Gay sentenced to 15 years for tricking straight guys to sex

A London gay man, accused in September of duping four straight men into having oral and anal sex by posing as a woman on Tinder and other dating apps, was sentenced Friday to 15 years in prison.

Duarte Xavier, 33, was found guilty of six charges of causing a person to engage in sex without consent, Evening Standard reports.

Xavier allegedly engaged the men on the apps with photos of a “good-looking” female. Using a “feminine” voice, he then arranged sexual liaisons at his flat or a park if the men promised to wear a blindfold throughout their encounter.

“By pretending that you were an attractive and sexually adventurous young woman, you tempted them into engaging in sex with you,” said Vice-Judge Advocate General Michael Hunter in court during sentencing.

The guys who were "victimized" in this case would presumably have not been sexually turned on by a very ugly woman, no matter how straight they are, and the fact that they agreed to be blindfolded during sex meant they wouldn't be able to tell how attractive or ugly the "woman" sucking them off was. Which means that it was all about the fantasy woman in their heads, whereas if it was important to them how attractive the woman ACTUALLY was, they never would have agreed to a blindfold. So in terms of the deception, I don't think there's ultimately THAT much difference whether the person fellating them was actually a man or an ugly woman -- but if it had been an ugly woman, she would never have been sentenced to jail at all, let alone for 15 years.

Yes, the judge has to have been a homophobe. Possibly the police involved as well. In a more local media website there is talk of the ‘utter depravity’ of the crimes and the utter trauma the men suffered. Then there is a link to a report of a man getting 4 years for sex with a 13 year old ! One victim has been diagnosed with PTSD. Something we used to associate with watching comrades be blown apart on the battlefield.

Either these men had never had physical contact with a woman ( or anyone for that matter ) before ever, they are all developmentally challenged or they are lying. This isn’t some previously arranged kink. They had blindfolds, or in one instance a pillowcase, put over their heads without prior agreement. In a fucking park ? At night ? Who does that in this day and age and doesn’t think that they were going to get robbed or attacked or that the ‘woman’ is deformed or diseased ? It’s too weird. Something doesn’t add up.

So, yes, the sentence is both homophobic and misogynistic because men rarely get that long for rape of women and while this situation involved trickery and coercion there was no force. To give just one example - John Worboys, who admitted to attacking 12 women but they suspect many, many more, was given an indeterminate sentence with a minimum custodial sentence of 8 years.

I wonder about the significance that the judge was a Judge Advocate General of the Armed Forces. Were they military ? His involvement is not explained.

If you have evidence the judge gave a straight person a lighter sentence for a similar crime, then you could prove bias.

There was just a woman sent to prison in the UK for misrepresenting herself as a man (to have sex with a woman). In her case, she wore a strap on and other "masculine" accouterments, but her attorneys did not try to say she was really trans so it's okay.

The crime is the misrepresentation.

If you are correct, how is that not completely unfair? Trans people are also deceiving people if they don't reveal their true sex. And what's to stop people, as suggested upthread, to simply claim a trans identity to get out of being prosecuted? After all, "self-id" is becoming the law of the land, and no change in apppearance can be required of a trans person.

Sentences in the UK are all over the place. Habitual car parking offenders can end up doing more time in jail than killers. Also prison conditions should be taken into account as they're more humane, they're treated with more dignity than the greater percentage of the planet. Eighteen members of the Huddersfield grooming gang were recently sentenced between 5 and 18 years each in prison.

This makes so sense at all. If a man sees a woman's profile on a dating site, and her photo looks attractive, then wouldn't he want to watch her as she performs these act?

In a case like this, it would be reasonable to expect a bait and switch. Maybe some of the guys thought it was an unattractive woman who was using someone else's photos to get some sex. And, even if the woman wasn't attractive as she pretended to be, at least they were getting some sex out of the deal, and with the blindfold, they could still pretend the woman looked like a model.

I have no sympathy for either the victim or the perp. Had the perp got his ass kicked, he would have deserved it, but at the same time the person calling rape has only his idiocy to blame. Both entered into a high risk situation which could have ended badly for either one of them. Unless the victim was mentally retarded, I don't see why the courts should have been involved.
