If r79’s story is true, then I guess the only thing they have him for is drinking in a federal park, which I believe was illegal. I read that in another linked article. But yeah, arresting someone for a bac level under the legal limit doesn’t make sense. Even if the cops saw him take a shot while sitting on his motorcycle, as soon as the field sobriety test was performed and passed, cops should’ve let him go with a warning not to drink while operating a vehicle.
I’m glad he was cooperative, though. I’d hate for him to be someone who goes with the , “do you know who I am?” retort a la Reese Witherspoon.

FSTs don’t return BAC. FSTs are paces you are put through to see if you exhibit any signs of intoxication. You can fail those and be perfectly sober, but if you’re exhibiting the telltale signs, they have probable cause to arrest you and get your BAC. The BAC is not done in the field.
Once the BAC number returns, usually if you’re under the limit, you are released with no further charges.
It’s not as though the cops in the field would know his BAC would return that low, though whomever conducted the FSTs should’ve recognized his level of intoxication was minor, if any.

1. Yes, he’s been an ally for a long time, even before he wrote ‘Streets of Philadelphia.” Terry in “Backstreets” is clearly a guy. Bruce was one of the first straight celebrities featured on the cover of the Advocate in the 1990s.
2. The Julianne-Patti thing is covered in his bio and he admits he was a bad husband to Julianne due to his chronic depression, undiagnosed at the time. Julianne was young, and he married her because he saw her in a magazine and thought she was beautiful. Not a great reason to marry someone, but he was admittedly immature and full of himself. Patti sang back-up on the divorce album (Tunnel of Love) and they fell in love.
3. In his Broadway show, he opens by calling himself a fraud and jokingly mocking himself for never having set foot in a factory. It’s funny, and meant to be, but as the show goes on, you realize (and it’s beautiful and heartbreaking) that all this time he’s been telling his father’s story. He isn’t pretending to be poor. He was poor, and his father was a mentally ill, abusive alcoholic who spent most of his time sitting in angry silence. Bruce is telling the stories he imagines his father would’ve told.
4. Bruce’s son is a firefighter. Cops don’t like Bruce because of the song “41 Shots (American Skin)”, a true story about a black guy who went for his wallet and was shot 41 times by cops who thought he was reaching for a gun. At concerts, the cops who do attend turn their backs during this song.
5. The Jeep commercial pissed off fans (because Bruce “sold out”) and both liberals and conservatives (because it was about meeting in the middle, and no one wants to do that. ) I am sure that the DWnotI back in November was reported now because a deplorable got pissed off.

Not necessarily. It can be a number of factors that determine whether to proceed to formal charges or not. There's rising blood alcohol concentration and there's falling blood alcohol concentration. They cut both ways to establish what an expert will "determine" the bac level was when the driving actually took place. So even if it can be determined that the level was below the limit if there is other evidence of driving under the influence (such as FST results or other evidence) you can get cinvicted of DUI. The legal BAC limits are legal presumptions you are DUI or DWI.
The crime scene (roadside) "breathalyzer" is used for probable cause sometimes along with the field sobriety tests. Some -probably most - states don't allow the initial roadside breathalyzer in as evidence at trial and a confirmatory chemical test needs to be done at the station or a proper medical setting if requested. But it needs to be done within a specified time period - like within 3 hours of the traffic stop.
We had a huge scandal in my jurisdiction years back when it was discovered - via hard work by defense attorneys to uncover this - that the cops had altered the breathalyzers to make them easier to read and thousands of pending cases and prior convictins were either dismissed or reversed. Good times.
