Academy begins 'formal review' into Will Smith-Chris Rock incident

Chris Rock declined to file a police report against Will Smith following "the slap seen around the world" at the Oscars Sunday night, but the newly minted King Richard Oscar winner could still face penalty from his peers at the Academy of Motion Picture Arts and Sciences as well as the actors union.

The Oscars' voting body revealed Monday that it was launching "a formal review" of the shocking moment that instantly left some 15 million viewers — and millions more on social media — aghast.

"The Academy condemns the actions of Mr. Smith at last night's show," a spokesperson for the organization said in a statement. "We have officially started a formal review around the incident and will explore further action and consequences in accordance with our Bylaws, Standards of Conduct and California law."

Smith was also chastised by his union. "SAG-AFTRA is focused on ensuring our members always work in a safe environment," the group said in a statement Monday. "Violence or physical abuse in the workplace is never appropriate and the union condemns any such conduct. The incident involving Will Smith and Chris Rock at last night’s Academy Awards was unacceptable. We have been in contact with the Academy of Motion Picture Arts and Sciences and ABC about this incident and will work to ensure this behavior is appropriately addressed. SAG-AFTRA does not comment on any pending member disciplinary process."

While presenting the Oscar for Best Documentary, Rock began roasting celebrity audience members including Denzel Washington, Javier Bardem and Penélope Cruz. Though Smith was initially seen laughing as Rock joked that Smith's wife, Jada Pinkett Smith, was making a sequel to Demi Moore's 1997 military drama G.I. Jane — Pinkett Smith has lost her hair due to a battle with the autoimmune disorder alopecia — the movie star quickly turned irate, approached the stage and slapped Rock.

Smith then returned to his front-row seat, where he twice yelled, "Keep my wife's name out your f***ing mouth!" at the stunned presenter.

The Academy and show producers have faced backlash over why Smith wasn't immediately removed from the ceremony and allowed to accept an Oscar moments later for Best Actor. While Smith have been defending his wife's honor, and Rock's jab may have been insensitive, the King Richard star assaulted another person on live television without any immediate repercussions. Many critics have suggested if it were anyone else in the audience (or at least anyone else not super-famous and/or only minutes from winning an Academy Award) who had approached Rock and physically engaged with him, there's little doubt security would've expelled the person.

However, according to Variety, high-ranking members of the Academy discussed ejecting Smith but ultimately decided not to. Smith's publicist huddled with Academy President David Rubin and CEO Dawn Hudson in a private room, according to The Hollywood Reporter. Whatever was discussed behind those closed doors may have led to Smith remaining. Perhaps a promise that Smith would apologize? We may never know. Smith, meanwhile, was seen conferring with Denzel Washington (whose counsel Smith later quoted while accepting his Oscar) and Tyler Perry in one corner of the venue.

“This was a real almost billion to one moment where the person involved in this incident was the probable winner for best actor,” explained ABC's Rob Mills to Variety. “So it’s just a scenario you don’t really know and you just got to keep the show going in the meantime and then obviously, AMPAS will address this afterwards, in the post mortem.”

A mere 15 minutes after the slap Smith was back on stage, where he delivered a tearful speech that included apologies to the Academy and to his fellow nominees, but not to Rock. "The devil comes for you at your highest moment," Smith said Washington told him.

Smith likely faces some type of penalty from the Academy, with speculation (unconfirmed at this point) the star could receive up to a year's suspension. If so, that would potentially mean Smith would be unable to present next year's Best Actress Oscar, as is customary from year to year. (There's no word yet on why last year's Best Actress winner, Frances McDormand, was not in attendance to announce Smith as the winner.)

However, there is little chance of the Academy stripping Smith of his Oscar, as some have postulated on social media.

"We're not going to take that Oscar from him," Academy Board of Governors member, Oscar winner and television host Whoopi Goldberg said on The View Monday. "There will be consequences I'm sure, but I don't think that's what they're going to do, particularly because Chris said, 'Listen, I'm not pressing any charges.'"

Whoopi's adamant stance today seemed to intimidate the other co-hosts and they appeared to be holding back on their negative opinions of Will. Sunny was the only one who spoke firmly against Will's action and even she appeared to be measured. Joy did say if Ketanji Jackson didn't lose control and slap anyone during the hearings then Will should have been able to control himself. Why does Whoopi have so much power on that show? It would be far better without her.

SAG-AFTRA has NOTHING to do with the Oscars who are the Academy of Motion Picture Arts and Sciences, the non-profit organization who owns and runs the awards. Plus, SAG makes rules for on set workplace safety, not award show safety, but who really ever believed it was needed?

I don’t support what he did at all, but I still feel sad for him. I would bet he has anger issues or maybe even substance abuse issues. The way he sobbed almost helplessly while accepting the award shook me up - that feeling of knowing you ruined your life in a way and have no one to blame but yourself. He put on a big front with his defenses and partying after the show, but from the way he cried - he knew he fucked up.

That being sad, I feel much sadder for Chris Rock. He stood there like a kid who’s been bullied - which he was. You can get as famous and rich as he is, but it doesn’t make you forget being the picked on one.

It's not just the Oscars, it's SAG of which both Chris and WIll are members of. They have a strict no violence policy and he could eb punished via the union as well. He apology was shit. Really R71? Because I can guarantee if a white man had done the exact same thing, we would NOT be having any discussion. He would have immediately been destroyed by everyone including the press and his career would be completely over. That’s not what’s happening here. If anything, it has been incredibly disturbing to watch the discourse over this situation and how slowly it’s unfolding when the reaction should have been immediate and swift. People are able to hold several different opinions at once. We can be empathetic to the pain and trauma Smith has clearly experienced to lead him to react like that while also wholeheartedly rejecting what he did as unacceptable and understanding that there must be consequences. I’ll also point out that Will would NEVER have done that to say, Amy Schumer, or another woman or a white man.

The conversation has been ALLLL about Will and Jada. What about the person he physically attacked on stage in front of millions of people worldwide? What about his trauma and pain? Of course he declined to press charges, he would have been destroyed by his own community if he did. That pressure should also be part of the conversation.

The discourse about how “he was protecting black women” (he was not) and how this is about hair (it is not) is incorrect. There are conversations to be had about those issues. This isn’t the place.

The responsibility for the slap lies with Will Smith alone. If Will Smith or Jada were unhappy with the remark they could have discussed it with him afterwards. You do not resort to assault on live television.

I'm a little surprised anyone is arguing that Smith's Oscar should be "taken back" or "rescinded," as that would NEVER, EVER happen, if only for the following reason: For the remainder of time, the fact would remain that the award had been voted to Smith, so it would always be a matter of record that he had rightfully won it. The award to whomever it would have gone to instead (Andrew Garfield?) would be tainted to the point of worthlessness, and I'm sure whoever did "get" the award instead would absolutely NOT want it under these circumstances.

All this talk of revoking the Oscar is ridiculous and not going to happen: he won it the same way Polanski won: for "achievement" in their fields, and that has nothing to do with therir behavior in real life. Their personal behavior as far as the award itself goes is immaterial, any more than the Academy would have demanded Jane Fonda's Oscar for "Klute" back because she sat in an enemy plane for a photo-op.

But any disciplinary measures regarding a disregard for the code of conduct of its members--including explusion, whether for life or a year, not letting him attend or participate in Academy Awards and functions, etc.--that's related directly to the assault he committed on the premisis of an Academy function, and the Academy should fucking act accordingly.
