Something that bothers me is trial by social media. Someone can lose their careers and social standing just with an accusation and they haven't been charged with a single crime or stepped foot in a court of law. Rape is a horrible crime and rapists should be punished and I think a way to clean this process up is to keep everybody's identity concealed until actual charges have been filed and we're not just at the accusation stage. I feel like fifteen years ago stories like this existed but the police were able to make a sober minded conclusion about whether charges should be brought and the facts mattered. I think the Brock Turner case was a watershed moment. The judge was successfully recalled for handing down too light of a sentence in that case, according to a bunch of people who did not sit through the trial and hear all the evidence.

Now, depending on how big the public outcry is, sexual assault cases are easy lay-ups for prosecutors. All they have to do is establish sex took place, press charges, then have some victim's advocate testify and explain any inconsistencies in the victim's story as indicative of trauma.

You hear a story like this and you’re like “OMG that’s horrible”. Then it comes out this was at a college party. Which of course means there was booze there. Then it comes out the girl was underage. Underage girl at a college party, which means older boys and booze. Well, okay. She had no business being at this college party with older boys and booze, but that’s light compared to rape.

Well, you get to the carefully worded portion and it contains inconsistencies like she was barely conscious but ran out of the room after and went to police and reported a rape the very next day, they did a rape kit that proved it however the police haven’t charged anyone. It starts to look a little suspect.

I don't know R270. But if the police or DA don't have sufficient evidence to charge (if she's lying), they could just say so...

R271 No, they couldn't. You've never, EVER heard a police department claim a sexual assault victim was lying or made a false statement UNLESS they're going to charge her for it (meaning they have affirmative evidence to corroborate the claim that she made it up).

If they think her story is inconsistent or there's not enough evidence, they'll simply tell her the case is open pending additional information, or if the prosecutor makes the decision not to file charges, he will tell her (again, likely not a statement he would make publicly) why he is unable to file charges.

If she's serious about her lawsuit, what will happen is the person she's suing will ask for immunity from any criminal charges in exchange for him being deposed. The judge will ask her if that's okay, and if she goes along with it, well, maybe a civil suit is her only avenue of redress, or maybe that's what she wanted in the first place...
