Trump replacing lawyer because she "doesn't know what she's doing": "She is a loser"

A former White House attorney for Donald Trump said Wednesday he's "not surprised" the former president is looking for new representation for his appeal of the defamation trial verdict, calling out Trump lawyer Alina Habba's management of the case.

Trump announced late Tuesday that he was seeking new counsel for his appeal of the $83.3 million verdict in the defamation lawsuit brought by writer E. Jean Carroll. Habba, who served as Trump's lead attorney and frequently clashed with the presiding judge throughout the trial, handled the case "in the mafia way," Ty Cobb told CNN Wednesday, according to HuffPost.

“She’s done his bidding. She's articulated his political narrative of victimization and unfairness in the judicial system and made some outlandish claims, including the conflict claims,” Cobb continued. "And she lost, so she's a loser. I’m not surprised that Trump is looking for appellate representation.”

CNN legal analyst Elie Honig echoed Cobb's lack of surprise, explaining in a separate appearance Wednesday that when a lawyer and client receive a verdict like the jury awarded, they do often seek different counsel for the appeal.

"Here is my assessment of Alina Habba's performance as a lawyer," Honig said in a clip flagged by RawStory. "The good news is she is clearly passionate and believes in her client, and she is fairly effective at communicating one simple message. The downside is she doesn't know what she's doing in the courtroom." Honig went on to argue that Habba "can't even do things that you learn in evidence class" like move exhibits into evidence and uphold the rules of hearsay, citing the court transcript.

"The other thing is — and look, maybe this is an impossible task — she had zero client control," Honig said, adding: "Allowing her client to be muttering audibly in front of the jury, to walk out during the other side's closing argument, that is just inexcusable, and I think that's reflected in the huge verdict that they got hit with."

This is what mystified me about her. I have a powerful aversion to public humiliation. Kaplan said she told him that his attorneys had “graciously offered to provide” her team with lunch — a common civil practice between opposing legal teams.

“At which point there was a huge pile of documents, exhibits, sitting in front of him, and he took the pile and he just threw it across the table. And stormed out of the room,” Kaplan shared, adding that Trump specifically yelled at his lawyer Alina Habba for providing them lunch.

“He really yelled at Alina for that. He was so mad at Alina,” she said.

Kaplan continued: “He came back in and he said, ‘Well, how’d you like the lunch?’ And I said, ‘Well, sir, I had a banana. You know, I can never really eat when I’m taking testimony.’ And he said, ‘Well, I told you,’ — it was kind of charming. He said, ‘I told you, I told them to make you really bad sandwiches, but they can’t help themselves here. We have the best sandwiches.’”

Kaplan was deposing Trump at Mar-Lago in a lawsuit alleging the former president was involved with a fraudulent marketing company. A federal judge dismissed the suit last month.

In a separate anecdote, Kaplan detailed the end of the deposition when she was set to leave, saying that Trump told her: “See you next Tuesday” – a phrase that is often used as a derogatory euphemism directed at women.

“We come in the room and I say, ‘I’m done asking questions’ and immediately I hear from the other side, ‘Off the record. Off the record. Off the record.’ So they must have planned it. And he looks at me from across the table and he says, ‘See you next Tuesday,’” she recounted.

Kaplan said that she was initially confused, as their next meeting was set for a Wednesday. “You could tell it was like, it was like a kind of a joke again, like teenage boys would come up with. But again, I wasn’t in on the joke,” she said.

“I wasn’t in on the joke, so I had no idea. Then we get into the car and my colleagues are like, ‘Robbie, do you know what that means?’ And I’m like, ‘No, what are you talking about?’ They tell me and I’m like, oh my God, thank God I didn’t know because had I known, I for sure would have gotten angry. There’s no question I would have gotten angry,” Kaplan said.

It is standard practice to hire specialists in appellate work. It would be normal for the trial attorney to assist in locating and interviewing appellate lawyers. All of that is normal. What is not normal is that Habba had no idea what she was doing in trial and could not follow evidentiary rules. In order to appeal, one must form a record for appeal, which includes appropriate objections. She did not know how to introduce exhibits into evidence, nor did she understand evidentiary objections.

R57, it's my understanding that they have to put the money in an escrow account with the court pending appeal, so even though she might not get it immediately he still is out that money (unless he wins on appeal). As others have pointed out, it's doubtful an appeals court will even accept the case because of the lawyer's ignorance about trial procedure.

What appeal? R61 is correct that there’s no appeal possible until Trump relinquishes control of $83+ million to the court. We know that’s not going to happen. It’s been pointed out clearly in another thread that Habba messed up so badly in court there’s essentially zero chance Trump could win an appeal at even the first approach or a subsequent appeal of that loss in court. What’s going on is the usual Trump Theater (it’s not my fault; it’s someone else’s fault; what verdict, there’s no verdict). Every day that Trump continues to speak, the US’s reputation is degraded at a time when the world is getting seriously more dangerous. It’s why Biden said what he did about Trump; he knows Trump is a serious problem for the US in many ways.
