Paramedics Charged With Murder After Strapping Patient Face Down On Gurney
Two paramedics who were called to save a man's life have been charged with first-degree murder after the man suffocated to death when the suspects strapped him onto a gurney face-down.
The charges against Peter Cadigan, 50, and Peggy Finley, 40, in connection with the Dec. 18 death of 35-year-old Earl L. Moore Jr., of Springfield, Ill., were announced on Jan. 10 by Sangamon County State's Attorney Dan Wright
The Lifestar EMS workers were called to Moore's home just after 2 a.m. after police officers responded to a 911 call. Those officers reported that Moore had possibly been experiencing hallucinations from alcohol withdrawal and that he required medical attention, according to a press release from the Springfield Police Department.
When they arrived, the pair placed the patient on the stretcher lying flat on his stomach and tightened a medical strap across his back and lower body, newly released body camera footage shows.
Moore was then taken to a local hospital, where he was pronounced dead, authorities said.
A coroner's report obtained by PEOPLE revealed that Moore's cause of death was "compressional and positional asphyxia, due to prone face-down restraint on a paramedic transportation stretcher due to straps across the back."
The pair should have known from their training and experience that positioning a patient in such a way "would create a substantial probability of great bodily harm or death," Wright told Fox News.

Yeah, even if he were drunk or OD'd and they were concerned about choking from vomitting, I can't imagine anyone thinking strapping someone face down is a good idea.
The only reason might be because there was an injury which prevented being on his back or side, like wound or a knife or metal bar they didn't want to remove before reaching the hospital.

If that were the case, shouldn't one of the two paramedics be in the back monitoring his vitals during the trip to the hospital?
Doesn’t first degree murder indicate they intended to kill him?
While the requirements vary:
most state penal codes require that a prosecutor establish willfulness, deliberation, and premeditation in order to convict a defendant of first-degree murder. Willfulness requires that the defendant acted with the intent to kill another person. Thus, the death cannot have been accidental. However, the prosecutor does not have to show that the defendant intended to kill that particular victim. If the defendant shoots into a crowd with the intent to kill his friend, but hits and kills a bystander instead, these facts can still support a charge of first-degree murder
It doesn't seem like they intended for him to die, so seems to fail to mee the requirements.

They intentionally strapped him down, but I doubt they intended for him to die. If you fire a gun into a crowd and someone died, that's first degree murder. This isn't the same thing.

As the cop in the bodycam footage is helping the male EMT get the hallucinating guy into the gurney, he turns into a face-down position, and the male EMT makes no effort to turn him face-up; he just shoves him down onto the gurney, obviously angry, then straps him while he’s face-down.
The whiney tenant had said her landlord had been picked up several times in the past while going through withdrawal, but the hospital “kept releasing him.” I wonder if the same EMTs had problems with him before, which is why they acted the way they did.

Answering my own question: "According to a common factoid, there's a community called Springfield in all 50 states, but the U.S. Board on Geographic Names says that's not true: only 34 states have a Springfield. The real champ is Riverside. Unless you live in Alaska, Hawaii, Louisiana, or Oklahoma, there's at least one Riverside in your state.
But even Riverside isn't the most common place name, due to in-state repeats. There are "only" 186 Riversides, but Fairview and Midway are way ahead, jockeying for the top spot. Playing around with the online Geographic Names Information System (GNIS) database, I see that at last count there were 273 places called Fairview and 257 called Midway."

Charging paramedics with murder due to neglect, incompetence, or bad training is odd to me. Why do they get charged with murder while doctors and nurses get sued for malpractice?
As another example, it's clear to me that Elijah McClain died because the moron EMTs confused pounds and kilograms when dosing him with a sedative. That's a criminal case and not a civil malpractice one? Why?

Unless the officer present or someone else can offer testimony or other proof of intent to kill the poor guy, I'd think manslaughter or negligent homicide would be the appropriate charge rather than murder.

To those saying they needed intent to kill this guy, that’s not true.
Illinois Murder 1 statute includes this:
A person who kills an individual without lawful justification commits first degree murder if, in performing the acts which cause the death:
(2) he or she knows that [bold]such acts create a strong probability of death or great bodily harm[/bold] to that individual or another;
It could reasonably be argued with all the attention this issue got with the George Floyd situation, coupled with their EMT training, they knew there was a strong probability of death.

R37, smfh A doctor can be charged with murder too if he/she/they knowingly did something egregious. Someone should never be strapped face down. Doctors have been charged with murder. Most doctors are high IQ however and would never do anything beyond the scope of incompetence. Incompetence can make you liable for civil damages.
What they did wasn't incompetence. It was negligence, intentional, and cruel.

Local chapter of the NAACP is now getting involved, because they cannot ignore the similarities to George Floyd as the victim is Black
Springfield NAACP President Teresa Haley said she viewed police body camera footage that showed the EMS personnel lacked compassion when dealing with Moore, a Black man, and brought a hostile attitude toward him.
“For me, it’s not about him being a Black man. It could have been a white family. If we were called in, we would have the same opinion. Everyone deserves to be treated with dignity and respect,” she said.

One of the Paramedics (Finley) is heard yelling at Moore to get up and walk out to the ambulance. “You’re gonna have to walk ‘cause we ain’t carrying you!” she says. “I am seriously not in the mood for this dumb sh*t.”
According to the coroner’s autopsy report, Moore died of “compressional and positional asphyxia due to prone facedown restraint on a paramedic transportation cot/stretcher by tightened straps across back and lower body in the setting of lethargy and underlying chronic alcoholism.”

R76, that's sweet. But it was years ago and totally my own doing. My poor choices. Just something I had to get through. Which I did, thank goodness.
The point of my post was that the man who died was probably hard to handle because he had zero response time to whatever they asked of him. Not because he wanted to be difficult. But because his body was shutting down. I could see how the EMTs might be annoyed by that.
But I would assume they were used to that sort of thing given their occupation.
Also, whatever issues the man had? It would seem to me to be impossible for it to be belligerence, violent tendencies, etc. That just doesn't happen when detoxing. You don't have the strength to fight. It's like the opposite of being drunk.
Again, I'll be very interested to hear more facts.

I don’t think this case will get very far. They will argue that the patient was thrashing and wild and needed to be restrained for safe transport. He didn’t follow commands or cooperate to lie on his back so they restrained him in the position he moved himself into. And it was only the two of them, not like in a hospital ER where there are more people around to help reposition someone who is out of control.
Now, whether they properly monitored him after that is another question, and is probably more negligence than murder.
