Martha Byrne and her troubles
Remember Lily from “As the World Turns”? In real life, things are not going well for her. Her husband has been accused of espionage for China by the FBI. Her home was raided in 2029, their access to money all cut off. Byrne loudly declares his innocence by going on interviews on every Right Wing show that will have her.
Her latest was with Dinesh D’Souza and that’s just a bit much.
How does the FBI accuse you of espionage without evidence ( according to Byrne.)

This was discussed in one of the stealth soap threads. If she truly believe her husband is innocent I don't blame her from aligning with whatever media will engage with her, but it is hard to believe he was convicted with no evidence. I thought I read somewhere that his search history is what doomed him. it proved he wasn't as naive as he claimed to be.

R5 Agreed ... And back when the trial first started, I read the very extensive report about the case at ProPublica. I found the report both impartial and objective. And from their analysis, I came to the exact same conclusion regarding McMahon that the jury who heard the case did. Guilty on two of the counts, but not the third more serious one.
I think he did something illegal in the stalking-intimidation area, and it also seems obvious that at some point he became aware of whom he was working for, but kept on going. But he wasn't some major operative for the Chinese government. While I have no knowledge of pre-trial events, I wouldn't doubt that he could have originally worked out some kind of plea agreement with the government, but he's probably too stubborn about maintaining his total innocence. I don't think he deserves 20 years like some news reports were spouting, though. Perhaps something like two years, maybe even as a suspended sentence, with a fine, and of course, he'd lose his P.I. license. I'm guessing that would hurt enough. (However, I also don't know what kind of leeway, if any, the judge has in sentencing when it comes to these charges.)
Looking at the current court action and document submitted, it looks like his attorneys are attempting to pick apart every piece of the government's case.

R15 First they had to wait for the court to file the official transcript. That took until late August. At that point, his attorneys immediately filed a motion to set aside the verdict, along with their intent to file other post-trial motions. The prosecution then submitted their argument against setting aside the verdict, with the defense subsequently submitting a lengthy response picking apart the prosecution's case. That was late October, and it appears the court is still reviewing these documents.

Does Byrne ever point out that this investigation and her husband's arrest occurred when the Trump administration was in charge of the DOJ? .. Even after the Biden admin came in January 2021, the Assistant Attorney General in the Trump DOJ who had been overseeing the prosecution of this case was one of the few holdovers and remained in the job until just a couple of months before the trial was to start. That would be John C. Demers in the video at R17. He's often a contributor to the conservative Federalist Society.

I LOVE it that this is costing them a FORTUNE. Her piece of shit husband put up posters/papers at these Chinese people's apartments/homes and there were threats written on them in Chinese. I know he obviously didn't know what they said, but he knew it was a threat and that's why he was putting it on these the front door's of these people's homes. To scare the hell out of them. That's he was surveilling them too, to scare the hell out of them. These people thought they would be killed. They thought someone, maybe even her husband would murder them.
Fuck that bitch martha. I hope they spent every penny they had on his lawyers, his defense & appeal.

The intimidation he facilitated sounds pretty horrible and probably not-so-well cloaked or thought out for a former NYPD Sargeant. Ham-fisted and not too bright describe his tactics and his face. He was hired for his resume, not competence, obviously. I kinda love that her ATWT earnings have been wasted away on his defense lawyers. Poor, poor Martha.

One of the news outlets covering the trial was the South China Morning Post, and in one of their reports it came out that he hadn't fully disclosed the China payments he'd received on his income tax. .. And while I can't find this other article any longer, I'm almost positive there was another report that said there was evidence that he'd transferred some of the money received to an account in his wife's name (meaning MB) and the adult son who has the same name.

That report was in the South China Morning Post article (paywall) written when the verdict came in and taken from the court record. It was part of the evidence showing there was a coverup, and it was also said that those cash payments were not reported on income taxes. LOL!

R34 It's not known yet, because even though the guilty verdict came almost a year ago (June 2023), the sentencing hearing doesn't appear on court schedule yet.
Right after the verdict, his attorneys filed two motions, which they were given time to prepare, as well as granted extensions, with the judge then having to rule on those motions. One was to set aside the (jury) verdict, the other was to request a new trial based on how evidence was presented by the DOJ. Both motions were denied. Those rulings just came down in March 2024.
Prior to sentencing, they have to go through a presentencing phase, part of which includes a probation officer interviewing the guilty party and looking at the case and preparing a recommendation report based on federal sentencing guidelines. I don't think it's been reported where they are in that process.

Just looked at the court record again, and it shows sentencing has now been scheduled for the three defendants in the case:
