Ghislaine Maxwell Loses Fight To Keep ‘Intimate’ Deposition Secret
Ghislaine Maxwell lost her appeal to keep court documents connected to Jeffrey Epstein secret Monday, after a federal court decided that the public’s right to access the documents outweighs Maxwell’s personal interests, dealing a blow to her ongoing criminal case but delivering a win to federal prosecutors seeking to prove she lied under oath in a 2016 deposition.
In their decision, the Second Circuit wrote that the Southern District of New York “did not abuse its discretion in rejecting Maxwell’s meritless arguments that her interests superseded the presumption of access” when the documents were originally ordered to be unsealed in July.
Maxwell was trying to keep a 2016 deposition secret, because the document reportedly contains “intimate” information about her sex life, among other personal matters.
Federal prosecutors in her criminal case believe Maxwell perjured herself in that deposition, and Monday’s ruling means the document will be made public.
The deposition is from a settled defamation case between Maxwell and alleged Epstein victim Virginia Giuffre.
Lawyers for both sides—including legendary attorney David Boies representing Giuffre—argued before the Second Circuit on October 13 as to whether the deposition should remain sealed.
Adam Mueller, representing Maxwell, said that the deposition was under a protective order from the settled lawsuit and that if it was revealed, it would harm her right to a fair jury trial, while Boies said the public deserved to have the full document.

Are you simple, R8? That was just the line she used to justify her fight to keep it sealed. Do you really think she'd admit to the court that she needs to keep it sealed because there's incriminating details in there that will hurt her defense in this case?
She's grasping at straws. And doubtless she's been promised that if she keeps her mouth shut about other people she's in a position to implicate, she'll get her reward. Making the deposition public could wreck that deal for her.

Which is exactly the advice any decent attorney would give their client prior to a deposition, whether guilty or innocent.
Once you say "I don't remember" there is no where else for the questioner to go. If they repeat the question, your attorney will simply pop in with "Asked and answered".
If you give any other answer, it allows for a deeper line of questioning that can go in any direction, including directions for which you are unprepared.

There’s no Brady rule for a civil deposition.
If you’re asked if you’ve ever met someone and you say “I don’t remember,” even though you did meet that person, they could produce a photograph of you with that person to “refresh your recollection.” Opposing counsel would’ve had no right to the photograph beforehand.

Bill is actually mentioned, unredacted. But since this is about the Virginia Giuffre accusations, it was just in the context of her claims of seeing him on the island. I guess his name could have been redacted elsewhere in the deposition though, like maybe if it's something that implicates him directly.

Ok I found the index at the end of the document, where even the redactions are alphabetical. I'm pretty sure one is for Clinton. I looked at a few pages but didn't see anything incriminating yet, just asking about him flying on the plane etc. Sometimes the name is redacted and sometimes it isn't. Again though Giuffre claimed to see him there (though she didn't accuse him of anything beyond that), so I guess they would ask about him as a result of these claims. Seemingly no mention of Trump, but maybe another accuser will come forward...

Slate shows you how to crack the redactions...
[quote]It turns out, though, that those redactions are possible to crack. That’s because the deposition—which you can read in full here—includes a complete alphabetized index of the redacted and unredacted words that appear in the document. For example, after cracking the redactions, we know that Maxwell was asked about an email that Dershowitz allegedly sent to Epstein. In that email, Dershowitz reportedly wrote that he was “working on several possible articles about unfairness in the legal process that allows false charges to be inserted into legal documents.”
[quote]Here’s how to deduce the redacted words, using former President Bill Clinton as an example.
[quote]You can see in the index that a word that falls alphabetically between clients and clock appears on quite a number of pages. From this, we know that the word starts with the letters CL.

NYT does a rundown on the Jizz dep...
[quote]Over and over again in the 418-page deposition, Ms. Maxwell, 58, rejected accusations of wrongdoing. She denied that she had recruited minors to give Mr. Epstein sexual massages. She denied that she knew he was abusing girls and young women. She denied having engaged in sexual acts herself with underage people. “I can’t think of anything I have done that is illegal,” she said.
[quote]At one point, Ms. Maxwell was asked more than a dozen times if she believed that Mr. Epstein had abused any minors — and each time she failed to answer. At another point, she parried inquiries about a laundry basket of sex toys, telling the lawyer asking questions, “I need you to define a sex toy.”
[quote]Eventually, Ms. Maxwell became so frustrated that she suddenly erupted into a “physical outburst” and knocked the court reporter’s computer off the conference room table, according to a separate document released with her deposition. She later apologized for her behavior, the deposition said.
