It is a common misconception that prenups automatically expire in California after 10 years. Absent a previously negotiated sunset clause they are valid for the entire marriage. Costner had very expensive lawyers I doubt he agreed to any sunset provisions. She was fully aware when she signed the legally binding contract.

You are correct, they do not expire after 10 yrs. However, since 1997, living in Southern California(La Jolla), there has not been a 10 yr pre-nuptial agreement that I have not been able to make null& void because the wealthier partner did something stupid. If she is required to pay her own fees she will have really lost. I suspect the prenup will be upheld. She was getting terrible legal advice by arguing the kids were entitled to an equivalent lifestyle when residing with their mom. That's not how it works. Child support is determined by algorithm based on the income of both parties and the amount of visitation time. It has nothing to do with maintaining equivalent lifestyles in both houses. That her lawyer argued the kids should travel in private jets with their mother because 'luxury is in their DNA' is baffling.

There's no way the divorced spouse without an income is going to live at the same level of luxury as before. Costner will be fine, but Baumgartner's days of beachfront houses and private jets are over.

He makes a lot of money but I have a feeling his fortune is overestimated. He hasn't had a hit in decades, he had to legally give half his money at the peak of his career and he's now doing a TV show on a streaming network in an age where shows and movies are not pulling in even half the money they did in the 90s.

Sometimes the courts will allow small additions or subtractions in special cases for things like health premiums and childcare expenses. If Costner has the kids 50% and he says he's going to be working nonstop the year ahead you know he's going to fob the kids off with a housekeeper, so he might have gotten a reduction for that, but I doubt it.
