New York rewards $2 Billion to people too dumb to teach for not hiring them as teachers

Failing the New York State teachers’ exam really paid off — especially for a Queens man who learned this month he’s getting a $2 million windfall over it.

Roughly 5,200 black and Hispanic ex-Big Apple teachers and once-aspiring educators are expected to collect more than $1.8 billion in judgments after the city stopped fighting a nearly three-decade federal discrimination lawsuit that found a certification exam was biased.

It’s the largest legal payout in city history.

As of Friday, 225 people who failed the Liberal Arts and Sciences Test used for teacher licensing from 1994 to 2014 had already been notified they’re getting settlements of at least $1 million, according to an analysis of Manhattan federal court records.

Court rulings found the exam violated civil-rights laws, allowing far more white candidates to pass.

The case is expected to generate hundreds of other future million-dollar awards.

Herman Grim, 64, of Queens, on July 5 was awarded the biggest judgment to date — a jaw-dropping $2,055,383.

It includes $1,583,114 in back pay for time never clocked, lost interest accrued, and other compensation.

The judgments are based on what the teachers and teacher candidates would have earned had they passed the test and kept working in the city’s public school system.

Typically, the further back they failed the test, the more money plaintiffs are entitled to.

Under an agreement ironed out in November 2021 during then-Mayor Bill de Blasio’s final weeks in office, the city agreed to set aside more than $1.8 billion in funds to pay off the plaintiffs through 2028.

But the cost to taxpayers is expected to be significantly higher because they’ll also be footing the bill for many of the plaintiffs to collect pension checks based on time never worked after they reach retirement age, plus their health insurance.

The remaining plaintiffs’ claims are being assessed by a court-appointed special master, who already racked up more than $8 million in fees at taxpayers’ expense.

The city is also on the hook for the plaintiff’s lawyer’s fees, a sum that totaled more than $43 million last year.

The payouts have many critics flabbergasted.

“It’s a struggle to explain how New York City could spend $38,000 a year per kid with such a poor return, but decisions like this really help people understand where all that money’s going,” said Ken Girardin, a fellow and labor specialist for the conservative government watchdog group Empire Center for Public Policy.

When contacted Thursday, Grim said he was unaware he struck gold but confirmed the award the following day with his lawyer.

Grim said he’s in disbelief but the money can’t come fast enough because he’s racked up serious debt on his Queens home and credit cards.

He couldn’t recite examples of why the test was biased.

But Grim recalled hiring private tutors and studying for it during the early 1990s, before failing many times.

“I can’t tell you how many times I took them. A lot! A lot!” he said.

“I want to stay as normal as possible,” he insisted. “I’m not going to be a millionaire.”

One Brooklyn principal said the city was “crazy” to settle the case.

“The standards are the standards,” he said. “It shouldn’t be based on what would be easy for blacks or whites. To hire people who are not qualified and change the requirements because a certain group didn‘t pass the test is bulls–t.”

A 2003 trial ended in the city’s favor, but the tests were ruled discriminatory in 2012 by the third Manhattan federal judge to handle the case.

If they had hired these people originally it might have meant that their students would have received a lesser quality of education, and many of their students would have been....Black and Latino.

[R16] I am thinking the same thing. Initially I figured perhaps Latinos were at a disadvantage if English was not their first language, but that would be equally true for Asians. I can see "arts" as having bias as interpretation can be subjective, but math and science is what it is regardless of background/culture. I guess this is the same thing California is planning with the bar exam for attorneys. They plan on getting rid of it because the failure rate is so high for Blacks. After that they can claim Blacks are not getting adequate legal representation resulting in unfair incarceration rates.

Yes, I am aware of the SAT example wherein they said that much of the language and vocabulary test is biased, but c'mon. Teacup is the saucer as lid is to blank. The argument was that poor kids had never seen a teacup or a saucer so had absolutely no idea what the answer would be. That's not biased. That's laughable.

I sometimes feel bad about thinking this and I have been drinking but in present day America could it be that white Americans have on average higher iqs than black Americans. I mean liberalism, with all its good, did allow multiple generations of dumb welfare recipients to procreate like crazy. Oops I just fonted that. I feel awful.

I wish I understood why American-born Blacks do so poorly academically compared to Whites and Asians (born in America or immigrants). Probably multiple reasons. It seems standards have to be lowered for them to complete and excuses regarding cultural bias always being brought forward. Interestingly enough, according to Pew Research, recent immigrants from sub-Saharan Africa are just as successful academically as immigrants from anywhere else. Whatever we have been doing to help "level the field" in this country has been unsuccessful so far. I wish I had a clue as to what the answer is. Clearly it's more than cultural bias as American born Blacks would have the advantage over African born Blacks.

Something like 75% of black children are born to unwed mothers. Also there is an urban black culture that undermines success in school. I’d say those two factors are major causes of the problem.

R27 Single parent households— that’s the culprit. And don’t get me wrong single parents, particularly black mothers, can be a beautiful thing but NOT when it is regarded as an expected cultural norm. And that’s what happened with African-Americans and I specifically mean exclusively American born blacks and heritage. The single parent and baby mama phenom has ruined black America. Because it’s treated like it is ok. It is ok to procreate and raise a child with a man whom you DONT even live with. Divorce and non married couples exist in all cultures but when women raise these children alone in non Black America they often have a support system of grandfathers and uncles. In Black America that has been decimated by the industrial prison complex and again the accepted norm that is ok for a dad to be 100% absent. All of that affects a young black man already battling a racist society with behavioral problems and dysfunction which impacts one’s ability to learn. The democrats used to care about such matter but now for whatever globalist or occult reason they WONT touch it. I specifically state young black men because they routinely have lower iqs and test scores than black females.

Overwhelmed by NYC generosity but its sense of injustice is grossly misdirected. Yes, there are disadvantages relating to race and ethnicity, so why not spend the money to help these in need - food, better education, shelter. 2B could do a lot of good.

This is the reason that California is looking at eliminating the Bar entirely. They have already reduced the passing score. Who will this ultimately hurt the most? I suspect the people that use attorneys in the group that has only a 31% pass rate. As was stated above, if we apply the same to MDs and other professionals, this will hurt the groups are most likely to use the professionals in the lower (extremely lower) performing race/cultural groups. I'm sure good intentioned people think this will help, but it will do the opposite. I hate to quote an asshole like Louis Farrakhan of the Nation of Islam, but welfare has destroyed the African American family. Obviously you can't cut off welfare and let children starve, but perhaps people could still be eligible for some assistance even if the father is living with the family.

A parting coupe de grace by DuhBlasio was attempting to eliminate the entrance exams for the elite public schools in NYC, one of which his son had graduated from several years earlier. Asian parents were outraged, and rightfully so. I don't know the status of this issue, but it is the same idea as this payout and all the other lessenings of standards to avoid facing the truth about certain groups.

I think at play is the interplay of nature and nurture. Asians and Ashkenazi Jews tend to have higher IQs then Gentile White, blacks and Latinos in that order. It just so happens that these two groups value intelligence, scholarly work, status and contributing to/building society. If one raises their children in a very stressed environment, no books, education and intelligence are not valued, inadequate verbal interaction, poor nutrition, inadequate social support, addiction, etc., God help the kid. At the same time, if someone doesn't have the innate cognitive capacity and temperament, no amount of all the best things in life is going to get them beyond a certain point. Harry of Montecito immediately comes to mind.

There are no guarantees in health or life, but you do want to stack the odds in your favor.
