The sergeant was sexually harassing the younger officer. That is a separate matter.

From the video, it is clear the younger officer deflected and rejected the sergeant's advances.

It does not mean that the younger man was justified in shooting him. The lawyers and father of the younger officer are using a version of "gay panic" in their defense of his actions.

No he didn't. The sergeant survived three gunshots. But I do think there's more to this story. The officer's dad says inappropriate behavior, unwanted sexual advances, etc., were going on for some time and that his son complained about it to superiors, yet he goes out for "a night of drinking" with his alleged harasser. Did he meet him that night already locked and loaded and ready to take care of business? If so, then there was premeditation. And his 911 call was OTT. I would think a cop would remain calm, but this officer was a bit too dramatic.

Neither were lookers, but the killer had those tell-tale pugilistic features that are an immediate warning sign to stay away from someone prone to violence. The dead sergeant should've known he wasn't attractive enough to pull off the advanced art of hooking up with first-timers.

Sarge was getting off on the power dynamic; Rusk was super closeted and conflicted. Over the past year Sarge had been tempting him and teasing him, and Rusk would whine and moan and refuse his advances until he finally gave in. Then he'd pretend it never happened and the cycle would begin again. That night Sarge thought they were just playing their usual head game, not realizing Rusk was pushed to his breaking point.

At least Rusk was clever enough to make those harassment allegations, probably to make him look like an unwilling participant in case the two ever got caught. But now they might keep him out of jail.

There's a lot of complexity to this soup -- or maybe it's just a hodgepodge of the usual ingredients: confused young cop, insecurities, shitloads of alcohol, the de-rigueur homophobic upbringing, a hillbilly redneck, moonshine-soused dad who probably called him a sissy and a faggot when he didn't like the timbre of his kid's high-pitched voice. Maybe Sarge functioned as a more sensitive (more tangents spring from that) father figure who understood his "complexities" more than poppa did. They may or may not have had prior fumblings. Sounds like a toxic convergence of mixed emotions, lubricated by gallons of booze. I don't think it's as simple, as some have suggested, as a straight dude who flew off the handle at an advance. The sheer hysteria he exhibited counters that. The prototypical straight dude who shoots in "self defense" would be a lot more defiant and self-assured in his hilllbilly-god-given rights to exterminate his rapist. This guy is confused and psychologically damaged. He may well have been the target of ongoing harassment from his superior, but that seems a little too simplistic here.

The video is very telling. The sargeant tries multiple times to put his hands on the officer and the officer refuses.

The sargeant refuses to address the accusations of sexual harassment and the police department refuses to address the officer's claims of reported harassment.

It's very easy to deduce what went on and the complicated, convoluted stories here are an attempt at deflection of an obvious gay man's attempt to fuck a subordinate officer who wanted nothing to do with him in that way. Regardless of the officer's assumed sexual orientation.

What the video shows is an individual who will not stop sexually harassing an individual who has made it very clear they are not interested. Seems to me that when the young officer first felt harassed at the bar, he should have just left immediately, no further words or interaction, get up and leave. He had a way out of the situation, just leave, no further interaction at that time. Instead he lingered, which looks to me to be a game of cat and mouse between the officer and sarge, and continued outside. Grown men have the power and free will to Walk Away and be done with it. Williamsburg Fire Department responded and transported the victim to Riverside Regional Medical Center with critical injuries; he is expected to recover.

There is no ongoing threat to the community.

The offender has been identified as Michael Trenton Rusk, a 24-year-old male resident of James City County. Mr. Rusk was transported to the Virginia Peninsula Regional Jail (VPRJ) and charged with malicious wounding, use of a firearm in the commission of a felony, and discharging a firearm within City limits.

The initial investigation indicates the two men are known to each other.

Mr. Rusk is employed as a police officer with the James City County Police Department but was off-duty at the time of this incident.

The investigation is ongoing.

I agree that gay or straight- in a power dynamic like this case- the totality of the touching, calling, texting, drinking, and et al -could amount to sexual harassment. But three things still confuse me. If after a year you knew what happening-even at 24-you should have told someone or reported it. Second, although I understand the power this man must had over this young man-he still went out drinking with him. He still didn’t move when he changed seats. He may have pushed him away but it wasn’t a violent get the fuck away from me push. More like a lover pushing a drunker lover away for being too aggressive in public. And finally the 911 sounds more like Lana Turner than an officer on a police force. He is confused-he just shot his lover/authority figure. And he is confesses that his whole evening has been one of force. I disagree with his lawyer using the idea that if he were a woman this would be a different story. If he were a woman there would have been physical issues more at play. But a young buck, and his “ dad” -both cops- would surly know how to defend themselves. I agree that this was not their first dance. They have jumped the rope some- too familiar ( the touching and all). And one more thing: the finger he puts up: gay-gay-gay! But that is still no excuse for harassment of any sort.
