Trump already lost against Stormy, no contract where the fine for breaking the NDA is so disproportional to the actual settlement is enforceable. No judge is going to award Trump 20 million for a settlement of $130,000.

The truth is that nothing is stopping Stormy from telling her story, even if you loses the case, because there is nothing in US law that prevents free speech. She could easily make $20 million for one interview or book deal. Heck she could easily made X10 that amount with a couple of interviews and a book deal. She could even sell the rights to her story to a movie studio.

I learned a lot from the Stormy case discussions. Apparently the $20MM claimed by the Trump lawyers is only to claim an outrageous amount so they can move the decision on arbitration to Federal Court.

And seal all the documents so nothing comes out of it?

As I understand it, the court (Federal, State) has to decide whether to enforce the arbitration - which is private and confidential, and decided by an arbitrator who the cable news pundits said is highly likely to be an old white conservative guy. OR whether to hear the dispute in open court, be it State of Federal, which will be disastrous for Cheeto because of discovery, he'll be deposed, etc. all documents will be publicly accessible.

Trump's lawyer in this matter is Charles Harder, as mentioned above. Harder was Hulk Hogan's attorney when he sued Gawker, eventually resulting in Gawker's bankruptcy and dissolution.

Two legal thoughts:

1. They ran into federal court based on federal “diversity jurisdiction.” Think that means all the parties have to be from different locations. Since one of the parties hiding the identities is a limited liability corporation (EC, LLC), the principals of it have to be uncovered to see if they too are diverse. Guess everyone will soon know who’s behind the legal mask. 🤦‍♂️

2. She’s got a truly top-notch lawyer; while the other side has got some of “the best people.” Demanding $20 million (plus) in liquidated damages for breach of a $130,000 contract has just the faintest whiff of unconscionability about it.
