[quote] If the charges are considered sever it won’t matter if this is his first offense
Of course it matters.
[quote] He will have to plead guilty to get probation.
No he won't.
This is what I found about the traffic and other offenses from his past
[quote] one that concerns giving false information to police when he was pulled over on suspicion of driving under the influence. According to records, he was also charged with false impersonation and driving without a license. He later pleaded no contest to a reduced charge and took an alcohol education and treatment program.
I don't know how Illinois works in sentencing. But for federal offenses and for my jurisdiction it will depend on what he actually pled guilty to and if that is still on his record.
If it wasn't DUI then it won't get scored as part of his criminal history. Driving without a license won't get scored and I doubt false impersonation would either and if it did it would be maybe .25 points. If whatever reduced charge he pled to was part of a "probation before judgment" sentence, i.e., the plea gets withdrawn once the "sentence" of education/program is completed, that doesn't count at all. It also may have been too far back to count.
Si it is possible he may have no criminal history
by Anonymous | reply 83 | March 10, 2019 3:09 AM |
Well, R83, he has certainly made up for lost time.
by Anonymous | reply 84 | March 10, 2019 5:11 AM |
He won’t plead guilty to anything here, because he is too delusional and egotistical. He thinks he’s innocent and a victim.
He’ll go to trial, be found guilty, and the judge will impose a stiff sentence.
They don’t give probation to people who go to trial and are convicted.
by Anonymous | reply 85 | March 10, 2019 8:12 AM |
He is making the calculation to NEVER plead guilty to anything as it would upend his career forever. If he gets convicted he can play the matyr forever and get jobs in black tv and film.
by Anonymous | reply 86 | March 10, 2019 11:03 AM |
Yeah, something wrong in his head-- he will do exactly that R86 and just continue to deny deny deny. The reality is though some people will never work with him. I wouldn't be shocked if he had some sort of mental breakdown because he can think he is so smart to get away/deny this, but that behavior will rot at his brain forever...
by Anonymous | reply 87 | March 10, 2019 1:26 PM |

I don't think he is going to be shunned. I think there are more people who are thinking like Queen Latifah. I'm already reading that many think 16 counts is too much, it's a conspiracy against a successful black man, blah, blah, blah. Jussie with the right team can turn this around and play the victim.
by Anonymous | reply 91 | March 10, 2019 7:55 PM |

The crisis management company he hired (I think he's on his second one, already) has been posting bullshit on the other Jussie thread. Lovely. He doesn't make a crazy amount of money from the show, and now he's not making any money off of it if they did indeed pull him
I can't fucking wait for the letter part of the charges to come down. God, that will be SO sweet. I think r53 is right though, re: timing.

Of course they do. Unless they have shitty lawyers. I'm not saying some judges don't impose a "trial tax" but they aren't supposed to. It is helpful to show remorse at sentencing though not necessary because defendants who want to appeal their conviction can't be confessing at a sentencing.

Jussie must realize there are no mani/pedis in the pokey. He will not have a chef cooking for him or 1000 thread count sheets. He will have to present hole to the Bloods, Crips and such. The Latins or Aryans won't touch that stankhole. He will be concerned about all the money he is hemorrhaging and be a nervous wreck. Kamala Harris and Cory Booker will have lost their bids for President by then and he won't be all that popular in the black community after he made them look like naïve fools. Gerragos will enrich himself and say a few nice words about Jussie for the next few years but will privately tell people what an arrogant and stupid. Jussie will not plead guilty to anything, because he’s stupid and delusional. He’ll go to trial, get convicted, and then go to prison.
As stated earlier, probation is for those who plead guilty. Those who go to trial and waste the court’s time... get prison if they are convicted.
by Anonymous | reply 122 | March 12, 2019 11:47 AM |
But Jussie won't be convicted of anything but lying to the police. You don't go to prison for that. They don't have him for the letter because the brothers cut and pasted , composed and mailed the letter. And they lied to the police too. They also took part in the staged attack. No one is going to prison. No one was hurt and they can't prove much without the testimony of Jussie's equally guilty accomplices. The telephone records and camera footage also implicate the brothers as much as Jussie. Jussie's will do nothing more than community service and or probation. And you certainly can get outcome that without pleading guilty. He can only be found guilty of some pretty minor charges, if any.
by Anonymous | reply 123 | March 12, 2019 12:02 PM |
[quote]But Jussie won't be convicted of anything but lying to the police. You don't go to prison for that.
Uh, yes you do. Specifically when you file a false report to them.
Jussie’s accomplices are not equally complicit at all. They didn’t file a false police report. They were paid to stage a hate crime. As despicable as that is, it is not a crime. Jussie filed a false police report and then doubled- and tripled-down on GMA, with the media and with his lawyer.

Sure, it's a little dramatic sounding but, in a way, he was doing the same shit Manson tried to do decades before. "White MAGA men attacked me and put a noose around my neck and tried to bleach me." Can't get more specific than that in terms of intent. Fuck him.

It bothers some here when I speak the truth. He won't go to prison. And he wasn't trying to start a race wore, though what he did was despicable. I am a black man who does not support Smollett, but he has lots of outs. As many who are saved, many more drown in the system. No one here seems to care about the unfairly charged, prosecuted and imprisoned men and women in the grossly racist USA. Jussie is a special boy who thinks he's special. And oddly enough, he is. They haven't much of a case against him regarding any serious charges. Geragos can spin much of it into an indictment of the CPD - who have played right into it by over charging Jussie and giving immunity to his accomplice/thugs. Sketchy thugs will thug, but Jessie is a golden yellow bone boy. He's not going to prison. Ever.

The police did not “overcharge” him. The Grand Jury indicted him. The police merely arrested him.

A corrupt and racist PD does require some assistance from prosecutors to be successful. But falsified evidence, forced confessions and the shifting clarity of police reporting is the basis of all unfair indictments. That's why no ONE should ever speak to the police without counsel. The brothers had a very good lawyer it would seem. She not only saved them from charges, she most certainly saved them from prison. Because they composed and sent the threatening letter with the crushed up Tylenol. That is the biggest legal offense committed in this mess. A federal crime that carries a lot of time. No one mentions it anyone but on DL. Jussie is not charged with it because the brothers admitted they did it and have been given immunity. The system would be nowhere without deals with often the worse perpetrators. So, don't be so naive. Obviously Jussie is a dumb piece of shit with mental issues who staged a hate crime hoax. He won't go to prison. And I don't think he made it worse for future victims of real hate crimes. This was a twitter and media uproar. The justice system works differently. Mostly worse. But even Chicago PD cares about racially motivated assaults on their finer citizens. As long as they aren't the ones accused.
Newsflash R 136. The police lie and withhold evidence. Manufacture it too. Of course Smollett is charged. But he won't be imprisoned.

And judges, too, right? I mean the whole damn system is corrupt and racist, right? Oh, wait a minute, what about all of those jurors who convicted those people? I’m guessing all of those people were racist and corrupt too, huh?
[quote]Because they composed and sent the threatening letter with the crushed up Tylenol. That is the biggest legal offense committed in this mess. A federal crime that carries a lot of time. No one mentions it [anywhere] but on DL.
Maybe no one else mentions it because what you’re saying is not true. There’s been no evidence presented that indicates the brothers did that. Indeed, the police publicly accused Jussie of doing it.
Regardless, though, the state prosecutors cannot give immunity to a federal crime, so I don’t know how you jumped to the conclusion they were given immunity. They don’t need immunity from the Smollet situation because they committed no crime in that debacle.
by Anonymous | reply 141 | March 13, 2019 1:40 AM |
Your post is full of conjecture and lies R141. I never said that judges and juries were fixed. I said that Jussie will not be found guilty of these charges. The police investigation is the foundation of all charges. The brothers most certainly did send the letter and when you are granted immunity from prosecution, they don't make an announcement of what charges you were guilty of. That will all come out at trial. The brothers composed the letter in their apartment, put in the tylenol and either mailed it or had some else do it. That was the what they had on them and why they finally broke their silence and agreed to cooperate. For a great deal, negotiated by their lawyer. The CPD don't like to made a fool of and the brothers were most vulnerable to go to prison. You are a racist R141. Jessie and the brothers are also black, but you are taking some huge personal offense as an old white gay man that Smollett would allegedly stage a hate crime. One look into your other posts reveals your true agenda. Smollett is a creep but this can still be a teachable moment for you. Stop defending the brothers. Wait for the trial or Jussie's plea deal. He's never going to prison.
By the way, there are racist cops, prosecutors, judges and jurors, congressman, Senators, Governors, and Presidents. WELCOME to AMERICA. Crazy self righteous old cracker R141.

Our beauty alone threatens so many.

That’s not what you said at all. You said, “A corrupt and racist PD does require some assistance from prosecutors to be successful.” By extension, you would HAVE to include judges and juries for this racist department to be successful.
You have absolutely zero proof the brothers did anything with the letter sent. The brothers were not the most vulnerable to go since they, technically, committed no crime. Does that mean I’m defending them? No! What they did was disgusting also, but they didn’t commit a crime.
[quote]Jessie and the brothers are also black, but you are taking some huge personal offense as an old white gay man that Smollett would allegedly stage a hate crime.

R144 All three of them are gorgeous, which is why this is so weird. They're all actors, so they'd probably be talented public speakers. They could have taken some kind of speech show on the road and probably would have brought in crowds. It's all so weird.
I think Jussie's activist parents conditioned him into thinking every "social justice" movement needed an event that lead to protests, like you can't just change people's minds by speaking with them, without a protest. I've been thinking this for a while but I believe some people have now fetishized the act of protest, in and of itself and are married to the idea, for everything -- even when a protest might actually harm a cause, rather than help it. Some action fits well with protest, other action doesn't.
by Anonymous | reply 148 | March 13, 2019 10:44 PM |
R148. Are you suggesting Jussie's parents are to blame for this hoax he created? The expense of taxpayer dollars to investigate when resources are tight. Jussie is his own man and should stand on his own actions. Let the prosecution begin and if he is guilty let him pay a big fine or go to prison or both.

by Anonymous | reply 152 | March 14, 2019 11:11 AM |
R149 I'm not blaming them for his choices. I'm talking about how he was raised and the cultural influence of the generation he was raised by: His parents were major activists and probably have find memories of protest. He was raised on those stories and had that bar to live up to. But protest isn't an appropriate -- or effective -- response to everything.
I think he was trying to spark a protest and I have yet to decide if it was for malicious reasons he was fully aware of or if he really, sincerely believes in some injustice he thinks he sees and felt he had to take drastic measures to address it. It's the same problem we're seeing everywhere: Who is sincere about their outrage and claimed fear and who is being knowingly opportunistic?

by Anonymous | reply 190 | March 30, 2019 10:50 AM |
Jussie can maintain his innocence because there are plenty of "Justice for Jussie" types who will believe him no matter what, and everyone else is too concerned with political correctness to really take the gloves off. That, and he's a sociopath.
There was no way the brothers could be charged at this stage, when the prosecutors have publicly stated that they believe Jussie lied about the events.
by Anonymous | reply 191 | March 30, 2019 1:38 PM |
Jussie is tainted in his own swill from this hoax. He is an openly gay actor. The roles he hoped for in the future were already limited, and now even more so. He will become a marginal celebrity very quickly, unless the FBI indicts him, then his notoriety will go back up, but not a guarantee for future acting roles and income.
Most reasonable people, gay, straight, black or white, believe he started this hoax and his INSISTENCE to not take any responsibility is a big turn off.
I have a Nigerian co-worker who is connected to the Nigerian community in the NYC area and he told me that most Nigerians are disgusted at Jussie for throwing these 2 men under the bus.

Why cast Jussie if a percentage of the public will boycott your production? Hollywood will not cast Jussie for this reason. R199. I doubt it. Producers want to sell as many tickets as possible. If they think even 1% will stay away they will cast someone less controversial.
