R10 Expect this to end up in federal court, in front of the colleagues of these same judges.
1) The law says the Attorney General can appoint an interim US Attorney for 120 days
2) At the end of that 120 days, the federal district court for that district selects a new interim US Attorney, who serves until a permanent US Attorney is confirmed by the Senate. The district court can appoint anyone - even a non-DOJ employee.
There is no ambiguity here. Absolutely no fucking daylight. Habba had her interim 120 days. The Senate failed to confirm her, or even consider her nomination in that time. Her term expired today, and she's already packed up her office and left. The judges picked a new IUSA, who Bondi fired from DOJ service. But the judges can simply appoint the same person again tomorrow, and there's zero wiggle room in the written law for Bondi to weasel her way out of it. The law recognizes the court - and only the court - as the appointing authority of a secondary IUSA. Bondi doesn't even get a second wheedle. Whoever they pick as the new IUSA stays in that job until and unless a permanent successor is confirmed by the Senate.
They wrote this law in 2007 to be very crisp and simple, because the second Bush Administration got up to fuckery with their US Attorney appointments, and the district court judges got sick of the games.

Bondi's only fledgling partial option would be to appoint a new "First Assistant" US Attorney, who could fill in for an absent US Attorney for a period of a few months. And then that person gets the boot.
It takes a year or more to fill out the US Attorneys offices nationwide - there are 93 of them - but Bondi is in such an insane rush to fire anyone who knows how to read that she's blundering into this bullshit in a completely avoidable way. She's manufacturing this crisis due to her own incompetence.
