will likely be able to either cut a deal for themselves or make sure that Rackover's trial is first, have both testify against him and use their narrative to convict Rackover. Then, if/when their cases come to trial, all they have to do is push the fact that Rackover has already been convicted of this murder and argue that Dillione and Gemma are only guilty of assault and unlawful disposal of a corpse.

Prosecutors offered a glimpse Friday of the damning evidence they plan to introduce at the upcoming murder trial of a “jeweler to the stars” lover accused of killing a Connecticut man.

Assistant DA Antoinette Carter said James Rackover, 27, allegedly stole thousands of dollars from his much older lover, jeweler Jeffrey Rackover, to pay off a drug debt.

He took $50,000 from Venmo, PayPal and Bank of America accounts in addition to a $30,000 watch, she said at a hearing to determine the evidence that will be admitted at the Manhattan Supreme Court trial slated to start Monday.

James Rackover and co-defendant Larry Dilione allegedly strangled, stabbed and bludgeoned Joseph Comunale inside the Sutton Place pad Jeffrey had rented for James, after Comunale said Dilione was mooching off him during a night of partying Nov. 13, 2016.

NEW YORK — Roughly 80 potential jurors were whittled down to eight on the first day of jury selection in the trial of James Rackover, one of two men charged with the grisly death of a 26-year-old Stamford man in a luxury Sutton Place apartment.

Rackover’s attorney, Maurice Sercarz, asked the pool of possible jurors on Monday to “keep an open mind” during the trial, which will focus on the murder of Joseph Comunale, a Westhill High School graduate. Sercarz said Comunale’s murder will be discussed in graphic detail during the trial and jurors will be shown disturbing autopsy photos that will be “very difficult to sit through.”

Comunale was beaten, stabbed, burned, dismembered, and dropped into a shallow grave on Nov. 13, 2016. His body was found in Oceanport, N.J.

Rackover was indicted on charges of murder, hindering prosecution, tampering with physical evidence and concealment of a corpse.

The 2016 incident in which Comunale was killed involved a drug-fueled argument over cigarettes and cocaine, according to police, between the two men and Lawrence Dilione, who faces similar charges to Rackover. Dilione is scheduled for trial after Rackover.

Another man, Max Gemma, was charged with hindering prosecution and tampering with evidence. He is expected to go to trial last.

On Monday, Assistant District Attorney Antoinette Carter said that drug use will be discussed in the trial and asked the possible jurors whether they would discount testimony from anyone who abuses drugs.

Other questions involved law enforcement, and whether any potential jurors had had negative experiences with police officers, many of whom could be asked to testify.

She also said the prosecution may be unable to fully define the “division of labor” between Rackover and Dilione and asked jurors whether they would be able to come to a verdict without knowing exactly who did what.

Rackover, who had often appeared at hearings wearing a white t-shirt, was in a full suit on Monday.

Nonetheless, he appeared to make an unfavorable impression on some potential jurors who had been dismissed after being vetted by Carter.

One possible juror who was not selected questioned Rackover’s credibility after seeing him “laughing and smiling and joking with his lawyer.”

Two others said they would have a hard time being impartial jurors if they discovered the defendant had committed past errors.

Jury selection will continue on Tuesday. Opening arguments are expected to start on Thursday.

James Rackover — along with his co-defendant Larry Dilione — allegedly strangled, stabbed and bludgeoned Comunale inside the posh Manhattan apartment.

The vicious beating allegedly began after Comunale accused Dilione, 30, of mooching off him after a night of partying.

In another jail call, Rackover allegedly said, “So, I got good news, it doesn’t look like Larry is being a f—king — running his mouth in court, and trying to flip on me, so that’s good.”

Defense lawyers Maurice Sercarz and Robert Caliendo argued that the calls don’t prove anything and would inflame the jury.

“An innocent person who feels aggrieved by a wrongful arrest is capable of making the same statements,” Sercarz said.

But Assistant DA Rachel Ehrhardt countered that the calls showed consciousness of guilt. Justice James Burke ruled that they can come in.

Prosecutors also previewed the gruesome autopsy photos that will be presented to jurors.

James and Dilione — who will be tried next in a separate trial — allegedly tried to dismember Comunale, 26, in the pad’s bathtub, leaving saw marks on his arm, then tossed the corpse out the luxury apartment’s fourth floor window, shattering his skull. Jurors will see photos of both injuries.

The pair allegedly put Comunale’s battered remains in the trunk of Jeffrey’s Beemer and drove to Oceanport, NJ, where they doused the corpse in gasoline, set it aflame then dumped it in a shallow grave.

Images of the Hofstra grad’s mutilated and charred body, which had to be identified from dental records, will be shown, prosecutors said.

Jury selection continues Tuesday before Judge Burke.

A third defendant, Max Gemma, will be tried last on lesser charges of hindering prosecution and tampering with evidence.

NEW YORK (WABC) --Opening statements began Thursday in the murder trial of a man accused in a deadly stabbing in an Upper East Side apartment, with the victim's family in the courtroom watching and crying through some of the testimony.

James Rackover is the first suspect to be tried in the murder of 26-year-old Joey Comunale.

He's also charged with concealing a human corpse and tampering with evidence.

Rackover and Lawrence Dilione are accused of killing the Hofstra graduate in 2016, before burying him in a shallow grave in New Jersey.

Authorities say Comunale attended a party at Rackover's apartment on November 13, where police said he was stabbed 15 times in the chest during an argument.

His father reported him missing the next day, and his body was found in a wooded area down the Jersey Shore in Oceanport two days later.

As testimony got underway, authorities revealed pictures of the shallow grave. Several of Comunale's relatives, including his parents, sobbed through the testimony given by investigators with the Monmouth County Prosecutor's Office, each picture revealing more of the body.

Rackover's defense attorney said in his opening statement that it is not his client but Dilone who is responsible for the murder. But prosecutors say Rackover showed a "monstrous indifference for human life."

"The defense here is that they can't prove beyond a reasonable doubt that my client acted in concert with Mr. Dilone, causing the death of Mr. Comunale," said defense attorney Maurice Sercarz.

Witnesses described a hard-partying night that included alcohol and cocaine. The most serious charge is second-degree murder, which means Rackover would spend the rest of his life behind bars.

Rackover is the surrogate son of celebrity jeweler Jeffrey Rackover, whose clients include Oprah Winfrey and Jennifer Lopez.

Dilone will be tried early next year. A third man is also charged with helping in the cleanup effort but not the actual killing.

I think Dillione might have been the one who actually killed Joey. But he’s got his silver spoon buddy Max Gemma backing him up to pin it on Rackover because he had a previous criminal record. This should be an interesting trial.

So, testimony from the three woman, but few details about Joey's presence in the room, that night. No detail about why the women left when they did, or about Joey's condition during that party or, immediately before they left/ as he escorted them with Larry, to their uber, outside. As an eldergay whose long-gone partying days were tame by comparison, I am having trouble wrapping my brain around this whole evening, but, holy shit, how many lives were either ended (Joey), ruined (Rackover II, Dilione, Gemma) or irreparably changed, to varying degrees, (Rackover I, Joey's family, Todd Greene, Stephen Naso, Katherine Conroy, Samantha Guardiola and Jenna Stisi) just from one night of seemingly innocent partying gone wrong.

So Rackover wasn’t even out partying that night out in the clubs that night to even meet Comunale. He was home. It Dilione who was running the night w Max Gemma and invited all these people over to Rackover’s apartment to continue the night. Yes Rackover bosted about being a son of a rich jeweler to everyone but the more you listen to the evidence presented. It really seems like Dilione might be the real murderer here. Thats when he returned to his place to find Dilione had already beaten Comunale to death and stabbed him with Max Gemma there as a witness. Rackover said he agreed to help dispose of the body in an area that Dilione had chosen behind a florist owned by the Dilione family. It really seems Dilione is the true killer. But he’s using BFF Max Gemma to put the blame on Rackover.

I reread the time-line on this. A lot of people think the killing happened in the middle of the night, but in fact it was mid-morning. Then Rackover Jr waited til later that evening to sneak the body out.

I'm still undecided as to whether this was a gay thing gone wrong or a drug thing gone wrong or very possibly a combination. Because of the unsavory nature of it all, the relationship of Joey's Daddy Patsy with NYPD, and the completely fucked up and incompetent original NYPD investigation, I bet never we know exactly what happened.

As I posted way above, Daddy "Patsy" Comunale was a retired NYPD cop who now runs a major security company and the Rackovers' building is one of its clients. Comunale Jr. worked for Daddy's security company and had been to that Sutton Place building many times before relating to his job.

Here's my question: when Joey didn't come back from his evening trip to the City, how did his Daddy Patsy know immediately to go to into town to that building and review the security tapes and then turn them over to NYPD, which is exactly what happened. How did he know to go that specific building first thing and check the tapes, which the cops hadn't known about and the press has never addressed publicly?

Did Joey already know Rackover Jr. when he ran into his friends at The Gilded Lily? Had they had some previous relationship or were they complete strangers? Regardless, when he went missing, how did Daddy know to go straight to that building and review the security tapes, which belonged to his company, and then turn them over to the cops?

There's so much that's missing from what has been reported. I bet we never know the real story.
