Biden DOJ signals it will defend law that allows discrimination in schools
The Justice Department said in a court filing Tuesday that it will continue to defend a federal law that allows religious schools to discriminate against LGBTQ students.
The filing came in a federal lawsuit in Oregon from students at religious schools who are suing the government for providing funding to schools with discriminatory policies.
The move seems to conflict with the Biden administration's March memo from the DOJ's Civil Rights Division pledging that "[a]ll persons should receive equal treatment under the law, no matter their gender identity or sexual orientation," but it also aligns with the DOJ's duty to defend federal laws.

It’s my understanding the case is being adjudicated as a statutory issue, and not a Constitutional one, so the DoJ would be required to defend the existing law that includes the religious exemption.

Biggest news from SCOTUS today is that Kagan just wrote an opinion in a case that was argued in November.
The Obamacare case and the LGBT discrimination case were also argued in November. This most likely means that Roberts has Obamacare and Alito has LGBT rights.
