Simon was having the kids whether Matt was around or not but Matt loved him and them and did. As R102 said, he also once said, "it wasn't his story to tell" because it doesn't really involve him. He joined them.

He also revealed that they have a "co-parent adoption" agreement in a couple of interviews before and even once on instagram which is common for same sex couples when only one is the biological parent. That's what he means in this context when he says "co-parent."

It gives him the same legal rights as Simon without Simon having to terminate parental rights.

You will not marry a man who has 3 children if you barely know him, Halls would not involve someone in his life or that of his children unless you know that person. A very interesting story, I imagine the people around Matt surprised that he began this adventure of being a father when he was relatively young and starting a career as an actor.
