Chicago (CNN)Two law enforcement sources with knowledge of the investigation told CNN that Chicago Police believe Jussie Smollett paid two men to orchestrate the assault.

The brothers, who were arrested Wednesday, were released without charges Friday after Chicago police cited the discovery of "new evidence."

The sources told CNN that the two men are now cooperating fully with law enforcement.

Smollett told authorities he was attacked early January 29 by two men who were "yelling out racial and homophobic slurs." He said one attacker put a rope around his neck and poured an unknown chemical substance on him.

The sources told CNN that there are records that show the two brothers purchased the rope found around Smollett's neck at an Ace Hardware store in Chicago.

Smollett gave his first detailed account of what he says was a hate crime against him, and the aftermath, in an interview with "Good Morning America" that aired Thursday. During the interview he expressed frustration at not being believed.

"It feels like if I had said it was a Muslim or a Mexican or someone black I feel like the doubters would have supported me a lot much more," Smollett said. "And that says a lot about the place where we are as a country right now."

CNN's attempts to reach both Smollett's representative and attorney Saturday were unsuccessful.

If I were the judge, and Jessie was found guilty of orchestrating this, here is what would happen:

1. No prison time for Jussie. I assume he had no prior offenses. I see nothing to be gained from putting him in jail.

2. Many, many hours of public service. Not bullshit public service either. I assume Jussie has three or four months off from filming Empire now that it's the end of the season. I would make sure that for those three or four months, Jussie was putting in 8 hours per day, 6 days per week of hard community service. And I would make it the most difficult. Tending to crack babies, working in the burn unit at the city hospital, working with Alzheimer patients, picking up trash on the side of the road. I would make sure he came into contact sometimes with Trump supporters so he could maybe understand that many of them were genuinely scared of their future, and wrongheadedly though Trump was the solution*. I would make it as hard of community service as possible, but make sure there was also the possibility of him learning something from it.

3. Restitution. I'd want him to have to pay back a percentage of the money wasted by the Chicago PD and the FBI because of his foolish endeavor. Any maybe make him pay $10,000 to a charity that helps ACTUAL victims of hate crimes, and provides hate crime education.

*Just FYI I hate Trump with the burning passion of 1,000 suns, but I myself work toward understanding the mind of the people who voted for him. I struggle with it, but I think we all should try to understand each other. I don't know, this is a hard one for me.
