Nicholas Sandmann reaches settlement with NBC in defamation suit

Nicholas Sandmann settled Friday with NBC-Universal, he said.

The media had lambasted the Covington Catholic High School student from Kentucky, now 19, over a confrontation at the 2019 March for Life in Washington, D.C.

“At this time I would like to release that NBC and I have reached a settlement,” wrote Sandmann on Twitter, adding that the terms were confidential.

Following the 2019 incident in Washington, D.C., many media outlets and Democratic politicians criticized Sandmann for a confrontation with a Native American elder at the Lincoln Memorial following the march.

Sandmann was recorded on video wearing one of former President Donald Trump’s “Make America Great Again” campaign hats while smiling at the activist, Nathan Phillips, as Phillips beat a ceremonial drum and chanted at him in close proximity.

Several media reports at the time claimed the incident was racially charged on the part of the White teenager, which Sandmann and other witnesses disputed.

People have judged Sandmann “based off one expression, which I wasn’t smirking, but people have assumed that’s what I have,” he said a 2019 interview with NBC News anchor Savannah Guthrie.

Nearby members of the Black Hebrew Israelites group were shouting slurs at him and his classmates, he added.

“I heard them call us incest kids, bigots, racists,” Sandmann said.

His filing against NBC-Universal and MSNBC reportedly asked for $275 million in damages.

CNN and the Washington Post both settled defamation lawsuits from Sandmann in 2020 for undisclosed amounts.

The suit against CNN sought damages for “emotional distress Nicholas and his family suffered” in the fallout of the network’s reporting.

Law school professor William Jacobson told Fox News at the time that CNN agreeing to settle is a “rare example of a ‘little guy’ being able to stand up to a media behemoth” and estimated the deal was worth at least seven figures.

In 2020, Sandmann attorney Todd McMurtry told Fox News that lawsuits against “as many as 13 other defendants will be filed,” including ABC, CBS, The Guardian, HuffPost, NPR, Slate, The Hill, and Gannett, which owns the Cincinnati Enquirer as well as other small outlets.

The media didn't spread misinformation about the incident.

What happened is that after the initial slew of reports about students making fun of Nathan Phillips at the protest, people discovered the Black Hebrew Israelites were involved and doing their usual free speech shtick of shouting slurs, and part of what Phillips had done was get in between the teens and the Israelites to cool things off. He said so when asked about the incident when the full video came out, and suddenly everyone's opinion shifted. They went from thinking he was a poor innocent Native elderly man being bullied to being mad at him for what they felt was "defending" the Black Hebrew Israelites.

Suddenly the narrative was that Phillips was a liar, the Israelites were the cause of the problem, these kids were innocent victims of crazy radical nutjobs.

No media org is going to go to trial and pay for a team of expensive attorneys, and where it would take weeks for a jury to review this footage and make a decision, so they're settling. This has added to the narrative of "the media lied and got it all wrong and Sandmann was an innocent victim and this is why you should never trust the media, because they have a LIEberal agenda."

The settlement amounts of $350 million are beyond absurd and letting people think you have been awarded huge sums of money is not a good thing. Media is neither right or left wing in the purest sense of the word. The outlets do lean conservative or liberal depending on the demographic but it's all profit driven and cynical. Clickbait, exaggeration and misinformation. Fox News and Forbes are terrible but CNN has stooped to their level. CNN never had a good reputation. Many would argue it was CNN that ruined journalism with the 24/7 news cycle and need to have constant noise and exaggerations of minor details to get views.

Here's the thing: with the recent tornado outbreak, the NY Post published a story where the girlfriend of one of the dead said the employees weren't allowed to leave the Amazon warehouse.

Later, another employee said some of her co-workers had actually left once there was a tornado warning, so clearly it wasn't true that employees couldn't leave.

The story changed and the media reported that as they got the info. The news always updates as more information is revealed. So why is this Sandmann situation so different? TONS of people said that Amazon is evil because they wouldn't let employees "evacuate during a tornado," so it's comparable to the Sandmann thing where people were saying "this is the kind of confrontational racist teen MAGAs are raising."

The Sandmann case is different only because rightwingers have been using it to push their "all mainstream media is biased against the truth" agenda.

Keep in mind that his attorney L Lin Wood said that WaPo made 33 libelous statements. The first lawsuit was dismissed completely, then the second one was allowed to continue ONLY on 3 of those 33 statements Wood submitted. Those three statements were that Sandmann impeded Phillips' way forward.

This came from Phillips himself. Some people say that the video proves he was lying but you honestly cannot tell in the video if it's true or not. It looks to me like Phillips is trying to move the teens back, but he's not particularly aggressive about it.

Anyway, with the WaPo lawsuit, I can't imagine Sandmann got millions upon millions for WaPo reporting that Phillips said he was blocked from moving forward by the teen. He got a settlement obviously, but I can't believe it was a huge one, especially since WaPo later corrected their story.

I know WaPo settled because it's cheaper and quicker but I'm angry that they didn't fight this. No one should be able to force a newspaper to pay a settlement just because it reported what someone who was involved in a newsworthy incident said.

The media should go back to checking the facts before they report things. This was only news because they wore MAGA hats. If they wore BLM hats it would have been non news. What would have been so newsworthy about a bunch of teens laughing as an Native American banged a drum? Oh right, nothing.

In California a gang of 6 black men were arrested for targeting older Asian women in over 70 robberies and attacks. Yet that is not national news. they were not MAGA types so we could have hours of reporting on hate crimes against Asians. Because the attackers were black we don’t get that. GMA won’t cover this at all but every police shooting (only of black victims) is given extensive coverage.

R24 He sued for damages/$250 million…so if he got 1% of that (arbitrary percent on my part) it’s $2.5 million…attorneys get 1/3 (33%) plus expenses (about 5%…could be more if one of his parents stopped working and they borrowed from law firm to keep household afloat)… so maybe he’ll keep $1.6 million. Some people think much less. He definitely had the equivalent of four years of college paid for, at the least.

Think in normal person/human terms for a second, and this applies mostly to Jordan and Gaetz but the Russia collusion narrative as well. If you accuse someone of child molestation and human trafficking and sleeping with minors, let's be clear that's not something you can just take back if it winds up not being true. If I ever made such an accusation, I'd have to have more than enough evidence because what I would never want to do is have to look someone in the face and apologize for something like that. I wouldn't be entitled to forgiveness for someone for using my platform to pump out a story like that.

Now if you have a suspicion and you report to the authorities, they can investigate and ultimately decide whether there's any evidence to support charging someone. That's their job.

And I don't care how you feel about Trump, they held that collusion narrative over his head for three years to invalidate his election. That's why I have to roll my eyes now with how precious some people are about "conspiracy theories" about the 2020 election being rigged. Oh now it's important to respect elections? Black Israelites hate other Black people especially those who are Christian and Muslim. I'm Black and they are an embarrassment and they are completely self-hating. They deny African Americans are primarily of West African descent even though it's so obvious in not just our phenotype but also our culture, music, cuisine and worship style. It's no different than the other Black militant groups that claim we're Ancient Egyptians or we're Native Americans which is disrespectful and taking other people's history. To these militant groups, being from West Africa is bad and they are accepting the racist narrative it was "primitive" despite the fact that region had so many beautiful cultures, languages, music and art and a long history of kingdoms and trading.

We should backtrack a little. Nicholas Sandmann was in Washington DC on an outing sponsored by his Catholic high school specifically to march against allowing women the right to control their own bodies. - a right which they might lose in the next 6 months. His high school is undoubtedly on board with not allowing gay people to serve on the faculty and in fact to roll back gay marriage and possibly even the repeal of sodomy laws, all possible outcomes of a Supreme Court which might reject the notion that the Constitution guarantees a person the right to privacy - something that all these decisions were based upon. The high school kids were very energized and vocal that day and definitely in an antagonistic mood towards the Black Israelites. The media only said that in their opinion (as in the opinion of millions of people who viewed the video) that this kid appeared confrontational and seemed to smirk as he refused to allow the Native American guy from proceeding. Let's talk about normal manners. If two people appear to be heading for a collision, BOTH should make an effort to avoid it, by moving out of the way - whether we're talking about cars, or people walking on the street. That video did not show normal manners. So the media were justified in drawing that conclusion. Sandmann CLAIMS that was not his intent. On the basis of that claim, do we really think he has been horribly maligned? I know I don't.

That school, Covington Catholic High School has a history of homophobia and discrimination. Questionable on the school to permit underage teens to attend an anti-abortion rally as a field trip. That's a very sensitive and heated subject and bound to cause a lot arguments and confrontations. Many of these private schools solely exist to indoctrinate children into far-right white Christian identity.

Sandmann isn't the only case that raised red flags about the impartiality of the media.

Take the Atlanta shootings. All sorts of "Stop Asian Hate" messaging of this, and profiles of the women who were shot, but only WaPo ran with the story that this particular place was whorehouses that used trafficked women who were kept under lock and key by fellow Asians, not just a bunch of physical therapist and that the police had made a number of prostitution arrests there over the years.

NYT never mentioned the sex work/happy endings aspect or the trafficking of illegals. [These places do both legit massage and happy endings]

But most people know what these "Asian massage parlors" are about so it was obvious they were choosing not to go there.

Absolutely untrue. People and corporations settle to get the matter out of the news and to save money. At no point has anyone who settled with Sandmann admitted to lying, and as said above, in the WaPo case, they reported what they were told by Phillips.

You may think Phillips lied when he said Sandmann blocked his way forward, but WaPo didn't lie when they reported what Phillips said.

But the issue is that they are impressionable and influenced by a negative and anti intellectual culture of right wingers. Being taken under the wings of Republicans and made into celebrities. They might mature and gain some wisdom and leave that behind. But the power and attention they are getting as young guys is addicting and they will just end up as egotistical pieces of shit. One of the early instances of the media's blatant mishandling of a story like this was with Richard Jewell, the security guard at the 1996 Atlanta Olympics who discovered a backpack with bombs and evacuated people in the area and notified the police.

I recall clearly seeing the subsequent coverage of his actions and I was shocked by the media's response. I kept thinking "But what if this guy is just what he appears and completely innocent of wrong doing" (Which, of course, he was.) . The media coverage of this man was horrifying and a message that this kind of media attack could happen to any of us.

The Sandmann case is another clear example where someone blatantly cherry picked part of a video to show and frame the narrative and the attacks began. The people who make these video selections know exactly what they are doing. "Ooooh!, look, cut it there! Focus on the expression on that kid's face! That's our story."

People who do this kind of thing (and the company knows who handled this) should be fired and banned from those occupations. They are dishonest and the results of their work is dishonest. And they should be liable personally for damages.

This kind of shit can happen to anyone who is "chosen" to be a likely target.

Don't kid yourself.

I have no problem with the Right being wrong. They are wrong 99% of the time. It is the Left that worries me. You would be surprised by how many people in the public eye get death threats, phone calls to the places of employment, etc when the media sets their sights on them. That’s one of the reasons why even now the media won’t say who the “whistleblower” is who reported Trump’s conversation with President Zelensky. Because they know all kinds of dirt would come out about him.

And by the way, I really think the catalyst for all of this is him wearing a MAGA hat. I don’t think is that bad — I think a lot of people simply got too comfortable with cancel culture and the Woke left running things and these LA/NY/DC sensibilities telling everyone what to think, that when the people picked the guy who rebelled against it, they reacted viciously.

r130 What you are describing is a right-wing pattern, not a left-wing pattern. Thousands of school boards and city councils have been receiving death threats this year from right-wing people over mask mandates and COVID restrictions. There is no evidence that the left wing bombarded Sandmann with death threats. He didn't make that claim in his lawsuits. His claim is that the articles defamed him by calling him racist and contemptuous of Phillips (the native american). It IS true that the left wing looked for additional evidence that the Covington high school was teaching or authorizing racism, to try to make sense of that chaotic scene. The more extended videos that were ultimately released show a scene of mass confusion, and it was very hard to make clear cut decisions about why, for instance, the Covington students greeted the guy with the drum with tomahawk gestures. What changed was that what initially seemed clear cut became more ambiguous - NOT that the extended video EXONERATED Sandmann, but that with more information it became harder to paint the scene in black and white. Sandmann's own comments were not consistent. In one interview, he claimed that he stood right in Phillip's face to show him he was not going to be pushed around. In another, he said he was smiling to show that he was not antagonistic. Two different explanations from the same person.

People on Twitter back when this occurred did call for his death. It was unhinged and woke me up to the fact that extremists really do exist on both sides. One was a trending author/professor who said he hoped the kid was put through a wood chipper.

To the credit of the world that professor seems to have lost his fame in the press. He's not condemned but is so longer lauded.

R133 link doesn't describe a death threat. It describes someone wishing some people would die - someone, who, by the way, suffered instant repercussions. He didn't say that he was going to go to their town and kill them. . . A death threat is something that says, "I'm going to be waiting at your house when you get home from work with a shot gun". . Or, "I'll be watching you when you leave the store - I'll have my knife with me", or, "I'll find a way to get back at you for what you did". The other link is behind a paywall, but I'm guessing it's more of what we saw in the first link.
