They no doubt bought the Equinox building’s air rights. You can do that with adjacent (defined broadly) parcels. That means that building can never build higher.

It seems short enough that structural integrity shouldn't be a problem. Still, I get that the mental aspect might drive some people nuts or not want to live there in the first place.
