Oysters are never flash frozen and I trust them no where out of season, and never at all from warm water.
It depends on restaurant for other seafood and if it needs to be live before preparation.
For example I will eat frozen lobster which means it was blanched or boiled at the site of the catch and flash frozen. I will eat live lobster on ice only within 48 hours of catch. Better, 24 hours of catch. Lobsters in tanks dont taste great, either. The only part of the lobster that can be frozen raw is the tail and it's complicated to get it correct. And the chef in Cincinnati may not know how to cook a raw frozen lobster tail to make it worth the price and the diner's time.
