They also argued that Trump cannot face criminal charges because he was acquitted by the Senate after being impeached for the alleged conduct.

In the brief, prosecutors wrote that the presidency "plays a vital role in our constitutional system, but so does the principle of accountability for criminal acts—particularly those that strike at the heart of the democratic process.

"Rather than vindicating our constitutional framework, the defendant's sweeping immunity claim threatens to license presidents to commit crimes to remain in office. The founders did not intend and would never have countenanced such a result."

The filing was submitted ahead of oral arguments scheduled for January 9....

My guess is it’s a combo of dwindling campaign cash and encroaching legal cases. He can’t afford both.

A campaign rival gives voters (and more importantly, big money donors) a place to go in the event of a conviction. It also reduces his ability to attract heavy money to pay for his defense. (Not to mention the drain of civil judgments.)

He if he’s the only one left standing, he probably could prevent a delegate filled convention from denying him the crown, even if he’s convicted. On the other hand, if there’s still a clean rival in the room it would be much more difficult.

This appeal nonsense in Navarro’s case is bullshit. Appeal what? What? He denied a Congressional subpoena and subsequently found guilty of 2 counts of contempt. This conviction is clear-cut to me. I’m not completely against appealing a lower court’s decision, but this decision/ case is like shooting fish in a barrel. The fucker is clearly guilty. Haul his flabby ass to jail. Same with slimy Bannon, who’s sentence is currently on appeal. He should’ve been serving time since last summer. Very frustrating.

Merrick Garland sat on his hands over a year and a half before even investigating any of the major figures who planned and instigated the insurrection.

The Jan. 6 Committee was way ahead of the DoJ in finding evidence that they shared with the DoJ who had collected very little at that point.

Had Garland got busy a year earlier, most of the trials could have been started well before this election year. He was fine with pursuing low-level characters in the Capitol riot, but unnecessarily delayed pursuing the Trump gang. And he showed reluctance until Jack Smith finally got named.

Trump is such an asshole. When Roberta Kaplan was at Mar a Lago taking a deposition of Trump, this is how he ended the session:

“We come in the room and I say, ‘I’m done asking questions’ and immediately I hear from the other side, ‘Off the record. Off the record. Off the record.’ So they must have planned it. And he looks at me from across the table and he says, ‘See you next Tuesday,’” she recounted.

Kaplan said that she was initially confused, as their next meeting was set for a Wednesday. “You could tell it was like, it was like a kind of a joke again, like teenage boys would come up with. But again, I wasn’t in on the joke,” she said.

"Former President Donald Trump's federal election interference trial in Washington, D.C., will no longer begin on March 4, Judge Tanya Chutkan wrote in a court order released on Friday. It is unclear when the trial will now start.

Chutkan's ruling comes as the D.C. Circuit Court has not yet decided on whether the former president is immune from prosecution."

There is nothing in the constitution saying the president is above the law. If you want that in the constitution, write and pass an amendment. Otherwise, sit down…in the courtroom. Take a seat and be tried for crimes committed.

r591, that is just another norm that Trump is questioning.

Trump's logic is if the SC has not given its opinion, he will ask them.

Trump is using the SC as his court of origination. Trump would litigate and appeal, the sky is blue as the SC has never rendered an opinion. The rest of the nation has chimed in with the 14th Amendment Section 3 lawsuits:

1] Is The President of the US an Officer of the US?

2] s Trump an Insurrectionist?

3] Is it allowable for Trump to be removed from the 2024 ballot?

Trump spent his entire adult life suing delaying tactics, evading tactics, counter-suing, appealing, in order to avoid both civil and criminal cases against him. His MO has been successful most of the time, but this time between the civil suits and the 91 criminal indictments, he is running out of legal options and probably also running low on money. He was probably never a billionaire, at least not a liquid one.
