Judge Hands Menendez Brothers Big Win in Resentencing Bid

On Friday, a judge scheduled a resentencing hearing for Erik and Lyle Menendez, who in 1996 were convicted of the murder of their parents, Kitty and José Menendez.

Los Angeles Superior Court judge Michael Jesic set the hearing to begin next Tuesday, May 13. It is expected to last for two days.

The brothers will have the opportunity to present their case for release. While they don’t dispute the fact that they killed their parents on August 20, 1989, they claim it was in self-defense, as their father’s alleged sexual abuse left them with no other choice.

Except the claims of SA didn't just come from the guys. None of this explains Roy Rosselló from Menudo claiming that their father did the same thing to him.

Their parents did not deserve to die like that and the boys did deserve to go to prison but if their father was not a great person and their mother covered for him then it stands to reason that their kids would have been screwed up as well. That includes, doing anything you can to try and manipulate your ex-girlfriends at 20 to help you get off (including, in one case, on the advice of your lawyer.)

You're twisting my words intentionally. I'm not saying bribery is justified. I'm saying you have to look at the why behind desperate behavior from someone who was, at that point, a traumatized 20-year-old on trial for his life, being guided (badly) by legal counsel. None of that makes the action okay, but it does put it in psychological context, especially if you're trying to assess someone’s potential for rehabilitation, which is the point of parole hearings.

As for “why bribe someone if there was so much evidence?” That’s not how trauma disclosures work. Abuse victims often try to supplement what they think won't be “enough” for people to believe them. Especially in the '90s, when the general public was even less inclined to believe male victims of SA... particularly rich, privileged-seeming ones who'd just murdered their parents.

And about Roy Rosselló, people don’t disclose abuse on your preferred schedule. Especially not when they’re part of an internationally famous boy band with their own trauma, NDAs, and career implications. He didn’t owe them anything. It’s not suspicious that he waited; it’s typical of survivor behavior.

This doesn’t erase what the brothers did. It just complicates the narrative, which is the whole point of post-conviction relief or reconsideration. If we still believe in rehabilitation and context, then after 35 years of good behavior, it’s fair to consider parole not because they’re innocent, but because justice is allowed to have layers.

A grown man regularly anally raping a small child would have caused rips and tears that would have required medical treatment.
