Am I wrong in assuming the arbitration must be for civil suits related to the situation?
Because I don't think there's any legal way that actual criminal cases would go to private arbitration. I've also just looked at a few articled about this and a couple specifically refer to a "lawsuit" which was filed against Masterson. That makes me think this is referring to civil action not criminal.
It's bad article writing as far as I'm concerned. They probably assume anyone who cares is up on the specifics but I'm sure not. Oh well.

This is what it must be. These are civil suits. Many civil suits for various reasons legally have to try to be settled through arbitration, mediation or a settlement conference before there can be a trial. Very few civil cases go to trial. The arbitrator or mediator will NOT be a scientologist. The parties together or the judge pick a neutral person.

Actually, that account is very mild, r30. Tony Ortega's been doing excellent play by play reporting from the courtroom. The first woman who testified gave a harrowing account about an ordeal that lasted hours.
The good news is he's being indicted on June 7 and Co$ came out of the prelim hearings with a big black eye.

They're not deciding law in this case r53. The arbitration is in the civil suit, not the criminal case.
The people suing Masterson signed a binding contractual agreement with the Scienos saying that any civil suit they brought up would go into Scientology arbitration. This arbitration wouldn't be happening had they simply not signed that contract.
If they were coerced into signing I wouldn't be surprised but we won't find out about that until later, if ever.

The California Supreme Court has granted the petition for review submitted by Danny Masterson’s accusers after their lawsuit was derailed by a decision by Los Angeles Superior Court Judge Steven Kleifield.
In a unanimous ruling, the state supreme court is asking Kleifield to show cause for why he made the decision he did, granting the Church of Scientology’s motion denying Masterson’s accusers (those who were former Scientologists) of a right to trial and forcing them into the church’s internal “religious arbitration.”
Wow, this is huge. These former Scientologists are going to get the appeal they’ve been asking for without first having to go through Scientology’s internal star chamber.
