Unless they've got something else on him normally improperly calling in sick would result in probably being written up, loss of a bit of pay and other or other sanctions. But this is unforgivable; Will Pepe is going down and union won't likely be able to save his job, less so if Andrew Cuomo and or other NY elected officials put screws to MTA. Senator Chuck Schumer who just came through with over four billion recently in stimulus funds for MTA likely isn't happy about this bit of news.....

There's going to be a lot of this happening I've heard that the FBI is checking wireless companies to find out which cell phone numbers were in DC and what locations the numbers were at and for how long.

The Transit union in the NYC area is very powerful I doubt he will get fired, fined and may lose a few days pay perhaps.

According to local NYC news media Will Pepe worked for Metro-North and was assigned to a yard in Putnam. Metro-North is a different union than New York City Transit who are Transport Workers Union (TWA).

Metro North deals with a bunch of unions representing various workers; Teamsters Local 808, Association of Commuter Rail Employees are two.

Metro North is also different from New York City Transit in that Metro North RR is just that , a railroad whose commuter services were pieced together from bits of former Penn-Central & New Heaven railroads (maybe a few more) when private railroads went bankrupt. Key difference is that Metro-North workers as a legacy of being part of private railroads are covered by the federal Railway Labor Act. This means among many things that they can go on strike, but are subject to actions by Washington D.C., not New York State.

On the other hand NYCT workers are state employees and are covered by the Taylos Act which forbids them going on strike, and if they do so calls for severe financial and other penalties including jail time.

Long story short highly doubt if the union representing Will Pepe is going to spend much capital helping to keep his job. The optics are just horrible and there is sure to be push back from governor and other NY elected officials if the guy is seen as getting off lightly.

Abuse of a sick day is one thing; doing so to commit offenses and or crimes is another matter entirely.

It doesn't matter, the commuter railroads that were once part of Penn Central or other private railroads have separate union representation than NYCT workers. This includes Staten Island Rapid Transit train line which once was part of B&0 railroad.

New York City Transit only became part of MTA because city (after beating down the private owners of subway, elevated trains and bus lines) couldn't afford to run much less maintain the system either. Then came city's economic woes of 1970's and there was nothing left but to allow a NYS public authority (MTA) who had keep enough pockets to pour much needed money into NYC's transit infrastructure including bridges and tunnels.

There is also fact that Metro-North operates interstate rail service (between NYS and Conn), which New York City Transit does not.

Losing his job is the least of his problems now--he will be going to prison when convicted on Federal charges, regardless of what his employer does or doesn't do to sanction him.

When released, he'll be a felon. And nobody is going to hire him for anything.

The MTA employee who was seen participating in the violent breach of the U.S. Capitol last week was arrested by the FBI on Tuesday, according to federal authorities.

Will Pepe, 31, of Beacon, New York, was taken into custody Tuesday and will make an appearance on an initial complaint Wednesday in federal court in White Plains, said a spokesman for the United States Attorney for the Southern District of New York.

Pepe worked at a Metro-North rail yard in Brewster and "called out sick Wednesday to attend the event," according to the NY Post.

The FBI did not return a call on Tuesday for comment on the charges Pepe faces, and the US Attorney's office in the Southern District did not have the complaint because the US Attorney's office in Washington DC is handling the case.
