The US and almost every other country on the planet has laws against foreign governments owning media companies.
The Chinese government may or may not "own" TikTok in a traditional financial sense, but exerts more control over it than any majority shareholding owner does over publicly traded companies.
Facebook, Google, Instagram, WhatsApp, Youtube, and Twitter/X are all banned in China. I do not see a problem with forcing TikTok to divest in order to remain operating in the US.
No, this will not create a "chilling effect" on free speech or any other nonsense.

In a way I wish that Trump had been successful banning TikTok while he was in office. The 6-3 conservative majority on the broken SCOTUS is much more likely to agree with Republicans, and it might just be that it was Joe Biden who signed this law that dooms it. Nevertheless, does anybody think that bytedance won't just form a US-based company to purchase TikTok and basically nothing will change? It's not like America's billionaires are going to stand idly by while their investments go to zero worth.
