Portlandia bakery fires employees for denying black woman service after closing

PORTLAND, Ore. — Two employees of a bakery in Northeast Portland were fired earlier this month for denying a black woman service because the business had closed.

"Back To Eden Bakery" released several public apologies and statements following the incident, before letting the employees go. In one Facebook post, the bakery's co-owner wrote, "We are doing business in a gentrified neighborhood in a racist city within a racist state of a racist country.”

In one statement, "Back To Eden Bakery" says that according to its own surveillance video, a black woman named "Lillian", who is well known in the area as a "professional equity activist", entered at 9:06 p.m., after the bakery's closing time. Employees had also turned off the "Open" sign, but several customers (all white) who had already ordered were still inside. Two other white women who went to the bakery two minutes before "Lillian", and were also informed that the business was closed for the night.

The bakery says "Lillian" left the store briefly and began recording video.

The bakery's statement says that even though it does not consider the employees to be racist and that they were following the business's protocol of closing at 9 p.m., they were fired because "sometimes impact outweighs intent." The bakery also says in the statement that the way the employees went about denying the woman service, "lacked sensitivity and understanding of the racial implications at work."

In the statement "Back To Eden" says the employees were fired because the woman and the "clamoring public" demanded they be fired.

In one statement, the bakery admitted that the employees did not necessarily do anything wrong, "this is more about how a black woman was made to feel" at the business.

That statements have since been deleted.

Oregon is an “at will employment” state. They can dismiss any employee at any time as long as it doesn’t violate the Civil Rights Act or Oregon anti-discrimination laws. Since they weren’t fired for race, religion, age, or sexual orientation reasons, there’s not much basis for a successful lawsuit.

Those employees should think about their white privilege and be thankful they can use their unemployment cheques to purchase pastries at any business that sells them, unlike black people who can only make the such purchases from bakeries during business hours because Portland is so racist.

They will. A person gets unemployment when they lose their job through no fault of their own (ie they don't quit). Even if the employer objects, they can argue that they were not properly trained. My concern is that they might have been paid under the table in which case they can't collect unemployment. These owners seem just skeevy enough to not pay any employment expenses.

When I was in college, I worked as a cashier at a hotel restaurant. I got written up one time because I closed the restaurant door at 9:30 pm (restaurant hours were until 9:45 pm) and of course two assholes complained to the front desk that the restaurant wasn't opened (this was in a huge tourist town with hundreds of restaurants better than our chain hotel slop). But like others have said, once the restaurant closed, there was a ton of work to do. And our bitchy manageress DID NOT pay overtime. If you clocked out late, she'd yell at you. And she often told worers, "Clock out and then finish your work." I should have reported the bitch.

(A) OR may be at will state but nothing precludes employment agreements that reserve termination for cause . Employees who are hired without paperwork (eg offer letter) are free to claim that employer and employees agreed that termination would be for cause only.

(B) Obvious they were fired because they were white. POC who turned away a black woman after hours wouldn’t have been fired.

(C) These cafe owners are ridiculous and they are trivializing the whole idea if social justice as a question of the woman’s feelings.

I watched her video, though I had to go to the Blaze to see it, and the whole time she’s talking about how she’s going to put them on blast for treating her this way. I just don’t get posting this kind of thing on the internet. If you feel a business has treated you poorly, especially a small one like this, why not approach management and let them try and rectify the matter. Then, if they don’t, knock yourself out, i guess. In general I think life is too short and would just not go back.

I’m also amazed that, at this point, people aren’t afraid of blowback from making internet scenes. They may get some initial validation, but the pendulum always swings back the other way and brings tons of negative attention.

R18 I'm sure the employees are white. If they were black, and did this, then they wouldn't have been fired. Therefore, the employees were fired based on their race. Even though they did not have ill intent, based on their race (and Lillian's race), the impact was negative - again, they have been fired as a direct result of their race. The fired employees have a good case.

R51 the videos have all been taken down, but there were people inside the bakery standing in line and ordering. There were also people sitting at tables. So when she came in and they said they were closed, she said she believed it was because she’s black as the people inside and in line we’re white.

I mean, I’ve been in that situation when I’ve missed the cut off in a restaurant/takeaway or a cashier sees me and puts down the “closed” thing on the conveyor belt in front of me because their shift is over. It’s annoying, but stores have to close and workers have breaks. An eyewitness said he heard the employees talking and saying not to take any more customers before she even walked in.

Trust me, the minute someone would be let out, others would try to push in. In a previous lifetime I worked retail. I know how they are. Employers have a responsibility toward their staff too, that they will honour the hours of business, and that the workers can expect to get home at a reasonable hour.

Workers have the right to take breaks and to end their shift at a predetermined hour and to go home. It is not a priviledge, it is a right.

r40, I'm black. This has nothing to do with racism. What it does involve is some entitled a-hole who is trivialising actual cases of racism by inserting race into a situation where it has no bearing.

I used to work retail. There are few customers more hated than those who show up just a couple minutes before closing. It is common practice to close the door so no one else can come in while you settle up with those remaining customers. But then there are those true idiots, like this woman, who want to come in and be served AFTER closing time, and will try to enter when the other customers are leaving. I don't care what colour you are, if you come in after closing time, you will not be served.

The arrogance displayed by this type of customer is unbelievable. Guess what? Retail workers have lives just like you do. Before I switched to TD bank, which is open late, I can't even count how many times I arrived at like 3:01 pm and was denied entry into the bank. Of course they allowed the people already inside and on line to stay. I'm very obviously white.

I usually side with people of color in these matters but if a place closes at 9 you don't try to go in after 9. Perhaps the employees weren't respectful in the way they spoke but it was not right of me to try to get into the bank at 3:01, I stopped trying after awhile because I knew I was in the wrong and it was not right to try to get into a place that closes at 9 after 9.

Now if someone of color was already in there and was asked to leave after all the white people were gone that would probably be racist.

I worked retail years ago lie R106. Late customers and customers who don't leave at closing time are assholes. Not only do you have to close up, clean, and count the register, I had to drop off the money bag in a commercial drive through late at night. It's usually young kids having to close up like this and it is dangerous because there are few people around. And the person up thread is right closing time is dangerous for the workers because the crowds have left. I live in Austin where some young females were rapped and killed right after closing time a couple of decades ago at a yogurt shop. There were like 4 of them.

I lived in the Portland area for a while in 1990, and I loved it. I thought it was much nicer than Seattle. I’m glad I don’t live there now. The influx of hipsters and far left whackos has really ruined the place.

All were white. It happened when Austin was a smaller, sleeper city, right before it started growing from the tech boom. I know people who lived in the neighborhood and they said it was shocking. One of the big issues with this case is that one of the investigating cops was later fired for coercing confessions out of dozens of suspects, including a couple of the guys tried for these murders. Years ago I worked at Walgreens for a manager who could not tolerate people still roaming the aisles at closing time. Five minutes before closing he would walk through the store and tell customers it was almost closing time. At the stroke of the hour if someone was in line, they were waited on, otherwise he grabbed the cashier and the drawer from the register and hightailed it to the back office while someone was stationed near the locked door, cleaning or restocking. When the inconsiderate shoppers finally made their way to the register, they were told the manager thought everyone had left and the cashier was now gone, so they couldn't make purchases anymore. The door was unlocked and the imbeciles were let out, no doubt to go haunt another business.

People start seeing everything through there lens of racism, homophobia etc. It warps their perception of things and sadly by crying wolf they undermine the real issue when it happens.. So when they experience anything contrary they rationalize that it must be racial bias, homophobia, etc. The truth is she was that the customer that came in after they closed and happened to be black. They should have served her since they didn’t lock the door.

I accept that this will not go over well, but WTF.

I think that most lower class blacks have no concept of accountability these days. They don't stop to think what part THEY may have played in an outcome which is negative for them. With the exception of a small handful, every black man shot by the police could have remained alive but for a choice they made to fight or evade the cops. "But that shouldn't mean they ought to be given the death penalty!!" No, but it does mean that they are accepting that they played no part in their unfortunate fate.

Same with the equality pastry lover. She is not looking at what happened and accepting any of the blame for what occurred. It would have been so easy for this not to have happened, but all she can see is that it DID happen and it must be because of her skin color and none of the choices she may have made.

I'm white(obviously) and nearly everyday I have to make choices about how to act and react. I modify my own behavior so that unpleasant incidents are few and far between. Do blacks think that white folks get whatever they want, whenever they want it because of their skin color?

That is hilariously absurd. We have to avoid conflict constantly, and most of us are pretty successful at that. Accountability is the reason we use restraint and we think before we make assholes of ourselves.

My sister has been documenting it via texts and photos (because my sister is BPD and woe unto you if you piss her off!). The supervisors met with HR and Legal and transferred this black woman to another assignment where she will be watched (my sister and her team work in rotations and somewhat independently). Now that woman filed a grievance. She also has a pending lawsuit against another school district. She’ll get her settlement, too, because you know why. And then she’ll move on to another district, rinse and repeat.

My supervisor and I were once robbed at gunpoint as we dropped off the day's cash at the bank across the parking lot from our burger joint, at 11:30pm just like we did every night. (Which is a pretty fucking stupid policy if you take two seconds to think about it, which the owner clearly never did before that!)

Like all restaurants and retail operations, we only had a limited amount of time after closing to finish all our duties and be out the door. If we'd had to keep serving late customers, then we wouldn't have been able to finish on time and would both A) be forced to work for free, because the boss would only pay us for up to 30 minutes after closing time, and B) we'd be bitched out by the boss the next day, for taking too long and therefore not doing our jobs properly.

Unfortunately people like this aopportunists. There is a certain segment of society with zero ethics that exploit hot button issues like racism for personal gain. Instead of just walking away and recognizing the situation like a reasonable adult (here, I missed out by arriving too late) they seize the opportunity and whip out their phone and create a scandal and to retaliate against the individuals that didn’t give them their way..

I used to teach high school and i remember parents that would have some issue with their kid at school or with the school and instead of dealing with administration, they’d run to the local news. It was always funny how parents that you could NEVER get a hold of for parent conferences and discipline issues were suddenly front and center and outraged. It’s a real shame because as we know there are real issues with systemic racism that are costing people lives, especially young black men. This kind of BS gives racists ammunition to dismiss real racism as a non issue.

Thanks for the corrections regarding exactly what was said re: the "I think they were women" comment. On one hand, I found this whole matter ridiculous and also infuriating. On the other hand, I don't think that I can force myself to actually listen to this video of Lillian's. So, I remembered what had been quoted that she said, incorrectly.

Systemic racism and white privilege. Young black man lunges at cops and loses fight to the death? Systemic racism, police brutality. Young black men killing each other at the same rate as 3rd world war zones? Systemic racism.

Some additional background. They're digging themselves into a deeper hole.

Portland is the often called the "whitest city in America." According to the most recent census, the population is more than 75 percent white. Northeast Portland, the neighborhood where the bakery is located, is a historically black neighborhood that has been heavily gentrified in recent years. Between 2000 and 2014, the black population in that area dropped from 30 percent to 17 percent. Black businesses have been replaced by white-owned shops, cafes, and bars.

As the news start to spread, people flooded Back to Eden's Facebook page with accusations of racism. The very next morning, at 9:06 am, exactly 12 hours after Green was denied service, Back to Eden's John Blomgren, who owns the bakery with his husband, posted a 3,000 word apology on Facebook.

"Since both Lillian and the clamoring public were demanding that these staff members be fired that it is what we did putting these two young women out of work.”

Since then, Blomgren has walked back his claim that they fired the employees due to the "clamoring public,"

Perhaps ironically, a few weeks before being accused of racism, Back to Eden had agreed to host a "Reparations Happy Hour," in which white people donate money to an event for people of color only. That event was organized by Cameron Whitten, an activist in Portland, who, in 2012, protested in support of low income housing by staging a 55-day hunger strike in front of City Hall.

Whitten told me in a phone interview that the day after Green was denied service, Blomgren called him and asked for advice on how to respond to the crisis. Whitten says he offered to help the bakery craft their message (or even to do it for them) but the owners didn't listen, and instead, later hired a white man to serve as the company's interim CEO and do their PR. This, Whitten says, was a mistake. "White people don't have the lived experience to speak to black people," he says.

On June 2, several weeks after the incident, Whitten posted a nearly 50-minute video on Facebook, about "why you can't trust the wolf in sheep's clothing that is Back to Eden Bakery."

"Here, again, a white person has fucked up," Whitten says. "They fucked over a black person and they will not be qualified to make amends to this black person." Whitten goes on to accuse Blomgren of performative allyship, centering himself, name dropping Whitten without consent, and—his primary complaint—writing an apology that was too damn long. In the end, Whitten both cancelled the Reparatations Happy Hour scheduled at Back to Eden and joined Lillian Green in calling for a boycott.

Neither Lillian Green nor the bakery responded to request for comment, but for his part, Whitten says he doesn't want to see Back to Eden close down because of this. "A boycott is not about putting them out of business," he said. "It's about creating change. I'm giving them an opportuntity to come correct. I will meet with John or Robert if they affirm their racism and anti-blackness. They say black lives matter but now they are being asked to demonstrate that their actions mean more than words."
