BREAKING Trump Admin Asks Supreme Court to Legalize Firing People For Being Gay
In the brief they just filed, they argue the Civil Rights Act cannot include sexual orientation.
There is no federal law explicitly banning employers from firing LGBT employees, but several gay plaintifs have sucessfully invoked the Civil Rights Act's ban on gender discrimination in lower court cases. The Supreme Court has never ruled on this issue.
If the Trump Admin is sucessful, the ruling will likely give other instutions like schools and public pools the ability to fire or ban LGBT people.

R14 The legal left did not want to have this fight at all because they weren't sure they would win. And once the supreme court rules, it will be very hard to overturn whatever they decide for decades.
The Obama admin labor department DID take the position that Title VII included sexual orientation. And they did ban all federal contractors from firing on the basis of sexual orientation, which is something they can do unilaterally. But they never took the issue to court, again because the might have lost.
The right actually largely felt the same way, which is how we've made it all these years with the supreme court never once hearing one of these cases, neither side wanted to risk losing and setting precedent.
But Trump is forcing the issue now. One way or the other, we will have an answer next summer. No one really knows how Kavanaugh or Roberts will vote on this.

I'm not sure where you got that but it isn't true. The Trump brief argues that Title VII doesn't include sexual orientation at all. They would give anyone the right to fire gay employees. He isn't requesting a special carve out in Title VII for religious employers, which I agree would be smaller thing, even though it's still wrong. But no, this is the broadest possible way to allow gay discrimination, the supreme court ruling being gay isn't covered under the Civil Rights Act at all.
In fact, Title VII isn't even just about employment. That same piece of the Civil Rights Act is what makes it illegal for schools to blanket reject all black applicants for just one example. If it becomes set in stone that Title VII doesn't include sexual orientation, we can conceivably be banned from anywhere. We would have no legal rights protecting us from it because legally nothing that happened to gay people could count as discrimination

I'm not trying to downplay this, its worth freaking out about.
But this will affect the federal civil rights act. Many states still have their own state level Civil Rights Act that bans discrimantion of LGBT people. I know my state of CT does. So some of us will be safe. Still I feel awful for the gays who live in flyover.

The truth is that gays never had an assurance that the law would protect their rights, and at the cusp of what looked like a turn around the Trans brigade rose to power and shut down many possible opportunities in which gay rights could have been protected. PA was not the only case where gay rights laws never made it because of the bathroom inclusion which many "allies" forced on those gay rights bills.
We said it back then, gay rights would collapse because the Trans brigade was selfish and on top of it harmful to gay rights.

r52, you are deliberately lying about history here. The first time that trans bathroom bills came into national consciousness was in 2015-2016, in North Carolina. A girl won a court ruling in 2013 to use a bathroom of her choice, but that case barely made the local news, never mind the national news. THAT'S it. This situation was completely off the public radar in 2008-2014. The failure to get gay employment rights then was the inability to get the full number of votes needed in the house and senate. Once again, we can thank our Republican congresspeople for that. It was in the Republican national platform for years that sexual relations between same sex people should be illegal and criminalized , and that same sex marriage should be illegal. Don't try to change history to make this the fault of trans people, asswipe.
Yes, people are generally slightly more squeamish about trans people in 2019 than they are about gay people in 2019, but this would not have been the case 15 or 25 years ago, when numerous polls showed that people held generally unfavorable attitudes about gays and lesbians. There has been a VERY gradual increase in tolerance for gay people since then. The real question is whether the conservative fuckers that Trump illegally got into the Supreme Court because of his illegitimate Russian-aided election will decide to be human beings with consciences or to act as the agents of Satan.

Some lower courts have already opened this pandora's box so anything the Trumpettes do regarding civil rights laws is going to be neutered by a more liberal court soon on religious freedom grounds.
