Judge Gorton doesn't have to accept the plea deal. He, and not Lori, Massimo, Lori's lawyers, Massimo's lawyers, or the US Attorney has the final say as to their sentences.
What she pled to has zero bearing on the judge. And Judge Nathaniel Gorton, 81, is hardcore:
"The Transactional Records Access Clearinghouse (TRAC) is a data gathering, data research and data distribution organization at Syracuse University. TRAC was established in 1989 as a research center jointly sponsored by the S.I. Newhouse School of Public Communications and the Martin J. Whitman School of Management at Syracuse University. Through Freedom of Information Requests and great research, TRAC provides a lot of detail about how our justice system operations, one of those areas of research is how federal judges sentence compared to other judges. So I pulled the report on Judge Gorton ... and based on the report it looks like he is tougher on sentencing than other judges (Note: all cases are unique and comparison of judges' has limited value ... but it is certainly good information to know.) According to TRAC as it relates to Judge Gorton:
[italic]For all cases disposed of in the 12 month period ending in December 2017 that were credited to Judge Nathaniel M. Gorton in the District of Massachusetts, the average prison sentence was 60.6 months. During the 12-month span covered here, Judge Nathaniel M. Gorton has sentenced 8 defendants compared with 21 defendants during the previous 12 month period. The Federal Sentencing Guidelines were meant to reduce the disparities in prison sentences across the nation, but it appears that there are dramatic differences, even within district courts.[/italic]
TRAC additionally noted on Judge Gorton:
[italic]During the last five years there were 13 other judges in the District of Massachusetts with information on convictions during that period. Average prison sentence numbers passed down for those judges ranged from 29.2 months to 57.1 months, putting Judge Gorton's average prison sentence of 53.7 months at the higher end of the range. The average prison sentence for the whole District of Massachusetts during that time was 43.6 months.[/italic]"

USC is a private so it was felt that it was easier to pull strings to get in. They also started enrolling a lot of Chinese nationals because of the tuition hikes for international students. Academically, the reputation has very much picked up, so not exactly on the level with UCLA, they're now competitive.
