Naya Rivera's family sues over death in brackish waters

A wrongful death lawsuit was filed today in Ventura County Court on behalf of the four-year-old son of drowning victim Naya Rivera, claiming the county failed to adequately warn swimmers of the dangers at Lake Piru.

The suit comes four months after the July 8 death of the Glee actress, who was swimming in Ventura County’s Lake Piru with her son, Josey, when the incident occurred. The boy was able to climb back onto the rented boat.

The suit, which also names as defendants United Water Conservation District as well as Parks and Recreation Management (PMC), was filed by Josey’s father Ryan Dorsey, along with Naya Rivera’s estate and business manager.

“At the Lake Piru Recreation Area boating dock, Naya rented a pontoon boat from PMC – a boat that, it turned out, was not equipped with a safely accessible ladder, adequate rope, an anchor, a radio, or any security mechanisms to prevent swimmers from being separated from their boats,” the suit alleges. “Disturbingly, later inspection revealed that the boat was not even equipped with any flotation or lifesaving devices, in direct violation of California law…”

According to the suit, no signs were posted anywhere near the popular Diablo Cove swimming area “warning of the lake’s strong currents, low visibility, high winds, changing water depths, underwater caves, ledges, and drop offs, or the trees, brush, and other debris that congest its waters due to vastly changing water levels and winds.”

The suit says that at least 26 other people, “from children to fit adults to elders,” have drowned in Lake Piru since its recreational facilities opened.

The suit also provides a horrific account of the actress’ final moments. “While Naya and Josey were swimming, the boat started to be carried away – likely by the current and wind, which gusted up to 21 miles per hour that afternoon. Josey, who was closer, managed to get back on the boat on his own volition and braced himself on the boat, which was rocking back and forth forcefully in the current and wind. Josey knew Naya was still in the water, and heard her cry, ‘Help! Help!’ in her struggle to get back to the boat and avoid drowning.

“Josey searched in vain for rope to help his mother get back on the boat. Josey then looked back at the water for his mother, and saw that Naya had disappeared. Josey yelled for help and cried alone in the boat until he was found more than an hour later by a PMC boat leasing agent.”

Naya had been going to the lake for most of her life. It was one of her favorite places. I'd assume they can argue she knew the dangers.

The boat didn't have an anchor? I.think there are at least 800,000 internet comments asking why she didn't drop the anchor before she went in the water.

You can have someone sign a waiver, but you still have responsibilities.

I don't think sending boats out without safety equipment is going to be overlooked here.

But I'm also not a lawyer and I am a little stoned.

It seems par for the course in America that if someone slightly famous dies in an accident, a lawsuit will be brought. By all accounts NR knew the lake well and hard to believe signs would have made any difference to her decision-making, but it’s the sort of technicality lawyers love. The lack of anchor is potentially more interesting. I suspect for life jackets they are obliged to offer them, but not insist on them for adults.

Rivera had apparently been drinking, and even a small amount of alcohol makes a massive difference in water. The boat company’s insurers’ lawyers will fight this and the family won’t want to publicly get into how much she was boozing alone with the kid, so as with most of these cases, you’d expect it to settle out of court.

If this is true, they're right to file a lawsuit. No ladder doesn't even make sense, they would have had to have removed it on purpose, or it was broken off at some point and they deliberately didn't replace it.

This is really gonna be a kick in the pants to all those frauen who were obsessed with blaming Rivera for being 100% responsible in every way. The theories were basically that she was too stupid or too full of drugs (because she's a whore) to know how to operate a pontoon safely, that's why she didn't drop anchor, or just climb up the ladder, etc. etc.

R23 I agree that it sounds odd that the 4 year old, who wasn’t able to remember many details during the initial investigation is some how suddenly able to recall this situation, including recalling looking for a rope.

With that in mind, it does seem odd that the boat lacked all those safety requirements.

Methinks the family hired one of those hack psychic psychologists who used to specialize in crazy shit like past life regression. The toddler suddenly remembered details, ones that he couldn’t recall while being interviewed by police and social worker. Alcohol in the system is a contributory factor, that can be argued in court if they do go to trial.

Her autopsy indicates she had ingested 2 different types of amphetamine, some valium, some alcohol, and diet medication before her day boating with her 4 year old. But somehow California will be giving her ex money because California hadn't posted enough signs??

Check out the verbiage in the lawsuit as apparantly Naya was both a cultural and LGBTQ "icon." Who knew.

The results said that she didn't have drugs or alcohol in her system above the legal limit. There were trace amounts. However, wasn't her body in the water for days? How accurate would the readings be?
