It varies from country to country and state to state. California has First-degree murder, Second-degree murder, Capital murder, Voluntary and Involuntary manslaughter, and Vehicular manslaughter on the books. First-degree is "willful, deliberate, and premeditated." Second-degree is "willful, but not deliberate or premeditated." Capital murder is murder for financial gain, to prevent a witness from testifying, muder of a public servant, a hate crime, or to benefit a street gang. The health penalty applies. Voluntary manslaughter is willful and deliberate, but not premeditated. Involuntary manslaughter is killing a person without malice or intent to kill, but done with the conscious disregard for human life. Vehicular manslaughter can be a felony or a misdemeanor, depending on the circumstance.
