The Wall Street Journal is reporting that no more live episodes of Megyn Kelly Today will be aired this week, and that her show could be replaced as soon as Monday. “The tensions between Ms. Kelly and NBC News could ultimately lead to her departure,” a source was quoted as saying.

I still have no idea what NBC was thinking making a big bet on her. She had several controversies on Fox and her career was in downfall prior to NBC nabbing her. She was never a natural fit for the network and it was always odd why they decided to hire her in the first place.

Her Sunday 60 Minutes-esque show was a total fail that lost to 60 Minutes reruns.

Her Today show has been a complete ratings failure.

I don't care for Megyn at all but I think this was a mistake. This could have been used as a great learning experience. Having an entire week of people on to explain what is offensive and what isn't. How to tell what is offensive. Not famous people as guests who can explain why they find certain things offensive. Instead we take another opportunity and just get rid of it like it didn't happen. And Megyn should have hosted it because people would have tuned in to see what she was doing.

R84 Generally guilt by association. There's no real need to paint your face black ever, so doing so is almost always seen as being deliberately provocative.

Black people dress up as white celebrities and characters all the time without painting our faces. It's never even occurred to me to do that when I was dressing up as a white character. So this isn't really a double standard.

She was paid really well at fox news before her NBC contract and now with this potential huge windfall pay out NBC may have to pay her. After taxes and everything goes into the bank. I'm sure that'll put her personal net worth way above $100 million dollars if it isn't already north of that yet. Megyn is a very wealthy person, she won't have anything to worry about monetary anyway.

That being said, she needs to stay off television indefinitely, she's way to controversial and provocative. But just like a lot of people keep saying. She just might end up back at fox news, where she belongs. She should have never left in the first place. The fox news stench follows all who worked there for life.

What R98 said is probably more accurate than not, although that depends entirely on what's in her contract with NBC (I assume there would have been extensive negotiations for someone like Kelly). I've actually had the displeasure of reviewing these types of entertainment contracts (dozens of pages long and incredibly confusing/boring) and there usually are clauses that release the employer from paying out on contracts when the employee's behavior causes damage to the company's public image. Generally, they're known as "morality clauses" and they hinge on damage to the public image of the employer via an employee's boneheaded actions or words. If an employee does something that patently makes the parent company look bad, it can trigger such a release. However, whether NBC could effectively argue a violation of such a clause is another matter.

R115 On its face, I don't really see how NBC showing actors in blackface is exactly relevant to a contract issue with an employee (did NBC really do that?). What would be at issue is her comments/behavior and their effect on NBC. To the extent Kelly could claim that because NBC showed such things it inherently OKed her to make her remarks, then maybe. But I still question the extent to which that gives Kelly a wild card legally. Her statements and their effect are really at issue, not anything done by NBC. If I'm missing your point, I apologize. I can't comment on the NBC/Weinstein thing, I have no knowledge on the topic. Ultimately, I'm not making an assertion on Kelly's success on any claim against NBC (my last sentence in my previous post). I am simply stating that there are likely clauses within the document that likely pertain to this type of dismissal and release from any contractual obligations, which NBC would/should use to their advantage. Believe me, NBC wont just throw a few 10s of mil at her if they don't have to. But again, any success for either party is dependent on the contractual language, which none of us (likely) know.

As a Black person, I find that we can be the most overly sensitive group of people on the planet. Was this malicious? No. Was it calculated and a misfire? ABSOLUTELY. R113 - I understand what you mean about a morality clause in contracts such as these (tho not in entertainment biz, I’ve had similar clauses in my own employment contracts) but aren’t these clauses meant to apply to an employee’s off the clock behavior? For example, if she did/said it a twitter rant or FB post, then the morality clause could apply. But, how can saying it in a discussion on a “news program” - especially when you (NBC) hired her knowing her background and to stir things up a bit, how can they invoke the morality clause now?

As for “damaging the brand”, I think it could be successfully argued the sexual harassment scandals and coverups were more damaging and they got contract payouts. I think NBC realized their mistake months ago, and this just gave them the excuse to begin exiting her out of the network. I don’t she’ll get anywhere near the $70 million some reports say, but I think she’ll still walk away with somewhere in the neighborhood of a year, a year and a half’s salary. I think NBC just wants her and this story to go away.

Now we’ll wait and see just how long it takes until the announcement that she’s going back to Fox is made.

It won't play well in the court of public opinion. And, combine their fascination with blackface with how the Today Show had no issue with "womanface" on their Halloween episodes and what Megyn Kelly did will look mild in comparison.

Billy Crystal used to do it too. I think the blackface that is offensive is the minstrel, derogatory, mockery and pandering to racist stereotypes. I think for someone of any race to portray a character is not necessarily offensive unless the context is offensive and designed to humiliate. I loved Eddie Murphy running around in white face for a skit where he was making a point about racism. Some actors hand comedians have a genius when it comes to impersonations. I don't necessarily think that impersonating someone of another race needs to automatically be construed as offensive. (I'm not white.)

Any issues litigated would hinge on the contract language and whether her words met the standards laid out in the contract. So I can't really answer your question. And no, these morality clauses (that I've seen) encompass both on- and off-the-clock behavior. If anything, her saying it on the air is all the more reason for NBC to induce such a clause, because the public nature of the comments can be assumed. As for damaging the brand, again, I don't know what damages NBC would have sustained due to her comments. Again, the resolution depends entirely on the contract language, which I don't know. As for the sexual harassment/metoo stuff, I doubt the relevancy of any of that in a single employee contract dispute.

You're assertions also assume that Kelly's comments and the depictions of blackface on those shows have the same meaning and intention, which is highly debatable (and another full thread of discussion on its own). Generally, the actions (good or bad) of an employer generally don't correlate to a get-out-of-jail-free card for an employee who acts similarly. Just because executives are hiring prostitutes doesn't make it OK that employees are doing it too. What NBC has or hasn't done in the past isn't at issue for such a dispute (although it certainly may be relevant to other issues). From what I can tell, you are reading quite a bit into my comments. I actually agree with you that this particular instance, by itself, was odd as the terminal offense. Based on what I've seen (I will have to watch it again), all she was doing was suggesting a question of whether a white person dressing up as a black celebrity with no intention of a negative portrayal (and, of course, darkening their skin with pigment to look further look like that celebrity) is the equivalent of the degrading form of blackface done decades ago, or something different. Honestly, I think it's a very interesting and challenging social question. She's said a lot of stupid things in the past from what I gather (the "Santa is white" thing was especially bad), but this wasn't in that category, in my humble opinion. But again, any arguments either side has are going to be centralized around what's in her contract, which I certainly don't know. If you do have such information, please do feel free to use it in our discussion. Quite frankly, if I had to hazard a guess, my guess is that she has the better argument. But it's not because NBC has shown actors in blackface or NBC made payouts to higher-up harassers; I don't believe her comments can be construed as breaching a morality clause that would subsequently damage NBC's image.

As for this "Court of Public Opinion", I am aware of it and understand it. It is a social construct that's not a real court and has no legitimate authority (although it can certainly induce certain actions). Therefore I don't (and no one else well legally-minded) accept it as an authority on any legal matter and it is dumb. The right to contract and to enforce rights granted by contract are given by the United States Constitution and are legally enforceable by an actual government-recognized authority (e.g. a court). You may not give a hoot about her contract, you probably shouldn't as most people don't. But that instrument and that body of law are paramount in determining how anything goes down legally regarding her conduct. Even assuming that Kelly and NBC care about this "court of public opinion" (they likely don't), there are plenty of people in this "court" who would "vote" on both sides of the matter. And, yes, these matters do "play out on TMZ and in the media" for the general public (I can't believe I just typed "TMZ"). But again, no actual authority there to determine an outcome on any legal matter.

You also don't understand the actual meaning of "morality clause" in a contract context. NBC's actual "morals" have nothing to do with it. "Morality clause" is a lay term used to describe sections of enforceable agreements that require an employee to act and appear a certain way publicly. The term "morality" is only used symbolically. The use of the term "morality" to describe them simply comes from the fact that they usually prohibit traditionally bad actions and behaviors in western culture. But it can be any behavior or action that counters a company's image (e.g. it technically could prohibit an employee from acting too righteous if the company's image is one of debauchery or bad-ass-ery). Re: this neighbor of yours, I'm curious as to what it is she disagreed. If she's an attorney and thinks I am incorrect, I'd actually be very interested in her thoughts. But if she isn't, her thoughts wont be worth much, if anything, to me. Re: this supposed morality oath she signed, that doesn't sound like a real thing and even if it were it's not relevant to a morality clause in a contract.

Also, Kelly's decision to turn this into a "PR nightmare" still has no relevance to the legalities of the contract.

I never liked her, and I am not surprised NBC is going to pay her off to leave early.

I post only because my father, who is 78, asked me last night when I was at his house and the Kelly controversy was on some channel, "Do you remember seeing that newspaper clipping in [my grandmother's] scrapbook of me and my scout troop onstage for a show, all of us in blackface?"

I actually did remember it, and I think we joked about it as kind of offensive after grandma died 25 years ago and we were going through her things. But now, both dad and I understand how wrong that was even in its time. It was a cute picture of a talent show to my grandmother, and to the town newspaper, but looking back, wtf. Thankfully we all have progressed.

And Ms Kelly is not 78 years old; she should know better.

Many people were aware of it and didn't care and those who did bring it up were mocked for making a false comparison.

Yet he's not going to denounce it even though they are all still working in high positions. Roker should just own up to the fact that there is no good explanation, and even more, what they did was much worse. In the case of Kimmel, he actually portrayed the NBA star as being mentally delayed.

He’s also responsible for the Brian Williams lying scandal, the Matt Laurer #MeToo scandal, the Joy Reid Homophobia scandal, Ann Curry being fired from the Today Show and Tamron Hall leaving the Today Show.
