OK. Two guys are driving in a car. They have been drinking and smoking weed all evening and it is now 3 AM and they're driving on a deserted country road. The driver loses control, goes thru the guard rails and into a pond the car is upside down. The passenger manages to get out. He's in a daze. He drags himself back to the highway and manages to get back to his house less than a couple miles away He collapses and passes out . once he gets in the house. Driver is dead. Is the passenger guilty of a crime?

Aside from a few states, it is not illegal in the United States to refrain from calling for help. It is not illegal to be an impaired passenger. (Otherwise, "Be a designated driver!" would not be enough.) If marijuana is still illegal in the passenger's state, he might get in some trouble for that, though.

OK. Fine. Yes we were watching Succession and this was the last episode of Season One when Kendall walked away from the accident and that young man died. His father is a fucking monster. Ofcourse Kendall was traumatized by the accident. And he suffered from survivor's remorse because he wasn't able to save the driver. But realistically, the driver could have broke his neck or suffered from some fatal injury on impact, and not necessarily drowned because he wasn't rescued.
