I see the thread discussing Meghan's legal case has been deleted. Does anyone else habour suspicions that whilst discussing the sex lives, characters, relationships, clothes of all other celebrities is fine, discussions of a legal case that is being openly discussed on the MSM (Vanity Fair, Telegraph, TIMES, SUN, MIRROR, and, of course, the DM itself, etc.) is off limits here at DL?
Who or what are they afraid of?
Well, we can continue here.
Meghan has submitted an application for, variously, Summary Judgement and/or a delay to the start of trial, and is also allegedly appealing the court's former ruling that MoS may use "Finding Freedom" as part of its defence on the basis of "similar fact in evidence".
Summary Judgement is usually requested when the applicant feels its case is so strong that the outcome is a foregone conclusion and a trial is therefore a waste of the taxpayers' money and the court's time. Meghan's team has asserted that they believe they have "an overwhelmingly strong case" and the defendant has no shot at winning, and that is their argument for Summary Judgement.
In fact, it's a Hail Mary Pass as no one, after seeing that FF is going to be allowed as part of the MoS's defence, thinks the case is a slam dunk for Meghan. It's a desperate measure and her solicitors probably also need to show that they tried to do everything they could to, as the TIMES put it, escape being put into the witness box and cross-examined under oath.
The appeal of the court's ruling on the MoS is also a Hail Mary pass, as Americans put it. Appeal courts are loathe to overturn lower courts' rulings without a very good reason.
The delay is also transparently desperation. Meghan's team will have had three months to prepare a response to the Amended Defence.
The only other reason for Summary Judgement is that negotiations have occurred between the parties resolving major issues that would be brought out at trial.
This was supposed to be another CCMC hearing (Costs and Management) at which dates would be determined for exchange of requested documents sought by either side, in this case, mostly the defendant.
The hearing is ongoing today, but I believe only the delay will be decided on by Mr Justicy Warby today.
