Is Florida really requiring genital checks in order for kids to play athletics?

I’m seeing this trend on twitter that the Florida legislature is going to require genital checks of kids to play sports to be sure they are matched up with their biological sex. Is that correct?

Chase Strangio the trans aclu lawyer is tweeting and retweeting this, but I’m reading where the law actually says that a note from a doctor would suffice. Also can’t a cheek swab determine sex? I think those have been around since the 60s.

I haven’t been an athlete in school for awhile, but boys at least had somewhat of a genital check for an hernias during an athletic physical.

Again haven’t there always been a current physical required in order to be cleared to play a sport? I don’t know what the girls physical involved, but the boys always had a turn your head and cough hernia check.

Nope. Kids are already required to do a physical for sports in Florida.

If there is a question about their sex, then the parent or guardian has to provide proof of the kid’s sex. They can do this by one of three ways:

Physician‘s note confirming sex based on physical exam

Physician’s note confirming sex through chromosome/DNA test

Physician’s note confirming sex through testosterone levels

It’s all in the law.

The physical that is currently required is a clearance and doesn't mandate reveals of sensitive personal medical info. And parents can opt out of it for religious reasons, which then relieves the school of any liability if, for example, the uncleared student has an unknown heart condition.

This new law allows *anyone* to "challenge" a student's sex with no requirement that anyone give a valid basis for the challenge, and that MANDATES with no exception the exam and reveal. It also gives students a right to sue if they claim they've been harmed by a school failing to meet these requirements, but does NOT give the right to sue to anyone who is unfairly targeted or harassed by baseless or repeated demands. And there's no limit in the law as to how many times a child can be challenged.

If you don't see what a handy harassment tool that is for ALL LGBTQ and non-gender-conforming kids you're 1) an idiot, 2) anti-gay, and/or 3) a heterosexist.

A birth certificate is required in Florida to play school and league sports r10. Unless somehow that document is now considered “sensitive personal medical info”. I know in crazyland, anything you don’t like is considered harmful and heretical, such as an “M” on the birth certificate. But fortunately the rest of us still live in the real world where such a “reveal” isn’t the least bit harmful but simply an established biological fact.

Here’s the bill.

I actually see where you’re coming from r13. The language about dispute is vague and open to interpretation. It says nothing about to what degree schools and leagues should take each dispute seriously. I guess that’s left to their own discretion.

However, this entire situation was inevitable. The activists have pushed too hard and too relentlessly all the while offering no compromise or attempts to hear from the other side the very reasonable arguments about why sex segregation in sports exists. This is a problem of their own making and the chickens are coming home to roost.

Doubt this comes up more than once a year as a physical is required annually. Once the school has the info, the results are settled for the year. Anyone trying to challenge within the school year will either be shut down by the school with the information available or the challenged student will be taking the school to court--and maybe the person challenging. Schools will be out in front of this to avoid headaches and unwelcome publicity.

There is nothing remotely "inevitable" about "anyone can challenge a student's sex for any reason and then it's on the student to prove it. Oh, and you can sue the school for not making the student prove it, but the student can't sue for being harassed by this law."

This has nothing to do with "reasonable arguments" or lack thereof. This is straight up anti-LGBTQ harassment under the thin guise of "protecting" girls' sports, which the very people who passed this law don't give a shit about otherwise, because they're always defunding girls' sports and refusing to enforce Title IX. If they didn't think of this as a wedge opportunity, they'd be using something else.

There's nothing the law that says the annual physical "settles" the issue for the year. There's no limit on challenges. There's no prerequisite for challenges. There's no cause of action for the student who is challenged, but there is a cause of action for anyone who says they suffered "direct or indirect harm" as a result of the school failing to enforce this law. And you should be ashamed of yourself for being such a fucking moron, because no matter how sensible you THINK your anti-trans arguments are, there is no justification whatsoever for championing or pooh-poohing really bad and unnecessary laws that target children, especially several categories of vulnerable children.

Because if it were "only" about trans in sports, the issue would be settled for the entirety of the students K-12 schooling with a law that says you play for the team that corresponds with your birth certificate/sex. It would still be an anti-trans law, but it would be a simple fix. But they don't actually give a flying fuck about sports, and certainly not girls' sports. They're not interested in a simple fix. They want to create a hostile, endlessly harassing, and even litigious atmosphere for ALL LGBTQ and non-conforming children. That's what's happening, and a bunch of deplorable trolls on a gay website are cheering it on.

R34 you do know that boys physicals have always included a standard hernia test where the doctor feels around the testis and instructs the male to turn his head an cough right?

Linked is the general summary that a woman’s sports physical involves where genitals as well as menstrual history are observed and discussed.

I never recall effeminate boys and masculine girls being questioned on their sex before.

On this issue, the science is there on the differences and the minor changes that occur after transition. Those are hard to dispute.

Veronica Ivy/Rachel McKinnon is who people on the opposite side of this issue are relying on. A philosophy PhD that was forced out of a tenured professorship after a measly couple of years.

Why this extra step of when a student is challenged they have to produce one of three means of "proof" if the school's required physical already covers this? Why, when the child's BIRTH CERTIFICATE would cover this? This law puts no limit on how many times a student can be "challenged." The law requires no good faith basis or even minimum standard for a challenge. And with the threat of lawsuits going only in the direction of the school not enforcing the law, there will be tremendous pressure to take each and every "challenge" seriously and force the students to do this over and over again. The whole point is endless harassment.

R37 never answers the question whether or not biological males should be allowed to compete with biological females. That’s really the crux of the issue, and it’s a losing issue. Most people don’t think they should. You can’t really crouch this around homophobia, being gay isn’t a biological advantage, being gay doesn’t deny science, being gay doesn’t take away from someone else.

Perhaps if your argument was more than TRANS WOMEN ARE WOMEN and backed up with some, ANY fact at all it wouldn’t have gone to this extreme.

In reality, this legislation is totally unnecessary. But it’s not about anti-trans, or LGGTQ harassment. It’s totally about pandering to trumpista, right wing evangelical Assholes. It’s purely political and is so poorly drafted that there appears to be many loopholes. For example, if a health care provider’s “note” about a student’s biological gender is a sufficient “defense” to a challenge, how is the required physical not considered such a “note?”

The law is quite ridiculous. But, in some ways, so is the hysteria over its passage. In actuality, it might not have much effect on anything of substance.

Your regular reminder that R10 and his ilk are anti-gay, and the anti-trans movement began as a reworking of the anti-gay movement. The far-right Christian crowd weren't making any headway with their anti-gay movement so they changed it to anti-trans, and took all the usual tropes like "gays are pedos and perverts who want to harm our kids" to "trans are pedos and perverts who want to harm our kids"... and it worked.

This law is meant to harass non-gender-conforming kids of all types. Considering we've already seen little girls who are not trans kicked off sports teams in school because they "look like boys," you can count on feminine little gaylings and butch little lesbians getting harassed as much or more than trans kids.
