Bijou Phillips writes a letter to the court on Danny Masterson's behalf, asking for leniency

When allegations of rape against Danny Masterson cost him his TV show and Hollywood career in 2017, he bought land in the Santa Ynez Valley (setting for the movie “Sideways”) and started a vineyard, toiling “long days on the land” to make it a profitable venture, his wife Bijou Phillips said.

Phillips, the “Almost Famous” and horror film actress who has been married to Masterson since 2011, made the disclosure in a letter to Judge Charlaine Olmedo, one of many that was included in a defense memorandum asking for sentencing leniency.

Despite heartfelt pleas from Masterson’s “That ’70s Show” castmates Ashton Kutcher, Mila Kunis and others, Olmedo sentenced Masterson to the maximum 30 years to life in prison on Thursday.

Parts of the letters obtained by TheWrap were redacted, including entire passages from Phillips’ letter. But it acknowledges that she had gone through some kind of major health issue; a separate letter, from the actor William Baldwin, mentions she had a kidney transplant and feared for her own well-being.

“I depended on Danny to take care of me and our daughter,” Phillips wrote. “I always felt that she would be okay because Danny is an amazing father.”

The allegations first arose weeks after her transplant in 2017, when Masterson was written off the Netflix show “The Ranch.” That’s when he began working hard to pivot to the winemaking business, Phillips told the judge.

“When we finally returned home, we thought we could start to focus on our lives as a family,” she wrote. “That’s when the investigation against him began. After he lost his show and acting career, he devoted himself to finding other ways to earn a living.

“We left our home in Los Angeles to move to a farm in Santa Ynez, where I could recuperate. Danny immediately began to work the land and grow a beautiful vineyard with 6,000 vines, that he tended on his own for six years. He toiled long days on the land to make it profitable for our family. He took classes to learn about growing grapes, wines and he became a sommelier. He also studied the business end of it.”

Dear Judge Olmedo,

I am writing to you to ask that you consider this information when sentencing my husband, Danny Masterson. Danny and I have been together for 19 years. We married in 2011 and our beautiful daughter was born in 2014. She is the bright spot throughout many years of crises and uncertainty.

I can say that Danny has literally been a life-saving partner to me.

At the time, our daughter was just three years old. She was our miracle child. I depended on Danny to take care of me and our daughter. I always felt that she would be okay because Danny is an amazing father. He was devoted to our daughter, would read her books, take her on walks and to ballet lessons. I never once heard him complain. The two were inseparable.

He tried to shield the younger actors he worked with from such temptations and offered them advice on their careers and in their lives.

Danny is an amazing father. Our daughter and I are heartbroken that he is not home with us. It has been very difficult without him here. Even though he is now in jail, he calls her every day. He helps her with homework every night. He teaches her math with kindness and patience. She is far above grade level in all subjects, reading three grades above her own, and that is thanks to the guidance and attention of her father. Danny has watched her piano recitals and applauds when she practices in the living room after each song. Our daughter loves her pony on our farm, as well as our dogs and cats. But more than anything, she loves her father. When he calls us each day, she ends with “I love you too much Daddy.”

I feel bad about this whole situation. If he committed a crime, they yes, he must be held accountable. But 30 years seems so extreme, although I am not a legal expert. Thirty years to life is a life sentence. Prison is punishment, but is there any room for redemption?

Bijou's letter is heartbreaking, but it's too late. She needed to send it to the judge after the verdict in May--not now after the sentence has been handed down. It's seems like the only thing that might have an affect now on a sentence reduction is the appeal process, which is a long shot.

If I understand the verdict correctly, Masterson received two 15-year sentences (for the two victims) to run consecutively. Perhaps he could have been given two 15-year sentences to run concurrently. Everyone needs a little hope. Fifteen years shows a little hope. Thirty years is nothing but doom.

I wonder what was offered before the trial as a plea deal.

I'm sure the letter was sent before sentencing. It's just being released now. I agree, r5, the sentence is excessive. We no longer do rehabilitative justice in this country. It's largely punitive.

5 to 7 years would have been more appropriate and would likely be upheld by a reviewing court on appeal. 30 to life is excessive. That woman who for no reason pushed the beloved voice coach to the ground on the street, killing her, only got 8 years! For taking someone's life!

He's a fucking monster. The fact that there are people in this thread crying about a rapist's long sentence is crazy. I was surprised by 30 years but it was a pleasant one. Most rapists know they'll never do any time at all and most likely won't get caught. Fuck them both. Bijou always seemed like a psycho too. I shudder to think what kind of sociopaths they're raising. The sentence isn’t excessive. The fact that other cases get lighter sentences demonstrates a flaw in those situations. It doesn’t mean Masterson should get less time.

Hopefully the daughter has some other stable adults in her life. I would imagine she’s already smarter than her mother if she’s actually ready 3 years above her grade level.

That's the thing. Her letter to the judge might have been "heartbreaking" if it had been written by a normal person who is not the brainwashed member of a cult, but although I know almost nothing about Masterson and Phillips, I have to assume she's a clam like he is -- and if not officially a Scientologist, she's at least quiet about and therefore complicit in the evil they do (and he has done).

His sentence was this long because he intimidated and threatened his victims afterwards for almost 20 years. Had he have not done that, he probably would have only received 10 to 15 yrs max. But he didn't just drug them and then rape them. He threatened them and he had other people threaten their lives and the lives of their children and other family members. This went on for 20 years. Fuck this piece of shit. He received the sentence he deserved. I think he turned down a plea deal too.

He got exactly what he deserved.

he'll appeal it and some judge will probably shorten his sentence.

30 years seems like a harsh sentence for two reasons - the amount of time that has passed and the difficulty of proving rape in cases where the two parties know each other

So, yeah. It seems like a lot. If he raped them violently, drugged them, and held a loaded gun to someone’s head, sure 30 years. Absolutely. Aside from what he deserves, I don’t want him walking around. But how did they prove that? I’ve read a few articles, but haven’t seen details of how his actions were proven. Also, if it was established that that the delay in prosecuting was due to pressure applied to the victims by Scientology, when do those people get prosecuted?

The claim that’s he’s never even smoked a joint makes me LESS sympathetic to him. Some guy on a bender who is already doing drugs with a partner gives them something extra and then rapes them seems somehow less creepy than a totally sober guy who drugs a completely unsuspecting person who had no intention of consuming an intoxicant. But maybe that’s a victim blaming attitude. It’s not so bad to drug a drug user if you are drug buddies?

Drugging and raping someone? There doesn't seem to be a general guideline for a sentence. Why are this bitch and his husband free for example? I don't know about 30 years. It seems long in comparison but I am not familiar with the details of the case.

Different states have different sentencing guidelines. The article doesn't say how many years he faced if tried and convicted. I also wonder if there's an element of homophobia in it. Back in the day women who were raped were accused of "asking for it" because of what they were wearing or alleged promiscuity and rapists either got off the hook entirely or with ridiculous sentences like this. See where I'm going with this? It's Texas.

The case was proven, to a jury, unanimously, beyond a reasonable doubt. You're admitting it's difficult to prove, but not acknowledging that it was proven.

The prosecutors didn't prove their case to this shithead poster, and you know what that means? Danny Masterson will have to be released.

Shithead didn't watch the trial, can't be bothered to even google a single detail, but he expects the prosecutors to have gone over to shithead's house and told him their case strategy, showed him all their evidence and presented their witnesses to him. So now he expects Danny Masterson has to be released, immediately, because no one proved this case to him.

There were 5 women. The prosecution only presented two cases. Now, try googling some of this. Don't ask people to give you every single detail.
