One of the biggest issues on appeal will be the fact that the Judge ruled the sentences will run consecutive and not concurrent. I suspect the convictions will be upheld but he may get that changed. Possibly end up with 15 years total. Top Gun Maverick made a lot of money that will fund the appeal.

It’s a very rational and thoughtful letter with regards to a suitable sentencing. He does not proclaim his innocence. Of course Twitter, which can’t sue soon enough, can’t understand the nuance.

this is one of Ashton's best friends. He was clearly asked to do this and Ashton's team put a lot of thought about what to write. He does have nearly 20 years of experience watching this person in a professional setting and has nothing but praise. It does not question the victims.

No. I imagine it’s exceedingly rare that they do. Gives people close to he convicted felon the peace of mind that they were able to do something to try to help them.

The first paragraph of the letter was OK. Ashton attested to what he knew about DM, what he (Ashton) observed with his own eyes.

The second paragraph, where Ashton opines that DM is not an "ongoing harm to society," is going too far. Ashton seems to acknowledge that the women who testified were "victims," so how is DM somehow, now, changed?

No, it's not a balanced letter, R26. It treats as relevant Kutcher's opinion that he was always nice to people on set and treated them all as equals, and indeed as a mitigating factor proving his good character. "I can honestly say that no matter where we were, or who we were with, I never saw my friend be anything other than the guy I have described." That opinion is beside the point. Even if Mila said, "I stayed overnight at his house on many occasions and he never drugged, raped, and donkey-punched ME," it would be irrelevant. All they're describing is normal, baseline behavior, nothing especially exonerating. It's also poorly written.

"While I'm aware that the judgement has been cast as guilty on two counts of rape by force" (WTF?) "and the victims have a great desire for justice" (WTF?)

This is possible. There was the Apprendi v. New Jersey SCOTUS opinion about enhanced sentencing (need for enhanced sentencing must be proven to a *jury* beyond a reasonable doubt). Consecutive sentences are different from enhanced sentencing, but they have the same effect, i.e., the sentence comes out way longer.

I don’t like Masterson but this is someone whom they cared about, who they know is going to prison and they don’t want to see him go to prison for the maximum sentence. This is just how people are, this is how they process these awful situations.

Not saying rape is okay, but it’s going to be scary Orwellian times when women take over and rape allegations automatically lead to convictions lead to life imprisonment and death row.

I’ve known six women who made up false rape allegations. I know of two who colluded because they were mad at the same guy and wanted to get revenge on him. I know of three women who have made up fake molestation charges in divorce/custody cases. Whenever it comes out that these women have lied about these accusations, people turned a blind eye, and it’s just a “oopsie”.

I think he definitely deserves a harsh sentence and maybe I'm not completely aware of all the facts and perhaps his rape of these women was far more brutal than I can imagine but the sentence does seem a bit Draconian considering we claim our penal system is supposed to rehabilitate.

He was paroled later that year. It was a "three strikes" thing. One of the strikes was armed robbery.

Three strikes sentencing rules are ridiculous, but within that context, I can see their point in refusing to review the case. It was a matter of the courts following the law, not of moral correctness

The one woman woke up while he was raping her. She grabbed a pillow and put it between them to try to get away. He held it over her face until she passed out again. And punched her head. And choked her. She took photos of her body after the incident.

Where are people getting the idea that they waited 20 years and came out of the woodwork with accusations and no evidence? Making inflammatory comments without being familiar with the case is dedication to the narrative of women being monsters and men being helpless innocents who just can't help themselves.

I get the sense there are many men whose only talking points regarding rape is "But it's so unfair, it's just he said/she said, any vengeful woman or someone who regrets being a slut can accuse a man and he can get sent away!" They never discuss sexual assault without bringing up not all men, or false accusations, or scenarios they feel are unfair to men.

If you know six women who have lied about allegations then you are hanging out with a questionable crowd. Or you're lying.

This absolute piece of shit gets 30 years, and people want to call it harsh? If it feels "too much" compared to other crimes, then raise those sentences.

It was premeditated. He put their physical lives in danger and disrupted their emotional lives indefinitely. Let him hang.

It's great they both choose to highlight Danny's strong anti-drug stance when he was convicted of drugging multiple women to assault them. Maybe just leave the word "drugs" out entirely.

Billy Baldwin is Bijou Phillips’s brother in law. I understand him writing the letter from the very practical perspective of him being an uncle to Masterson’s kid.

I get that Scientologists and C-list actors are his his social and professional milieu. But aside from the showrunner of The Ranch (who fired Masterson after his name because PR poison) and a 9/11 firefighter who got some assistance from his Scientologist detox charity, this is who he had couching for him en masse.

The idea that a judge would read a letter from Mila Kunis, note her praise of Masterson’s displays of superficial charm, and therefore concluding that 8 years is a more appropriate sentence is baffling to me.

Actors don’t realise how much of the general public despise them.

R40 Apprendi v. New Jersey probably won't apply. Masterson was convicted on the rape charges of 2 different victims at different times not a single crime. Cruise's $cientology money appeal lawyers will focus on that basis and request concuurent.
