BREAKING: Supreme Court limits ability to enforce Miranda rights

The Supreme Court limited the ability to enforce Miranda rights in a ruling Thursday that said that suspects who are not warned about their right to remain silent cannot sue a police officer for damages under federal civil rights law even if the evidence was ultimately used against them in their criminal trial.

Losing Miranda is a big problem and it's entirely thanks to the GOP, but keep telling me how Biden has a low approval rating, therefore we should all vote Republican about it.

This is beyond idiotic, but isn't the main thrust of not being given Miranda warnings that the self-incriminating evidence might get thrown out at trial. Has there ever been a a large number of lawsuits for not being given proper Miranda warnings? Also, and this is hardly a silver lining but just to underscore that the opinion might not have drastic effect, law enforcement already is often iffy with Miranda and when it's brought up at trial, it doesn't lead to anything because you get officers to back each other up and say that proper Miranda warnings were given at the right time. Still, it's all a shit show.

If the police are not subject to any kind of punishment for not giving out the Miranda, then that means no one is going to even tell a suspect about their right to remain silent.

Claiming that this ruling doesn't matter "because cops lie about it anyway, so who cares" is fucking bullshit, r2. You're an asshole.

SCOTUS is a really big problem

by Anonymousreply 4June 23, 2022 3:05 PM

[quote]The court's ruling will cut back on an individual's protections against self-incrimination by barring the potential to obtain damages. It also means that the failure to administer the warning will not expose a law enforcement officer to potential damages in a civil lawsuit. It will not impact, however, the exclusion of such evidence at a criminal trial.

Do not for once second believe that there isn't already a case coming down the pike that will go before the Supreme Court, where they ask the Court to allow self-incriminating evidence given by someone who was not aware of their Miranda rights.

That's the next step. Just like the next step after overturning Roe is to make abortion illegal on the federal level.

We all know where this is headed.

No one said it didn't matter, R3.

by Anonymousreply 6June 23, 2022 3:12 PM

You said this opinion "might not have drastic effect," because cops lie about whether they gave out Miranda rights anyway, r6. That's clearly an attempt to excuse this opinion away as not being a big deal.

by Anonymousreply 7June 23, 2022 3:17 PM

It's really not, but continue ranting.

by Anonymousreply 8June 23, 2022 3:19 PM

Time to pack the court, Joe!

by Anonymousreply 9June 23, 2022 3:34 PM

Biden won't pack the court. The Republicans will, once they get the presidency again.

by Anonymousreply 10June 23, 2022 3:40 PM

Anything that diminishes opportunities to keep police in check is preparation for our fascist future where citizens can be pickup up off the street and help without cause or recourse. It’s part of their plan.

by Anonymousreply 11June 23, 2022 4:22 PM

R9, I assume that you are referring to Joe Manchin.

by Anonymousreply 12June 23, 2022 4:41 PM

R9, for the millionth time, the President cannot single-handedly pack the Court. The Senate needs to approve legislation to expand the number of justices (and I assume the House would have to approve it as well), and it should be obvious to anyone how unlikely that is.

People need to stop acting like Biden only has to wave a magic wand to make everything wonderful. This court is the result of years of strategic planning on the part of the Right, while Liberals were largely asleep at the wheel or merely being reactive vs. proactive. Or aligning themselves with candidates like Sanders who would never be elected President and, even if he was, would have no more power to do anything than Biden does.

A lot of Bernie fans made the same mistake that Trump fans did - mistaking a lot of "we'll do this" bluster for the actual ability to do so by himself.

Ahhh, The Supremes...they remind me of a larger bureaucratic version of those managers who wait everyday until just before business closing time to e-dump some huge work project or news update on all their employees, but with The Supes it's on a huger administrative scale over the last couple of weeks before they adjourn for the summer.
