Joy Behar appalled at thought of letting voters decide the presidency

“The View” co-host Sara Haines visibly angered co-host Joy Behar on Tuesday by claiming that former President Donald Trump will likely be restored to the ballot in Colorado and Maine.

Haines predicted that the Supreme Court will unanimously rule in Trump’s favor by striking down the decisions to remove him from the states’ primary ballots.

“The point I would say here is that I actually agree with [California] Gov. Gavin Newsom and [political strategist] David Axelrod — these are Democrats, leading Democrats, — that say this would really cause a division that’s almost insurmountable and as someone that believes January 6th was that bad —”

“So what are you saying?” Behar interjected.

“Just one second … One, I don’t think the Supreme Court’s gonna hold this. I think they’re gonna overturn it and it won’t just be the originalists,” Haines said. “I bet it’s a 9-0 vote. I actually don’t think they will hold this.”

“So do you think they should leave it to the voters or not?” a visibly exasperated Behar interrupted.

“I think they should leave it to the voters,” Haines said.

“Oh no,” Behar responded.

Haines argued if the court upholds the states’ decisions, Trump will become more of a martyr in the eyes of his voters. She said that many Americans no longer “believe in democracy” and that voters will see the 2024 election as “rigged” if Trump is taken off the ballot.

“No, I don’t agree,” Behar shot back. “I think that the law will stand and people should follow the law. Listen, if you’re not gonna follow an amendment, then why don’t we have Taylor Swift run for president?”

It's also in the Constitution that you have to be a natural born citizen and over 35 to run for President. It doesn't always matter what the voters think, some things are in the Constitution. For example, the Constitution says you can't be President if you've engaged in insurrection. If we're gonna allow Trump then it's not clear what the point of that amendment is or when it would ever actually possibly be enforced.

Her point was the constitution says an insurrectionist is disqualified for running for public office. An election shouldn't determine if he can be president any more than a foreign born person can run for president.

The requirement is that they be a natural-born citizen. Should a state be allowed to declare that a candidate not to their liking is not a natural-born citizen and then use that to bar them from the ballot, or is that a status that only the federal government can determine?

The requirements for being President of the United States apply uniformly in all states. One state cannot declare a candidate is over the age of 35 and another say he is not. He’s 35 in all the states or he’s not in all the states. Similarly, we will find that two states cannot declare that a candidate engaged in insurrection when the other 48 do not. It’s all or nothing.

Look, I don’t ever want that clown to be the president again, but the section you are referring to says that such persons may not hold office. It doesn’t say they cannot run for office. I realize this seems like splitting hairs, but it also says that the provision they cannot hold office can be overturned by 2/3 of both the House and the Senate. Since the House and Senate can’t override section 3 of the 14th amendment and appoint a president who wasn’t elected or wasn’t on the ballot, it seems pretty clear from that addition, that if he is unable to run, then congress is unable to “remove such disability” (i.e. override the disqualification). So what would the point of including that provision be?

Personally, I don’t want him removed because Texas is already threatening to remove Biden from the ballot and others are right, it will make right wingers think that he is a martyr and that all elections are rigged.

He’s never gong to win the electors in Colorado or Maine anyway. I don’t want to risk Republicans disqualifying democratic candidates who haven’t committed the crimes that Trump has or make him a martyr and his followers more likely to think elections in the US are rigged, despite the fact that they aren’t.

He needs to stay on the ballot. The alternative is more dangerous.

OP, The United States is a constitutional federal republic. The 14th amendment states it clearly in section 3: The lying, failing, vile Orange Tub of Shit tried to overthrow the government of the United States. People DO NOT have the right to vote in a presidential for anyone they want: You need to be at least 35, born in the United states and HAVE NOT COMMITTED AN ACT OF INSURRECTION against the USA. That is not up for a vote.

Fourteenth Amendment, Section 3:​

"No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any state, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof But Congress may by a vote of two-thirds of each House, remove such disability."
