Obergefell and Lawrence

The right to gay marriage and the abolition of sodomy laws need to be codified federally and/or at the state level if you don't want a repeat of today.

Setting the supreme court on fire won't do anything.

Reject anything other than a push for your legislatures to put our rights into law. Don't leave them dangling by a court decision. It has to be explicitly legal.

The thing with sodomy laws is that they're usually restrictive - outlining what CAN'T be done. I don't think I've ever seen a law that sets out what you CAN do, i.e., "all legal adults have the right to engage in any voluntary consensual sex acts with other legal adults." I can't see them codifying such a law. But, it would be great if they did, because, just like Roe, if Lawrence is overturned, it would be a patchwork of state laws. And those laws would be legally sound in the states that passed them - though restrictive laws would also be legally sound in other states.

Surely the right to marry could be codified without even being controversial, right now. Abolition of sodomy laws could be phrased in such a way that wouldn't be opposed. Sodomy includes oral or anal sex between straight people, too. Clearly it's not a good bet to rely on a SCOTUS decision. Our rights have to be spelled out by law.

That's true, oral and anal is a classic definition. But, sodomy can also just mean non-procreative sex - again implying oral or anal and maybe more. And even broader, it can mean simply "aberrant" sex. There's a sliding scale, and don't be so sure that a new sodomy law wouldn't specifically codify that people of the same sex can't engage in certain behavior.

There has to be a way to make these rights a law. Specify it doesn't matter whether it's same sex or hetero.

Clearly, leaving these rights undefined by law and unenshrined by law is rolling the dice with a conservative court that will be around for the next several decades.

I helpfully provided links to where people could find contact information for their legislators to do just that--you know, the exact topic of this thread.
