Australian Border Force investigating whether Djokovic lied on entry form

The Australian Border Force (ABF) is investigating whether Novak Djokovic submitted a false travel declaration ahead of arrival in Australia, a source with knowledge of the investigation told CNN.

Djokovic declared he had not traveled and would not do so in the 14 days leading to his arrival in Australia on Wednesday January 5, according to a travel declaration submitted as evidence to the court determining whether he would be allowed to remain in Australia.

Various pictures taken during that two-week period appear to show Djokovic in both Spain and Serbia.

While court documents show that Tennis Australia filled out the travel declaration on Djokovic’s behalf, the information used was provided by Djokovic, an ABF officer at Melbourne airport on January 5 determined.

The penalty for submitting a false travel declaration carries a maximum penalty of 12 months prison, according to the Australian Department of Home Affairs website.

Djokovic’s media team has not responded to CNN’s requests for comment.

The ABF investigation comes as Australian Immigration Minister Alex Hawke considers whether to exert his personal power to cancel Djokovic’s reinstated visa.

First of all, Slovenia is not on Balkans. It is a central European country. It was part of Yugoslavia, but has never been on Balkan peninsula. The westernmost Balkanic country is Croatia. Then further east is Bosnia and Herzegovina, Serbia, Montenegro, Kosova, Albania, North Macedonia, Greece, Romania, Bulgaria and European part of Turkey. I have seen maps including Slovenia on the peninsula, but it is wrong, because peninsula is a geographical term, not political, so Slovenia which was a part of socialist Yugoslavia is not situated on it, while Greece, who was part of capitalist Europe is.

I am from Croatia, and I will leave the decision which one of us is bigger trash to little DL fascists, but only an ignorant will call call Romania, a country which is home to Cioran, Eliade, Ionesco, Brancusi and the greatest contemporary European filmography bottom of Balkan trash.

And there are so many of them, keeping together, helping each other, at least the ones from ex Yugoslavia. My partner's brother started to work in Austria and he is thrilled. They have little Yugoslavia there, everyone wants to help him and take care of him, Bosnian girls competing to invite him home for dinners.

Hawke as Minister for Immigration has the discretionary power to overrule the court’s finding and cancel Novaxx’s visa. He and Karen Andrews, the Minister for Home Affairs are the only ministers with those discretionary powers.

My guess is that Hawke is looking for any other reasons to kick Novaxx out, which he continues to serve up on a platter. If ND does get expelled it will create a shitstorm - you saw how the ND supporters went crazy when he was first released. Just imagine if that is reversed. There are quite a few fanatics in that crowd.

It’s Wednesday morning here now and as the draw is on Thursday I’d be surprised if we don’t get a decision within the next eight hours.

I guess it hinges on when he was notified about his positive result R100. So the diagnosis might have been on the 16th but he may not have found out until the 17th, after the kid's tennis thing. But he still went and did that interview knowing he was positive by that stage.

No. In court docs, he states that he was tested and notified on Dec. 16 at 8pm. On instagram, he's saying it's the 17th because otherwise it looks like he exposed kids to COVID. If he lied in his sworn affidavit, does that void the cancellation quash?

At what point will he finally admit that there was no positive COVID test in December? He let the Serbs invent one for him, he didn't think that he'd ever be stopped at the border and questioned on it, and the existence of the fake test was never supposed to be made public. He wasn't prepared for people to dig. It's so obvious that he's a scummy liar.

Robert Potter, co-CEO of cyber security firm Internet 2.0, confirmed there were inconsistencies between the timestamps in the documentation Djokovic presented to Border Force officials, and the URL linked to the QR code on one of Djokovic’s tests.

“I can’t interpret the medical implications but I’d say there is sufficient evidence to question the fidelity of his paperwork submitted to the Australian government relating to his positive test,” Mr Potter said.

“The time stamp contained within the QR code of his positive test does not match the paperwork as submitted. However, the timestamp of his negative test does match his submitted paperwork. As long as you are confident that the QR codes you have sent me for evaluation match those submitted to the Australian government, then I’m confident saying that Djokovic has legitimate questions to answer.”

German cyber group zerforschung also found that, according to the ID numbers attached to the test results, there are questions about the timing of Djokovic’s claimed positive result on December 16 and his claimed negative result on December 22. The identification number for the negative result is 50,000 numerations lower, suggesting it was recorded before the positive result.

“Based on these pieces of evidence, the most plausible explanation is that the positive test result was added to the official Serbian database on the 26th of December, and not on the 16th,” the IT experts told Der Spiegel.

Later on Wednesday morning (Australian time), the German cyber group said a “plausible explanation” for the timestamp discrepancy had come to light, but not for the discrepancy around the confirmation codes.

Pointing to web postings by Serbian users of the HackerNews forum, it was theorised that timestamps in the QR code and its linked URL were regenerated when the PDF was downloaded with a result. This could mean, for instance, that Djokovic or someone on his behalf re-downloaded one of his results on December 26.

“This explains the inconsistencies in the timestamps – but not in the confirmation codes – because they remain the same,” zerforschung wrote in a detailed blog post update and on Twitter.

“And the inconsistencies also exists in them. The confirmation codes are ascending, so the result from the 16th should have a lower number than the one from [the] 22nd. However, it is the other way around.”

Australian Border Force, Djokovic’s lawyers and Tennis Australia were contacted for comment.

In May 2021, European news agency N1 reported that fake COVID-19 PCR results were able to be purchased in Serbia.

The news agency cited “sources at the Serbian government e-administration office” confirming a false PCR result bought by journalists on the black market was faked using Photoshop and a national personal ID number.

The false document purchased by the investigative journalists, who were seeking to prove the ability to buy fake lab results, had the same Institute of Public Health of Serbia letterhead as the document provided by Djokovic. The Sydney Morning Herald and The Age does not suggest Djokovic purchased false test results.

Unless it's for travel, you only get a PCR test if you have symptoms and think you may have caught Covid, in some cases if you've been exposed to someone with Covid. So, even if he didn't get the test results back until after he cuddled the little kids, he still would either have had symptoms or known he'd been exposed and should have been self-isolating anyway.

I imagine the Government is wargaming it. The Serbians will be violent either way, either in protest to a deportation or when he is inevitably abused in the stadium. So that’s a given. Then, it’s about which voters are motivated and demotivated. For a conservative Liberal/National government they have to assume that most antivaxxers are also their supporters.

Journalists unaware Novak Djokovic had tested positive for Covid two days prior to interview

Two journalists working for French sports newspaper L’Equipe were not told Novak Djokovic was Covid-positive before, during or after a 33-minute interview with the tennis star in Belgrade on December 18, the outlet reported Wednesday.

Journalists Franck Ramella and photographer Etienne Garnier reported that Djokovic seemed “well,” despite it later emerging he had been diagnosed with Covid-19 two days prior.

Separately on Wednesday, Djokovic acknowledged he knew of the positive diagnosis at the time of the interview and apologized.

The L’Equipe article states Ramella has since tested negative to Covid-19, but it does not mention Garnier’s health.

Ramella told CNN he was en route to Melbourne to cover the Australian Open.

Djokovic, who is unvaccinated, is currently fighting to be allowed into Australia to compete in the tournament.

He applied for an exemption from Australian rules mandating that arrivals must be fully-vaccinated against Covid-19, using a positive test result on December 16 as evidence that he should be allowed into the country. Photos posted on social media show him unmasked at events in mid-December,

While Djokovic admitted Wednesday that he did not immediately isolate after testing positive for Covid-19, he denied knowing he had the virus when attending public events.

The French journalists' interview with Djokovic was conducted in Belgrade at the player’s Novak Center, L’Equipe reported.

“As we waited for about 90 minutes, the (masked) staff offered us an excellent assortment of sliced fruit. At last Djokovic arrived, all smiles, masked as well,” a CNN translation of the French language article reads.

It is unclear whether staff at the Novak Center knew of Djokovic’s positive diagnosis.

The article acknowledged that Djokovic kept his mask on for the duration of the indoor interview, but took it off when asked to pose for a professional photo without it.

“For thirty-three minutes, according to the timer on the recorder, Djokovic answered the questions with confidence. We were being safe, facing each other at a distance of nearly one meter, sitting on opposite sides of a long rectangular table. When Etienne asked him to remove his mask for five minutes during the interview, Djokovic refused,” the article reads.

“Then the photo session took place. Obviously, the Serbian champion removed his mask. We did not want him to pose with his face half-covered. Then he followed the instructions of Etienne, who was masked. He held the trophy at arm's length, moving from one position to another, smiling or grinning to show that he had won. He also shouted to make it even more genuine," the story continues.

The article was published just hours before Djokovic apologized for keeping the interview appointment despite being aware of his positive PCR diagnosis from a test done two days earlier.

“I felt obliged to go ahead and conduct the L’Equipe interview as I didn’t want to let the journalist down, but did ensure I socially distanced and wore a mask except when my photograph was being taken,” Djokovic wrote in a statement published on his social media accounts Wednesday.

“While I went home after the interview to isolate for the required period, on reflection, this was an error of judgement and I accept that I should have rescheduled this commitment.”

Someone said way back in the other thread that another attempt to kick Novaxx out would also go through review by the same judge as before. We know from the hearing that judge was sympathetic to Novaxx “what more could he have done?!” and judgmental about the government not giving due process. So if that is true, the government is likely showing restraint and deliberation here, giving Novaxx’s team a full chance to submit its arguments, and will likely issue a very carefully reasoned explanation if they kick him out again.

And/or, they may be waiting until the last possible minute before the AO draw, so that Novaxx doesn’t have time to get himself back out of trouble again and the AO has to proceed without him.

I think Craig Tilley might well be in some trouble once the immediate Novax situation subsides. Then there are the 'two independent committees' we keep hearing about. I don't believe for one second he had COVID recently - it is a scam to slip into the AO on what he thinks are his own terms. The slight puzzle is why they waited till 16 December, when they could have done this a week or two earlier and cut off at least some of the issues being raised. The answer probably lies in what Novax himself wanted and what his diary dictated - through arrogance and carelessness he wasn't prepared to do things properly. He couldn't even manage to do this the week before Christmas. Another interesting point is his coach and entourage, who all got through to Australia no problem, which must mean, unlike their boss, they are all properly vaccinated.

Any lawyers here can explain - I find it confusing that a decision made by a minister can't be appealed - but the reasons for it can be? What does that mean in practice? Does it mean that Djokovic hypothetically can't get off based on procedure like he did already but can stay if the judge rules that the minister's reasons are unlawful??

R360, my assessment, based on random internet research: there are two kinds of orders he can issue, an “order of deportation” and an “order of removal.” The later is a super-power type thing and can’t be appealed. The former can be appealed. It turns on the basis of his decision, I.e., his reasons. An order of removal requires (again, as I understand it) a finding that Djokovic is some sort of threat to Australia. Virtually any other reason makes the order one that can be appealed.

Below is from The Guardian live blog. Given these comments by Morrison I can't understand why it is taking so long. It would appear to be cut and dried that Djokovic has no right to enter and remain in the country.

IF he rules against Djoker, the only reason I can think of is to make sure he has a watertight case and to prevent that judge from throwing a spanner into the works.

Well, the Age says Friday is likely but then again, they did say Thursday was likely. Another weird/interesting thing - they claim that the delayed draw was to see if the presser would announce the cancellation of Novax's visa:

R572 I don't deny that there's a ton of corruption but it's relative. If you look up corruption indexes, you can clearly see a pattern about which countries are worse. Then you compare that against how developed and wealthy they are and it's pretty clear that there's a link.

That's why I will never apologise for wanting to hold people like Djokovic to account. It pressurises politicians (yes, most of them are corrupt and greedy fucks - perhaps that's simply human nature - but we are somewhat better at holding them to account which is better for everyone and the country in the end.)

Looks like typical political buck-passing. Tennis authorities waiting for government to kick him out, politicians waiting for tennis authorities to do it. Nobody wants to take the heat for it, everyone stalling, waiting for the other guy to do it. Nice to know politicians are the same everywhere.
